1. CALL TO ORDER: Meeting called to order at 6:02 p.m.
2. ROLL CALL: Present: SMITH, KOELLISCH, AND VILLEGAS. Absent: WRIGHT AND
GUERBER. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Villegas moves to approve the consent agenda as presented. Seconded by Smith. ALL

5. PUBLIC HEARINGS:
A. PPIFP-04-16 — Wallace Subdivision — John R. Jantz: John R. Jantz, represented by Joe
Canning, P. E., with B & A Engineers, Inc., is requesting combined preliminary plat/final
plat approval for Wallace Subdivision, a 2 -lot industrial subdivision. The 2.81 -acre site is
located approximately 270 -feet northwest of the intersection of South Edgewood Street and
East Iron Eagle Drive at 1447 East State Street.
Joe Canning with B & A Engineers, Inc., 5505 West Franklin Road, Boise, Idaho 83705.
Canning gives brief overview of the application.
City Planner, Brian Parker, gives a detailed overview of the application.
Commissioner Koellisch opens the Public Hearing.
There were no members of the public present to testify.
The applicant provides a closing statement.

Smith recommends for approval item 5A, PP/FP-04-16 — Wallace Subdivision, with one
change in language for site specific condition number 4 in the presentation from staff
recommendation, that would be to include language stating that, provide an access
agreement/maintenance plan stating that the landscaping, parking lot and other shared site
improvements are to be maintained according to that access agreement or maintenance
plan. Seconded by Villegas. ALL AYES ... MOTION CARRIES.
B. PP-03-16/RZ-01-07 MOD3 — C1 Subdivision — Dave Callister: Dave Callister, represented
by John Carpenter, P.E., with T -O Engineers, Inc., is requesting a development agreement
modification and preliminary plat approval for Cl Subdivision, an I1 -lot {9 buildable and 2

common) residential subdivision. The 5.70 -acre site is located on the east side of Park Lane
approximately 1,200 -feet south of Beacon Light Road at 2440 North Park Lane.
Dave Callister, 2873 West Wind Drive, Eagle, Idaho 83616. Callister gives brief overview of the
application.
City Planner, Mike Williams, gives a detailed overview of the application.
Commissioner Koellisch opens the Public Hearing.
Michael Hester, 3950 West Night Hawk Lane, Eagle, Idaho 83616. Hester is the property owner
to the south. Hester is proposing that this subdivision be a minimum of one acre lots.
Jason Ellison, 3664 West Tabasco Trail, Eagle, Idaho 83616. Ellison owns part of the road just
south of the development. Ellison would like to see larger lots adjacent to the Tabasco Trail
Road.
Teresa Johnson, 3417 North Croft Way, Eagle, Idaho 83616. Johnson lives northeast of the site.
Johnson would like to see a better transition area and see the community keep a rural feel.
City Planner, Mike Williams, provides clarification on the previous development agreement and
past modification history for the site.
The applicant provides rebuttal and addresses the concerns from public testimony.

Smith makes a motion to recommend for approval item 5B PP-03-16/RZ-01-07 MOD3 — C1
Subdivision. Seconded by Villegas. City Planner, Mike Williams, requests the motion
include "with the conditions as recommended in the staff report." Smith amends the
motion to include "with the conditions as recommended in the staff report." Seconded by
Villegas. ALL AYES ... MOTION CARRIES.
C. A-04-16/RZ-06-16 — Annexation and Rezone from RUT f Rural -Urban Transition — Ada
County Desi nation To R-E-DA(Residential-Estates with a Development Agreement —
Richard and Sharon Term Richard and Sharon Terry, represented by Kirsti Grabo with
KM Engineering, LLP, is requesting an annexation and a rezone from RUT (Rural -Urban
Transition Ada County designation) to MU -DA (Mixed Use with a development
agreement). The 6.74 -acre site is generally located on the south side of State Highway 44,
approximately 1,380 -feet west of the intersection of West State Street and State Highway 44
at 2755 West State Street.
Kirsti Grabo with KM Engineering, LLP., 9233 West State Street, Eagle, Idaho 83616. Grabo is
representing the applicant Richard and Sharon Terry and gives a brief overview of the
application. Grabo recommends a change to site specific condition 3.5 be reworded to state that
they can reconstruct those systems if they fail and utilize the new systems until such time as
those facilities from Eagle Sewer District and United Water are available and at that point then
they would connect into those utilities.
Commissioner Smith, asks for clarification on future use plans for the parcel to the south, and
access ways.

