CALL TO ORDER: Meeting called to order at 6:01 P.M.
ROLL CALL: Present: WRIGHT, VILLEGAS, GUERBER, KOELLISCH. Absent: SMITH.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of November 7, 2016
Koellisch makes a motion to recommend the consent agenda as written. Seconded by
Guerber. ALL AYES... MOTION CARRIES.
4_ UNFINISHED BUSINESS: NONE
PUBLIC HEARINGS:
A. A-05-16/RZ-09-16/CU-07-16/PPUD-02-16/PP-04-16 — Brookway Subdivision — Iron
Mountain Real Estate: Iron Mountain Real Estate, represented by Kent Brown, is
requesting an annexation, rezone from RUT (Residential -Urban Transition — Ada County
designation) to R -6 -DA -P and R -2 -DA -P (Residential with a development agreement —
PUD), conditional use permit, preliminary development plan and preliminary plat approvals
for Brookway Subdivision, a 194 -lot (180 -residential, 14 -common) residential planned unit
development. The 89.35 -acre site is generally located on the west side of North Lanewood
Road, approximately 1/2—mile north of the intersection of North Lanewood Road and West
Floating Feather Road.
Kent Brown, 3161 East Springwood, Meridian, Idaho. The applicant gives a brief overview
of the application.
City Planner, Mike Williams, gives a detailed overview of the application
Chairman Wright opens the Public Hearing.
Tom Brengle, 2475 North Sun Valley Place. Brengle opposes the application due to concerns
about increased traffic on Beacon Light Road.
Theresa Johnson, 3417 North Croft Way. Johnson opposes the application due to concerns
that the proposed application will not fit with the surrounding area, and is not in line with the
proposed use (transition area) that was identified for the area by the Rural Planning
Committee.
Kent Brown provides rebuttal and addresses the concerns from public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Guerber makes a motion that we approve the annexation/rezone, conditional use

permit, preliminary development plan, and preliminary plat for rile number A-05-
16/RZ-09-16/CU-07-16/PPUD-02-16/PP-04-16, and as presented, stick with the
recommendations of the city staff to be followed on those items of disagreement.
MOTION FAILS.
Villegas would like to make a motion to table this, would like to get more information.
City Attorney asks for clarification. Chairman Wright restates the motion to table Item
5A to the next possible meeting time, until December 5, with also a request to have our
City Long Term Planner available at that time for questions. Seconded by Koellisch.
THREE AYES, GUERBER NAY... MOTION CARRIES.
B. RZ-11-16 — Rezone from MU to MU -DA for a Senior Living Facility — Riverside Senior
Development Co. LLC: Riverside SR Development Co. LLC, represented by Tamara
Thompson with The Land Group, Inc., is requesting a rezone from MU (Mixed Use) to MU -
DA (Mixed Use with a development agreement [in lieu of a conditional use permit]) for a
146 -unit senior living facility. The 6.0 -acre site is generally located southeast of Merrill
Park and adjacent to the southern boundary of Merrill Park approximately 250 -feet east of
the intersection of East Shore Drive and East Riverside Drive.
Tamara Thompson, The Land Group, 462 East Shore Drive. The applicant gives a brief
overview of the application.
Tom Bobo, Grossman Property Companies. Grossman Property Companies is site owner and
landowner of the majority of surrounding properties, and is in support of the project.
Greg Van Patten, The Wolff Company. Van Patten gives brief overview of the project and
The Wolff Company.
City Planner, Mike Williams, gives a detailed overview of the application and answers
questions from the Commission.
Chairman Wright opens the Public Hearing.
No one present for public testimony.
Chairman Wright requests a recess at 7:55 P.M.
Chairman Wright resumes the meeting at 8:03 P.M.
Tamara Thompson, with The Land Group, and Greg Van Patten, with The Wolff Company,
respond to questions from the Commission.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Villegas would like to recommend for approval application RZ-I1-16, Rezone from MU
to MU with a DA for a Senior Living Facility, Riverside Senior Development Co., with
the staffs recommended conditions of approval, as well as the I don't know if you want
to call it concessions or modifications that the applicant was willing to concede on, and
obviously leaving the height as recommended by staff. Seconded by Guerber.
City Planner, Mike Williams, requests clarification on the motion, and confirms that staff
recommendation 3.5 will remain unchanged at 43 -feet and that staff recommendation 3.16
will be amended to reflect only that the owner shall provide maintenance access for the City.

6. NEW BUSINESS:
A. VAC -03-16 — Vacation to the final plat of Irish Acres Subdivision — Coleman Homes
LLC: Coleman Homes, LLC, represented by Josh Mann with Engineering Solutions, LLP, is

requesting a vacation of the public utility, irrigation, and drainage easements from Lots 1, 3,
4, 5, and 6, Block 1, within Irish Acres Subdivision. The site is located on the west side of
North Linder Road approximately 390 -feet north of the intersection of SH -44 and North
Linder Road at 341 North Linder Road.
City Planner, Mike Williams, provides a detailed overview of the application.
Villegas makes motion that we recommend for approval item 6A application number
VAC -03-16, Vacation to the final plat of Irish Acres Subdivision. Seconded by
Koellisch. ALL AYES... MOTION CARRIES.

B. City Attorney: Cherese McLain provides brief update regarding the IMC appeal.
C. Staff: City Planner, Mike Williams, provides a brief update to the Commission regarding
Senora Creek Subdivision No. 3 and the Isla del Rio development.
