CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: KOELLISCH, SMITH AND GUERBER. Absent: VILLEGAS AND
WRIGHT. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

B. Findin s of Fact and Conclusions of Law for A-01-16/RZ-01-16 & PP/FP-03-16 -
Eusterman Subdivision - Matthew B. Eusterman: Matthew B. Eusterman, represented by
Mark Butler with Land Consultants Inc., is requesting an annexation, rezone from RUT
(Rural -Urban Transition Ada County designation) to R -E -DA (Residential -Estates with a
development agreement) and combined preliminary and final plat approvals for Eusterman
Subdivision, a 2 -lot residential subdivision (re -subdivision of Lot 4, Block 1, Ray's Acres
Subdivision). The 5.61 -acre site is generally located on the south side of West Floating
Feather Road approximately 700 -feet east of the intersection of Park Lane and West Floating
Feather Road at 3709 West Floating Feather Road.
C. Findings of Fact and Conclusions of Law for CU -04-16 - Addition of an Accessory Use
(Bar) to the Ea le Art Gallery - Stephen Douglas: Stephen Douglas, represented by
Walter Lindgren with Lindgren Labrie Architecture, PLLC, is requesting conditional use
permit approval to add an accessory use (bar) to the Eagle Art Gallery to permit sales of wine
and beer by the glass. The 0.08 -acre site is located on the east side of North 2"d Street
approximately 110 -feet north of the intersection of North 2" d Street and East State Street at
50 North 2'd Street.
D. Findin s of Fact and Conclusions of Law for A-02-16/RZ-02-16/CU-03-16/PPUD-01-
16/PP-01-16 - HCR/Level 3 Planned Unit Development Phase 3 - Home Capital
Resources LLC: Home Capital Resources, LLC, represented by Jason Densmer, P.E., with
The Land Group, Inc., is requesting an annexation, rezone from RUT (Rural -Urban
Transition - Ada County designation) to R4 -DA -P (Residential with a development
agreement PUD), conditional use permit, preliminary development plan, and preliminary
plat approvals for HCR/Level 3 Subdivision - Phase 3, a 10 -lot (7 -buildable, 3 -common)
residential planned unit development. The 394 -acre site is generally located on the
southwest comer of South River Creek Avenue and West State Street (Hwy 44) at 5335 West
State Street.
Smith moves to approve the consent agenda as presented. Seconded by Guerber. ALL
AYES... MOTION CARRIES.

5. PUBLIC HEARINGS:
A. CU -05-16 — Private School/Childcare Facility — Brooke Van Horn: Brooke Van Horn,
represented by Brenda Van Horn, is requesting conditional use permit approval to operate a
private school/childcare facility (preschool through 6" grade) for the care and instruction of
up to thirty (30) children. The 0.33 -acre site is located on the north side of East Idaho Street
approximately 115 -feet east of the intersection of North 2nd Street and East Idaho Street at
342 East Idaho Street. This item was continued from the May 16, 1016, Commission hearing.
Brenda Van Horn, 342 East Idaho Street, Eagle, Idaho 83616. The applicant gives a brief
overview of the application.
City Planner, Mike Williams, gives a detailed overview of the application.
Chairman Koellisch opens the Public Hearing.
Gloria Nagel, 99 Cherry Lane, Nampa, Idaho 83687. Nagel is a teacher at the school and
provided a copy of the daily schedule.
Paula Maudlin, 1457 East Achen Court, Meridian. Modlin feels the school is a friendly addition
and is in favor of the application.
Kristen Burris, 1473 North Watson Way, Eagle. Burris is in favor of the application.
Beth Stricklin, 3056 West Bolodi Court, Meridian, Idaho 83646. Strickland is a parent of a
student at the school and is in favor of the application.
Vincent Edwards, 3017 North Hansen Avenue, Meridian, Idaho. Edwards is a parent of a student
at the school and is in favor of the application.
Holly Purdy, 8075 West Floating Feather, Eagle, Idaho. Purdy is a parent of a student at the
school and is in favor of the application.
Richard Ames, 120 North 2' Street, Eagle, Idaho. Ames is concerned with the location and is not
in favor of the application.
Jenny Wells, 2042 Pebblestone Street, Meridian, Idaho 83646. Wells is a parent of students at
the school and is in favor of the application.
Jiquel Blun, 6400 Butte Road, New Plymouth, Idaho 83655. Blun is an aunt of a student at the
school and is in favor of the application.
The applicant provides rebuttal and addresses the concerns from public testimony.
Chairman Koellisch closes the Public Hearing.
General discussion amongst commission members.
Guerber makes a motion to approve the request of the conditional use permit to operate
the private school. They go through the sixth grade and no more than 30 children per the
fire codes and the stipulation that the mitigation that was outlined tonight be included and
take place in order to come into compliance with our recommendations on this item.
Seconded by Smith. Guerber amends his motion to include the Design Review Board to
determine the fence type and a timeline of 30 days to put the fence up upon receiving City
Council and Design Review Board approvals. Amended motion seconded by Smith. ALL
AYES... MOTION CARRIES.
B. PP/FP-02-16 — Feather len Subdivision — Ja o Development, Inc.: Jayo Development,
Inc., represented by Shawn Nickel with SLN Planning, is requesting combined preliminary
plat/final plat approval for Featherglen Subdivision, a 7 -lot residential subdivision (6 -buildable,
1 -common). The 0.88 -acre site is located on the south side of West FIoating Feather Road at 135
West Floating Feather Road.

Doug Greenway, 234 West Cobblestone Court, Eagle, Idaho. Greenway is not in favor of the
application.
Theresa Johnson, 341 North Kroft Way, Eagle. Johnson is concerned about the shared driveway,
setbacks, and two story homes.
The applicant provides rebuttal and addresses the concerns from public testimony.
Chairman Koellisch closes the Public Hearing.
General discussion amongst commission members.
Koellisch makes a motion to recommend for approval PP/FP-02-16 Featherglen
Subdivision — Jayo Development, Inc with the following addition that the CC&Rs state that
the association will be responsible for the parking and maintaining safe parking and
written in CC&Rs so that it's clear and only approving preliminary plat and site specific
conditions as written. Seconded by Smith. ALL AYES... MOTION CARRIES.
C. A-03-16/RZ-04-16 — Annexation and Rezone from RUT ural -Urban Transition — Ada
County Designation) to R -E (Residential -Estates) — M. Lynn McKee: M. Lynn McKee is
requesting approval of an annexation with rezone from RUT (Rural -Urban Transition Ada
County designation) to R -E (Residential -Estates). The 8.41 -acre site is generally located on
the south side of West Beacon Light Road approximately 350 -feet east of the intersection of
North Ballantyne Lane and West Beacon Light Road at I887 West Beacon Light Road.

8.41 -acre site be approved. Seconded by Smith. ALL AYES ... MOTION CARRIES.

A. Commission: Commissioner Guerber provides an update on the committee reviewing the
Comprehensive Plan.

C. Staff City Planner, Mike Williams, introduces a new City of Eagle PIanner, Brian Parker.
