ROLL CALL: Present: WRIGHT, SMITH, GUERBER, AND KOELLISCH. Absent: VILLEGAS. A quorum is present. 31, CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of August 1, 2016. B. Findings of Fact and Conclusions of Law for PP/FP-04-16 — Wallace Subdivision -- John R. jantz: John R. Jantz, represented by Joe Canning, P. E., with B & A Engineers, Inc., is requesting combined preliminary plat/final plat approval for Wallace Subdivision, a 2 -lot industrial subdivision. The 2.81 -acre site is located approximately 270 -feet northwest of the intersection of South Edgewood Street and East Iron Eagle Drive at 1447 East State Street. C. Findings of Fact and Conclusions of Law for PP-03-16/RZ-01-07 MODS — CI Subdivision — Dave Callister: Dave Callister, represented by John Carpenter, P.E., with T- O Engineers, Inc., is requesting a development agreement modification and preliminary plat approval for Cl Subdivision, an 11 -lot (9 buildable and 2 common) residential subdivision. The 5.70 -acre site is located on the east side of Park Lane approximately 1,200 -feet south of Beacon Light Road at 2440 North Park Lane. D. Findings of Fact and Conclusions of Law for A-04-16/RZ-06-16 — Annexation and Rezone from RUT Rural -Urban Transition — Ada County Desi nation To MU -DA Mixed Use with a Development Agreement — Richard and Sharon Terry: Richard and Sharon Terry, represented by Kirsti Grabo with KM Engineering, LLP, is requesting an annexation and a rezone from RUT (Rural -Urban Transition — Ada County designation) to MU -DA (Mixed Use with a development agreement). The 6.74 -acre site is generally Iocated on the south side of State Highway 44, approximately 1,380 -feet west of the intersection of West State Street and State Highway 44 at 2755 West State Street. Smith moves to approve the consent agenda as presented. Seconded by Guerber. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE PUBLIC HEARINGS: City Planner, Nichoel Baird Spencer, makes a request to hear items 5A and 5B at the same time. Chairman Wright approves request. A. CPA -02-I5 - Williamson Ranch - Buie Stoddard Group: Buie Stoddard Group, represented by Tamara Thompson of The Land Group, Inc., is requesting a comprehensive plan map amendment to include 88.24 acres from the Boise City Comprehensive Plan (Boise Page 1 of 4 K:1P&ZVAINUTES42016\PZ-08.15.16min doc City Land Use designation of "Large Lot') into the City of Eagle Comprehensive Plan (Eagle Land Use Designation of Residential Two — up to 2 units per acre). The applicant is requesting that the northern portion of the site (approximately 44 acres) is included in the Isla del Rio Planned Unit Development. This item was con inued from the July 18, 2016, Commission hearing. B. A-02-15/RZ-05-151CU-02-151PPUD-01-15 and PP -03-15 — Isla Del Rio Planned Unit Development — Buie Stoddard Group: Buie Stoddard Group, represented by Tamara Thompson with The Land Group, Inc., is requesting an annexation, rezone from RP (Rural Preservation — Ada County designation) to R -2 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Isla del Rio Subdivision, a 112 -lot (97 -buildable, 15 -common) residential planned unit development. The 74.32 -acre site is generally located at the terminus of East Island Woods Drive and East Garden Brook Drive. Tamara Thompson with The Land Group, Inc., 462 East Shore Drive, Eagle, Idaho 83616, is representing the applicant. Thompson gives a brief overview of the application. Derek Risso, Biologist with Ecosystem Sciences, 202 North Knight Street, Boise, Idaho 83713. Risso was hired by The Land Group, Inc. to provide an environmental assessment regarding the application, and addresses the conditions of approval regarding the bald eagles nest found adjacent to the site. Jason Densmer, Principal Civil Engineer for The Land Group, Inc., 462 East Shore Drive, Eagle, Idaho 83616, Eagle, Idaho 83616. Densmer provides a brief description of the application and addresses site specific conditions of approval 3.4, 3.13b, 3.I3d, 3.13e4, 3.13f, 3.13g, 6, 11, and 20. City Planner, Nichoel Baird Spencer, gives a detailed overview of the Comprehensive Plan map amendment application. City Planner, Mike Williams, gives a detailed overview of the annexation, rezone, conditional use permit, preliminary development plan, and preliminary plat applications. Charlie Baun, 1072 North Beachwood Court, Eagle, Idaho 83616. Baun Environmental Conservation Services represents the City of Eagle. Baun gives a detailed overview of the environmental impact assessment that is included in the packet item. Chairman Wright requests a recess at 8:00 p.m. Chairman Wright resumes the meeting at 8:07 p.m. Chairman Wright opens the Public Hearing. Ellen Elder, 1758 South Aspen River Way, Eagle, Idaho 83616. Elder lives in the adjacent subdivision and opposes the application. Elder is concerned with traffic, loss of privacy, and noise. Elder would like the clubhouse to be centrally located, a privacy buffer placed between the two subdivisions, no development within the 660 -feet buffer for the bald eagles nest, and the setbacks changed. Scott Cleveland, 1233 East Riversong Drive, Eagle, Idaho 83616. CIeveland opposes the application and is concerned that preservation would not be upheld and the eagles are threatened. Dan O'Leary, 1240 East Riversong Drive, Eagle, Idaho 83616. O'Leary opposed the application and is concerned there is not sufficient buffer between the two subdivisions. Rick Gividen, 1584 South Aspen River Way, Eagle, Idaho 83616. Gividen is opposes the application and is concerned about the eagles being threatened and the impact of taking away the rural heritage. Linda Williamson, 856 Williamson Lane, Eagle, ID 83616. Williamson is the owner of the Page 2 of 4 K.