ROLL CALL: Present: SMITH, VILLEGAS, AND GUERBER. Absent: KOELLISCH AND WRIGHT. A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Findings of Fact and Conclusions of Law for RZ-05-16 — Rezone from R4(Residential) to CBD Central Business District — Shawn Nickel: Shawn Nickel is requesting a rezone from R4 (Residential) to CBD (Central Business District). The 0.33 -acre site is generally located on the west side of North Eagle Road approximately 675 -feet north of West State Street at 247 North Eagle Road. C. Findines of Fact and Conclusions of Law for CU -06-16 — Side Setback Waiver for Accessory Structure (RV Storaze Facility) — Butch & Ida Denney: Butch and Ida Denney, represented by Cyrus McCrory with Artisan Construction and Remodel, Inc., are requesting conditional use permit approval for a waiver to reduce the side yard (south) setback on Lot 2, Block 2, from 20 -feet to 10 -feet to accommodate the placement of an accessory structure (RV storage facility). The 1.09 -acre site is located on the west side of North Ballantyne Lane approximately 330 -feet north of the intersection of West Floating Feather Road and North Ballantyne Lane at 1343 North Ballantyne Lane within Scotch Subdivision. D. Findings of Fact and Conclusions of Law for RZ-05-02 MOD4/RZ-03-16 & PP -03-05 MOD2 — Lakemoor Subdivision — DMB Investments LLC: DMB Investments, LLC/B.W. Eagle, Inc., represented by Dan Torfin, is requesting a rezone from R-1 (Residential) to MU -DA (Mixed Use with a development agreement in lieu of a PUD), a development agreement modification and preliminary plat modification for Lakemoor Subdivision, a previously approved 409 -lot (existing platted 223 residential, 14 commercial, and 21 common [7 private road]; proposed 117 residential lots [32 attached], 16 commercial lots, 18 common lots [3 private street lots and 1 utility lot], and 1 utility lot). The entire 178.91 -acre site is generally located on the east side of Eagle Road approximately 1000 -feet North of Chinden Boulevard. Villegas moves to approve the consent agenda as presented. CPA -01-15 - Williamson Ranch - Buie Stoddard Group: Buie Stoddard Group, represented by Tamara Thompson of The Land Group, Inc., is requesting a comprehensive plan map amendment to include 88.24 acres from the Boise City Comprehensive Plan (Boise City Land Use designation of "Large Lot') into the City of Eagle Comprehensive Plan (Eagle Land Use Designation of Residential Two — up to 2 units per acre). The applicant is requesting that the northern portion of the site (approximately 44 acres) is included in the Isla del Rio Planned Unit Development JoAnn Butler, 251 East Front Street, Boise, Idaho 83702. Butler is representing the applicant, and requests a ten minute recess to confer with her client.
