CALL TO ORDER: Meeting called to order at 6:03 P.M. 2_ ROLL CALL: Present: WRIGHT, KOELLISCH, GUERBER, and SMITH. Absent: VILLEGAS. A quorum is present. 3_ CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of May 15, 2017. City Planner, Mike Williams, explains that New Business item 6A VAC -02-17 — Vacation to the Amended Plat of Flint Estates Subdivision — Jacksons Food Stores/Scott Stom is associated with a Lot Line Adjustment application and requests that the item be moved to the consent agenda. Guerber makes a motion to move item 6A to the consent agenda. Seconded by Smith. ALL AYES... MOTION CARRIES. 6A. VAC -02-17 — Vacation to the Amended Plat of Flint Estates Subdivision — Jacksons Food Stores/Scott Stam: Jacksons Food Stores/Scott Stom, represented by Tamara Thompson with the Land Group, Inc., is requesting a vacation of the public utility, drainage, and irrigation easement along the common side lot line of Lots 1 and 9, Block 2, within the Amended Plat of Flint Estates Subdivision. The 7.04 -acre site is located on the northeast corner of West State Street (SH -44) and North Park Lane at 3950 West State Street. Guerber moves to approve consent agenda item 3A minutes of May 15, 2017 and item 6A VAC -02-17. Seconded by Koellisch. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE 5. PUBLIC HEARINGS: A. PP/FP-02-17 & CU -02-17 — Kestrel Commons Subdivision — David Callister: David Callister, represented by Travis Perry, is requesting combined preliminary/final plat and conditional use permit approval to allow for one multi -family dwelling (4 -units) for Kestrel Commons Subdivision, a 2 -lot (1 multi -family, I commercial) mixed-use development. The 0.38 - acre site is located on the east side of South Kestrel Place approximately 250 -feet south of West State Street at 174 South Kestrel Place. City Planner, Mike Williams, requests that item 5A PP/FP-02-17 & CU -02-17 Kestrel Commons Subdivision be continued. Koellisch makes a motion to continue item 5A to the June 1911 meeting. RZ-04-17 — Rezone from MU Mixed Use to MU -DA Mixed Use with a Development Agreement in lieu of a PUD for Mustang Corner Mixed Use Commercial Development — Jacksons Food Stores/Scott Stom: Jacksons Food Stores/Scott Stom, represented by Todd Lakey with Borton-Lakey Law and Policy, is requesting a rezone from MU (Mixed Use) to MU - Page 1 of 4 K. The 11.22 -acre site is located on the northeast corner of Park Lane and State Highway 44, on Lots 1, 4, and 9 of the Amended Plat of Flint Estates, at 3950 West State Street. Todd Lakey, Borton-Lakey Law and Policy, 141 East Carlton Avenue, Meridian, Idaho. The applicant provides a brief overview of the application. The applicant responds to questions from the Commission. City Planner, Mike Williams, provides a detailed overview of the application. Chairman Wright opens the Public Hearing. There were no members of the public present to testify. Chairman Wright closes the Public Hearing. General discussion amongst the Commission regarding the application. Guerber moves that Planning and Zoning recommend for approval item 5B RZ-04-17 — Rezone from MU (Mixed Use) to MU -DA (Mixed Use with a Development Agreement in lieu of a PUD) for Mustang Crossing Mixed Use Commercial Development — Jacksons Food Stores/Scott Stom with the following changes to the staff recommendations: in regard to item 3.4 and the commercial size of buildings, indicate that the buildings should not exceed 14,000 - square. feet, but allow any building beyond that to go to public hearing before the City Council. With the correction in the paragraph from 3.5 to read as 3.6. Item 3.6 to concur with the recommendation of the applicant in regard to prohibitions. Item 3.9 concur with application's recommendation for irrigation. Item 3.12 regarding the fencing to allow pre -fab concrete, 6 -foot and striking the CMU requirement. Item 3.15 completion of pathway in its entirety adjacent to State Street the full length to the property to the east. Item 3.16 agreement with recommendation from applicant for parking. Item 3.22 allowing the simultaneous construction of the facility along with the requirements from ITD so once there is full compliance with that the city would then be allowed to issue permit for occupancy. Discussion. Seconded by Smith. City Planner, Mike Williams, requests clarification regarding the overall motion and regarding the timing of fence construction. Guerber clarifies that the fence shall be required as part of phase two. ALL AYES... MOTION CARRIES. C. CU-03-17/PPUD-02-17/PP-02-17 — Feldspar Subdivision — Eagle Single Family, LLC: Eagle Single Family, LLC, represented by John Rennison, P.E., with Rennison Engineering, is requesting conditional use permit, preliminary development plan, and preliminary