Tim McCaulley, 2611 West State Street, Eagle, Idaho 83616. McCaulley lives immediately
adjacent to the east of the proposed annexation. McCaulley is in favor of the annexation on the
basis of the owner's right to sell their property to enhance their retirement.
Arlene McCaulley, 2611 West State Street, Eagle, Idaho 83616. McCaulley questions how they
are going to get water and sewer to a business park if one is going to be built. McCaulley's
property currently separates the Terry property and the access to water and sewer and does not
want those utilities to cut across her property. She also states that her son owns 17 acres to the
west of the site and she wants to know what would happen to the Terry property if her son
decided not to sell.
Nathan Anderson, 2565 West Conifer Drive, Eagle, Idaho 83616. Anderson expresses concern
about future development.
Jim Doerty, 2564 West Conifer Drive, Eagle, ID 83616. Doerty expresses concern with the
zoning being mixed use. He suggests the zoning for the south portion not allow for apartments.
Val Brooks, 287 North Sierra View Way, Eagle, ID 83616. Brooks expresses concern with what
the future use will be.
The applicant provides rebuttal and addresses the concerns from public testimony.
Commissioner Villegas asks the applicant and staff questions.
City Planner, Michael Williams, responds to Commissioner Villegas' question about what the
comprehensive plan shows as a future development opportunity for the MU zoning designation.

Smith makes a motion to recommend for approval A-04-16/RZ-06-16 — Annexation and
Rezone from RUT To MU -DA with the change made to specific condition 3.5 as proposed
by the applicant to state that the existing home may continue the use of the existing well
and septic system, however, in the event the existing well or septic system fail Owner shall
connect to the respective central service if facilities are available for connection. If central
services are not available, Owner shall be permitted to re -construct the well and/or septic
system and utilize said facilities until such time as central services are available and all
other conditions standing as written. Seconded by Villegas. ALL AYES ... MOTION
CARRIES.
D. ZOA-02-16 — Code Amendments — City of Enle: An ordinance of the City of Eagle,
Idaho, a Municipal Corporation of the State of Idaho, amending Title 8 "Zoning", Chapter 1
"Zoning Interpretation and Definitions", Chapter 2 "Zoning Districts and Map", Chapter 2
Article A. "Design Review Overlay District", Chapter 3 "Performance Standards", Chapter
4 "Off Street Parking and Loading", Chapter 5 "Nonconforming Uses'; Providing a
Severability Clause; and Providing an Effective Date.
Zoning Administrator, Bill Vaughan, provides detailed overview of application. Vaughan
proposes that if the commission makes a motion to approve this item that they consider adding
clarification under item 2 that the home occupation shall be conducted entirely within the
dwelling unit garage. Vaughan also requests language be added that states "traffic relating to the
operation of the home occupation such as any mail or parcel delivery shall be Iimited to a
maximum of four vehicle trips per day. A trip is defined in the most recent version of the
Institute of Transportation Engineer's Trip Generation Manual." Strikethrough "no significant
traffic." Under No. 5 strike the sentence "if the home occupation is conducted in any single
family residence or outside the dwelling unit if conducted in other than a single family
residence." Finally involving section 7 should read "It shall not involve the use of signs" striking
"and or other structures or other than those permitted in the district of which it is part."

Turk will attend in her place.
