ROLL CALL: Present: WRIGHT, VILLEGAS, SMITH. Absent: GUERBER, KOELLISCH. A Quorum is present. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of December 5, 2016. Smith would like to make a motion to recommend for approval the consent agenda as written. Seconded by Villegas. ALL AYES... MOTION CARRIES. 4_ UNFINISHED BUSINESS: A. A-05-16/RZ-09-161CU-07-161PPUD-02-16/PP-04-16 — Brookway Subdivision — Iron Mountain Real Estate: Iron Mountain Real Estate, represented by Kent Brown, is requesting an annexation, rezone from RUT (Residential -Urban Transition — Ada County designation) to R -6 -DA -P and R -2 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan and preliminary plat approvals for Brookway Subdivision, a 194 -lot (180 -residential, 14 -common) residential planned unit development. The 89.35 -acre site is generally located on the west side of North Lanewood Road, approximately 112—mile north of the intersection of North Lanewood Road and West Floating Feather Road. The applicant has requested these applications be tivithdrativn. City Planner, Mike Williams, explains that the applicant has requested to withdraw the applications for Brookway Subdivision. PUBLIC HEARINGS: A. CPA-01-161A-07-161RZ-12-16/PP-07-16 — Tandem Ridge_ Subdivision — Guy Hendrickson & Greg Mcvay: Guy Hendrickson/Greg Mcvay, represented by Shawn Nickel with Rennison Engineering, are requesting a comprehensive plan map amendment to High Density Residential, annexation, rezone from C2 (Community Commercial — Ada County designation) to MU -DA (Mixed Use with development agreement [in lieu of a conditional use permit]), and preliminary plat approvals for Tandem Ridge Subdivision, a 25 -lot (24 buildable, 1 common) single-family residential subdivision. The 1.98 -acre site is located on the east side of North Horseshoe Bend Road approximately 120 -feet south of West Goose Creek Road at I2000 North Horseshoe Bend Road. Shawn Nickel, 1589 North Estancia Place. The representative gives a brief overview of the application. Guy Hendrickson, 1772 South Lakemoor Way. The applicant responds to questions from the Commission regarding the potential contaminants on the site. Nickel responds to questions from the Commission. City Attorney, Cherese McLain, gives a brief explanation of water rights and wells, and legal remedies with regards to well interference. Baird Spencer responds to questions from the Commission. City Planner, Mike Williams, gives a detailed overview of the application and answers questions from the Commission. Chairman Wright opens the Public Hearing. Michael Ling, 2316 North Eagle Creek Lane. Ling supports the application and development of the property. Janet Gates, 2887 East Pine Hollow Lane. Gates opposes the application and would prefer the city purchase the property to use for open space. Joan Johnston, 10770 Janie Road. Johnston opposes the application due to higher density than existing surroundings, increased traffic, and parking concerns. Bev Roth, 9989 Janie Road. Roth opposes the application due to the density and height in relation to the foothills, concerns about water and viability of wells on the property, lack of sidewalks in the proposed subdivision, concerns about use of tax -payer money, parking along Horseshoe Bend Road during events at the Bike Park, concerns about insufficient parking at the development, traffic on Horseshoe Bend Road, effect of development of wildlife, fire danger in the foothills, and insufficient water supply in the area. Connie Barton, 11025 Janie Road. Barton opposes the application due to concerns about insufficient water supply, density of the proposed development, illegal fireworks usage in the area, fire danger in the area, and traffic/the ability to evacuate the area in the event of a fire in the area. Craig Brasher, 2333 North Eagle Creek Lane. Brasher is the current President of the Eagle Crest Subdivision Home Owners Association (HOA), and Vice -Chairman of the City of Eagle's Design Review Board, and is not representing the consensus view of the HOA, or the Design Review Board. Brasher supports the CPA and annexation applications, but has concerns about high-density development on the site, recommends requiring the development to use existing wells if viable, and commends the applicants for being forthcoming about plans for development. Lee Hartman, 2177 North Trail Creek Lane. Hartman opposes the application due to the high- density of the proposed development, has concerns about water availability, traffic flow and parking on private streets within the development, and accessibility for the fire department. Shawn Nickel provides rebuttal and addresses concerns from public testimony. Shawn Nickel and Guy Hendrickson address questions from the Commission. Chairman Wright closes the Public Hearing. General discussion amongst the Commission regarding the application. Smith would like to make a motion to recommend for approval item CPA -01-16. Seconded by Villegas. ALL AYES... MOTION CARRIES. Wright will make a motion to recommend for approval item 5A, the Tandem Ridge Subdivision, with the following recommendations: to #3.4, on page 5 of 50, to reflect a 10 - foot living space and an 8 -foot garage under the front setbacks, and then, again, additional changes under site specific conditions for approval, to remove section #9, on page 8 of 50, site specific condition for approval #16 to change in the first line 8 -feet to 10 -feet residential living portion of the home, and the second line to change 10 -feet to 8 -feet, representing 8 - feet to the garage. In addition to that, site specific condition of approval #19, found on page 8 of 50, for the waiver of requirement to provide pressurized irrigation, we would also like Page 2 of 3 KAP&ZW1NUTES1201WZ-12.19.1 Gmhdoc to include language that the applicant is to provide language according to staff designating a professional entity certification of the failure of the well before this provision can be vacated or moved on from. Seconded by Smith. City Planner, Mike Williams, recommends striking Site Specific Condition of Approval #16 because the preliminary plat already reflects the correct information. Wright will amend my motion to strike Site Specific Condition of Approval #16, if the maker of the second would concur. Seconded by Smith. Discussion amongst the Commission about Design Review of the application. City Planner, Nichoel Baird Spencer, requests clarification regarding which aspects of the development the Commission would like the Design Review Board to review. Wright: I am going to amend one more time under the discussion phase of this motion, my initial motion, as long as we can maintain a second on it, to add a site specific condition of approval 24, that will eventually be a 22, but 24, that architectural review of this application shall be provided through the Design Review Board with the City of Eagle... City Planner, Nichoel Baird Spencer, requests that Eagle City Code 8-2A be cited in the motion. Wright: ...pursuant to Eagle Code 8-2A. Seconded by Smith. ALL AYES... MOTION CARRIES. 6. Commission: Commissioner Smith recommended having a handicap -assisted door at City Hall; Chairman Wright informed the Commission about an update on the Planning and Zoning Commission that he provided to the City Council at the most recent City Council Meeting. B. City Attorney: NONE C. Staff: City Planner, Nichoel Baird Spencer, provided an update regarding the progress of the update on the Comprehensive Plan. 8.