plat approvals for Feldspar Subdivision, a 21 -lot (13 -buildable, 8 -common) residential planned unit development. The 3.44 -acres site is located on the east side of North Taylor Street approximately 950 -feet north of the intersection of West State Street and North Taylor Street at 368 North Taylor Street. Nelson expressed concerns about increased traffic along Taylor Street, the name of the proposed street, and the location of the proposed fire hydrant. Allison Green, 285 North Taylor Street. Green opposes the application. Patricia Roloff, 276 North Taylor Street. Roloff expresses concerns about potential damage to the existing well during construction. Amanda Van Paepeghem, 337 North Taylor Street. Van Paepeghem opposes the application. Pierre Gaudreau, 350 North Taylor Street. Gaudreau opposes the application due to the proposed density, concerns about potential damage to the existing well, concerns about the stability of existing infrastructure along Taylor Street, and concerns about the placement of a proposed streetlight. Jerry Deckard, 322 North Cobblestone Lane. Deckard requests that privacy fencing be installed around the perimeter of the subdivision, similar to the style seen in the Once Upon a Sub Subdivision. Herman Doering, 11224 West Musket Street, Boise, Idaho. Doering is representing the Seventh Day Adventist Church. Doering is neither pro nor con, but inquires whether privacy fencing will be installed and would like to confirm that the subdivision common area will not have access to the church property. Wendy Smith, 364 North Cobblestone Lane. Smith does not oppose the subdivision, but is requesting that solid fencing be installed along Cobblestone prior to construction beginning to minimize dust/dirt to adjacent properties during construction. Tom Letz, 302 North Taylor Street. Letz opposes the application due to parking concerns, the proposed density, the possibility of two-story structures, and concerns about damage to the existing well. Letz requests an assurance from the developer that the existing well will be preserved and suggests involving an attorney to acquire such assurance. Sally McCormick, 404 North Cobblestone Lane. McCormick expresses concerns about noise from the proposed subdivision, drainage concerns, fire department accessibility, density of the project, and the impact that the proposed development will have on the view of the surrounding property owners. Ron Colbeck, 139 North Taylor Street. Colbeck expresses concerns about the safety and security of a single ingress/egress subdivision. The applicant provides rebuttal and addresses the concerns from public testimony and responds to questions from the Commission. Chairman Wright closes the Public Hearing. General discussion amongst the Commission regarding the application. Smith makes a motion to recommend for approval CU-03-17/PPUD-02-17/PP-02-17 — FeIdspar Subdivision with the following conditions: we recommend that two-story homes be optional on lots 15, 16, 17 and the height not to exceed 25 -feet; site specific condition #19 remains as stated; also, we're going to add site specific condition #29 — location of fire hydrant at the corner of what is currently referred to as Taylor Street and Taylor Road. Site Specific Condition #30 — we're going to make the stipulation that the developer run a privacy fence, presumably 6 -feet around the perimeter of the project, material in accordance with city code. Discussion. Add that extra 5 -feet of setback as part of the height allowance and the three lots that can be considered for two stories. VAC -03-17 — Vacation to the Final Plat of Carlene Estates Subdivision — Robin Rissell: Robin Rissell, represented by John Bottles, is requesting a vacation of the 35 -foot wide landscape and irrigation easement located adjacent to North Locust Grove Road within Lot 4, Block 6, within Carlene Estates Subdivision. The site is located on the west side of North Locust Grove Road approximately 550 -feet north of the intersection of West Stafford Street and North Locust Grove Road at 2748 South Pasa Tiempo Way. City Planner Mike Williams explains that the item can either be continued or rescheduled. Guerber moves to continue item 6B VAC -03-17 to the June 1911 meeting. Seconded by Koellisch. ALL AYES... MOTION CARRIES. 7. REPORTS: A. Commission: Commissioner Guerber informed the Commission that the Comprehensive PIan Update will soon be ready for review. B. City Attorney: City Attorney Cherese McLain informs the Commission that they do not need to take action when a continuance has been requested. C. Staff: Clerk reminds the Commission that there will be a joint meeting between City Council and the Planning & Zoning Commission on June 19, 2017. ADJOURNMENT: Guerber moves to adjourn.
