Minutes
1. CALL TO ORDER: Meeting called to order at 6:01 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, and VILLEGAS. Absent: KOELLISCH and
SMITH. A quorum is present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of February 6, 2017.
B. Findings of Fact & Conclusions of Law for RZ-16-16/PP-10-16 — Larkin Village
Subdivision — Paradism Construction — Jim Larkin: Paradigm Construction —Jim Larkin,
represented by Joe Pachner with KM Engineering, LLP, is requesting a rezone from MU
(Mixed Use) to MU -DA (Mixed Use with a development agreement [in lieu of a conditional
use permit]) and preliminary plat approvals for Larkin Village Subdivision, a 17 -lot (Il
residential, 1 commercial, 4 common, and 1 private street) subdivision. The 1.55 -acre site is
located on the south side of East State Street approximately 115 -feet east of South Golden
Eagle Lane at 1301 East State Street.
Staff requests to remove item 3B from the consent agenda for discussion.
Guerber makes a motion to accept the consent agenda without item 3B. Seconded by
Wright. ALL AYES... MOTION CARRIES.
City Planner, Mike Williams explains that setbacks were not addressed as part of the original
motion for item 3B.
Discussion regarding item 3B.
The Commission requests that the applicants confirm that they are in agreeance with the setbacks
recommended by staff.
Jim Larkin, 561 East Fishing Creek Lane, Eagle, Idaho, and Joe Pachner with KM Engineering,
9233 West State Street, Boise, Idaho. The applicant and representative explain that they are in
agreeance with the 20 -foot second -story setbacks as discussed during the February 6, 2017
Planning & Zoning Commission meeting.
Guerber makes a motion to approve the Findings of Fact & Conclusions of Law for RZ-16-
16/PP-10-16 — Larkin Village Subdivision as presented in the written Findings of Fact for
item 3B. Seconded by Wright. ALL AYES... MOTION CARRIES.

5. PUBLIC HEARINGS:
A. CPA-02-16/RZ-14-16/CU-08-16/PPUD-03-16/PP_-08-16 — VaLynn Subdivision — Roth
Homes: Roth Homes, represented by Mark Butler with Land Consultants, Inc., is requesting
a comprehensive plan map amendment from Residential Four to Residential Five, a rezone
from R-4 (Residential) to R -5 -DA -P (Residential with a development agreement — PUD),
conditional use permit, preliminary development plan, and preliminary plat approvals for
VaLynn Village Subdivision, a 28-Iot (23 buildable, 5 common) residential planned unit
development. The 4.64 -acre site is located at the terminus of West Cowman Court and South
Grandean Way at 701 West Cowman Court.
Mark Butler, 1675 East Bishop Way. The applicant provides a brief overview of the application.
City Planner, Mike Williams, provides a detailed overview of the application.
Chairman Wright opens the Public Hearing.
Doug Newbrand, 645 West Cowman Court. Newbrand opposes the application due to the
proposed density and has concerns about increased traffic flow through Cowman Court.
Kevin Lee, 172 South Taylor Street. Lee opposes the application due to concerns about density
and the potential of speeding cars on surrounding streets, and supports the application due to off-
site improvements proposed and thorough communication from the applicant.
Steve Minert, 709 West Aikens Court. Minert opposes the application due to concerns about
increased traffic and increased sound in the area.
Heather Paredes, 667 West Cowman Court. Paredes opposes the application due to concerns
about increased traffic passing through Cowman Court.
Nicki Hill, 180 South Grandean Way. Hill inquired as to the anticipated construction timelines.
Kyle Safely Anderson, 130 South Grandean Way. Safely Anderson opposes the application due
to concerns about increased traffic in the area.
The applicant provides rebuttal and addresses the concerns from public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Wright makes a motion to recommend for approval item 5A CPA-02-16/RZ-14-16/CU-08-
16/PPUD-03-16/PP-08-16 with the VaLynn Subdivision - the comprehensive plan
amendment from Residential Four to Transitional Residential. Seconded by Guerber. ALL
AYES... MOTION CARRIES.
Wright makes a recommendation for approval of item 5A CPA-02-16/RZ-14-16/CU-08-
16/PPUD-03-16/PP-08-16, a rezone from R-4 Residential to R-5 with a development
agreement with the PUD Conditional Use permit with the following considerations:
Condition of Development
3.4 (c). All residential structures shall require Architectural Control Committee (ACC)
approval prior to the issuance of any building permits to assure that the homes are
designed to he compatible and consistent with the "C-Faftsman Arts & Crafts Mission
Revival and Mediterranean' theme of the development;
3.6. The single-family dwellings shall be constructed utilizing "Fee -fie Northwest
Craftsman Arts & Crafts. Mission Revival and Mediterranean' style architecture;
3.10. In conjunction with 3.9 above, all living trees that do not encroach upon the buildable
or -en an any lots or development infrastructure areas shall be preserved, unless otherwise
determined by the Design Review Board or City Council. A detailed landscape plan