\P&ZVA8NUTE Ol Z-OB-15-ifimin.Joc Williamson Ranch and in support of the application. Williamson expresses that the eagles are very urbanized and have moved several times over the decades and the rural quietness of the area is long gone. Kent Brown, 1800 South Aspen River Way, Eagle, Idaho 83616. Brown is opposes the development and would like there to be a larger buffer between the two subdivisions. TJ Angstman, Attorney with Angstman Law Office, 3649 Lakeharbor, Boise, Idaho 83703. Angstman is representing Bill Elder, Cindy Gividen, Pat O'Leary, Lisa Goddard, and Bill Cole. Angstman opposes the development, would like to see some of the ponds moved to the west side of the property to provide a buffer between the two developments, has concerns about the eagles, and suggest redesigning the road system to reduce the through traffic. Maria Milacoochi, 511 Sherman Street, Boise, Idaho 83702. Milacoochi is a member of the Golden Eagle Audubon Society, lives in a historic home, and wants to express that by living there she is required to ask permission from the city for any changes made. Joann Butler, Attorney with Spink Butler, 251 East Front Street, Boise, Idaho 83702. Butler provides rebuttal and addresses the concerns from public testimony. Jason Densmer with The Land Group, Inc., 462 East Shore Drive, Eagle, Idaho 83616. Densmer provides clarification on the differences between the original design and the final design per public testimony and discusses the complexity of the pond system design in the proposed plan. Chairman Wright closes the Public Hearing. General discussion amongst commission members. Commissioner Smith makes a motion to recommend for approval item 5A CPA -02-15 for approval. Smith amends the motion to include the following modifications as recommended by staff: 1) 8.17 -acres be designated "Floodway" and 80.07 -acres be designated "Residential Two." 2) The MOU with Boise City be executed prior to the passing of a resolution amending the plan. 3) CPA -02-15 be processed concurrently with the Isla del Rio PUD application and all future public hearings be combined. Seconded by Guerber. ALL AYES... MOTION CARRIES. General discussion amongst commission members on item 5B. Commissioner Wright makes a motion to recommend for approval item 5B with the following recommendations for changes: Under Condition of Approval 3.4b I would like to add the additional language that was provided by the applicant that solid fencing is acceptable along the southern boundary of the subdivision." I would also like to add further language that we would recommend that solid fencing be a capped fence to mitigate any sort of wildlife damage. On condition of approval 3.13f makes the recommendation to include the language from page 29 of the Environment Impact Assessment that deals more specifically so there is less ambiguity between sufficient screening and what maturity is, and it's very clearly defined. Moving on to site specific condition of approval No. 6 I would recommend the following changes to include the language provided by the applicant adding living area, 25 -feet garage (side load) and removing "garage access prohibited." Also making the recommendation under site specific condition of approval No. 20 to add the language that the applicant has provided that the fencing at the perimeter of the project along the south boundary of the subdivision may be a solid type fencing but again also adding that the additional language as a recommendation that the fencing also be a capped fence. Further recommendations. I would like to add site specific condition No. 25 that on the western boundary of the plat that the number of homes be reduced eight to six located between the two access points. I would also like to add site specific condition of approval No. 26 addressing the buffer zones in that we would put a recommendation for increased dense screening in the buffer zones between the two access points located on the west Page 3 of 4 K:1P&Z1MiNUTEM20161PZ.08.15.16mi n. doc boundary of the proposed subdivision, proposed application. I would also to add site specific condition No. 27 that the reporting that is provided on the monitoring for the eagles nest location of 660 -feet be of a quarterly reporting nature and not an annual reporting nature to the city and to the Fish and Game Wildlife Services. Discussion. Chairman Wright amends his motion instead of site specific condition No. 27 to make under condition of approval No. 3.131. Discussion. Chairman Wright provides clarification on 3.13f that his intent was to leave the approval to the City and US Fish and Wildlife Services and not include any additional entities at that point. Seconded by Smith. ALL AYES...MOTION CARRIES. 6. NEW BUSINESS: NONE 7. REPORTS: A. Commission: Commissioner Guerber states that tomorrow there is a meeting of the Comprehensive Plan Steering Committee regarding transportation and there will be a public hearing on the 30" of this month to review the transportation proposals from the county. B. City Attorney: None C. Staff: City Planner, Nichoel Baird Spencer, states that August 30'h the City will be having an open house for the Comprehensive Plan on connectivity from 5:30 p.m. to 7:30 p.m. at City Hall.