showing how the trees will be integrated into the open space areas (unless approved for
removal and mitigation by the Design Review Board or City Council) shall be provided for
Design Review Board approval prior to the submittal of a final plat application;
3.18. As part of the shared alley access maintenance requirement stated in Note 9 of the
Alderwood Village Final Plat , Owner
shall seal coat the shared alley prior to the City Clerk signing the final plat.
Site Specific Conditions of Approval
#5. The developer shall provide shade -class trees (landscape plan to be reviewed and
approved by the Design Review Board) along both sides of all streets within this
development. Trees shall be placed at the front of each lot generally at each side property
line, or as approved by the Design Review Board. The trees shall be located within an -S -
foot a 6 -foot wide landscape strip, with ACHD approved root barrier, between the 5 -foot
wide concrete sidewalk and the curb. Prior to the City Clerk signing the final plat the
applicant shall either install the required trees, sod, and irrigation or provide the City with
a letter of credit for 150% of the cost of the installation of all Iandscape and irrigation
improvements. Trees shall be installed prior to obtaining any occupancy permits for the
homes. A temporary occupancy may be issued if weather does not permit landscaping.
Partial reduction of the surety may be permitted for any portion of the development that is
completed, including street trees that have been installed. On-going surety for street trees
for all undeveloped portions of the development will be required through project
completion;

proportionate share of maintenance costs of the shared alley shall be 50% from each

#13. Should the Council approve the design of the private streets (with the eNeeption of the

preliminary development plan/preliminary plat with plat note #15 revised to contain the
following information: 1) conveys to each lot owner within the subdiAsien abutting the
private street, which are to be served by the private street, the perpetual right of ingress
and egress over the described private street, 2) provide that such perpetual easement shall
run with the land, 3) provide that the restrictive covenant for maintenance of the private
street cannot be modified and the homeowners'/property owners' association or other
entity cannot be dissolved without the express consent of the City. The revised preliminary
development plan/preliminary plat shall be provided prior to submittal of a final plat

#16. Should the private streets be approved, the cross section submitted, as shown on the
Preliminary Plat, is agnroved. -

#17. Provide a revised preliminary development plan/preliminary plat with a public street
cross-section showing a minimum eight -feoE{$!4 six foot (61) wide landscape strip located
between the roadway and detached sidewalk on both sides of the street. The revised
preliminary development plan/preliminary plat shall be provided prior to submittal of a
final plat application. (ECC 9 -4 -I -6[F][3]);
#23. The applicant shall be required to obtain the proper permit and subsequently abandon
the existing septic system and drainfield located on-site. Upon removal abandonment the
applicant shall provide documentation from Central District Health Department indicating
the septic system and drainfield were properly abandoned prior to the City Clerk signing
the final plat;
#27. All construction traffic associated with the construction of VaLynn Village
Subdivision infrastructure and homes, except for delivery and for utility extension needed
though the alley utilities easement shall be prohibited from utilizing the alley located
adjacent to the western boundary of the subdivision.

6. NEW BUSINESS:
A. Elect Chair and Vice Chair for the Planning and Zoning Commission.
Discussion.
Wright makes a motion to table item 6A Election of Chair and Vice Chair for the Planning
and Zoning Commission until the next available Planning and Zoning Commission
meeting. Seconded by Villegas. ALL AYES... MOTION CARRIES.
7. REPORTS:
A. Commission: Commissioner Guerber provides an update about the latest Eagle is HOME
meeting and the Economic Development Open House.
