CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SMITH, VILLEGAS, KOELLISCH, and WRIGHT. A quorum is
present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of November 2, 2015.
B. Findings of Fact and Conclusions of Law for PP -09 -15 — Crestnoint PIace Subdivision 7- —
Northside Management; Northside Management, represented by Scott Noriyuki, is
requesting a preliminary plat approval for Crestpoint Place Subdivision, a 52 -lot (43-
buildable and 9- common) residential subdivision. The 7.74 -acre site is located on the west
side of South Edgewood Lane approximately 1,290 -feet north of East State Street at 103
South Edgewood Lane.
Koellisch moves to approve the consent agenda as presented. Seconded by Villegas. ALL
AYES... MOTION CARRIES.

5. PUBLIC HEARINGS:
A. A- 04- I5 /RZ -09 -I5 & PPIFP -01 -15 — Garrinan Estates Subdivision No. 2 — George and
Leigh Brecht: George and Leigh Brecht, represented by Shawn L. Nickel with SLN Planning,
LLC, is requesting an annexation, rezone from RR (Rural Residential) to RE -DA (Residential
Estates with a development agreement) and combined preliminary and final plat approvals for
Garrigan Estates Subdivision No. 2, a 4 -lot (3- buildable, I- non - buildable) residential
subdivision. The 15.9 -acre site is located on the north side of West Homer Road
approximately 1,950 -feet west of the intersection of West Homer Road and North Linder
Road.
Shawn Nickel, 1589 North Estancia Place, Eagle. Nickel, representing the applicant, gives a brief
overview of the application.
City Planner, Mike Williams, gives a detailed overview of the application.
Chairman Wright opens the Public Hearing.
Mike Summers, 7612 West Wilshire Drive, Boise, Idaho 83704. Summers is speaking on behalf
of Heather Summers who is requesting this item be deferred due to the staff report not coming
out until the Friday prior to the meeting.
The applicant provides rebuttal to staff's recommended site specific conditions of approval.
George Brecht, 4830 North Hawk Wing Lane, Eagle, Idaho. Brecht provides further information

about the request to keep the gravel road instead of paving it.

General discussion amongst the Commission regarding the application.
Villegas moves to recommend for approval A- 04- 15/R2r09 -15 & PP/FP- 01 -15, Carrigan
Estates Subdivision No. 2 with the modification to staffs recommendation that we
recommend to the City Council that the streets remain gravel instead of paved and all the
other conditions of approval as staff has recommended. Seconded by Koellisch. Discussion.
City Planner, Mike Williams, recommends they strike condition number 6 as written and
add Ianguage to condition number 6 stating "Existing gravel road is approved." Villegas
modifies the motion per staff recommendation. Amended motion seconded by Koellisch.

B. CPA- 05- 15/RZ-11 -15 — TPC Commercial, LLC: TPC Commercial, LLC, represented by
Shawn Nickel, is requesting a Comprehensive Map Amendment from Mixed Use to
Commercial and a rezone from BP (Business Park) to MU -DA (Mixed Use with a
development agreement [in lieu of a Conditional Use Permit]) and C -2 (General Business
District) to develop a 48 -unit senior apartment building and commercial area consisting of
retail, financial, and restaurant uses with drive - thrus. The 15.55 -acre site (consisting of seven
parcels) is generally located on the west side of South Edgewood Lane between State
Highway 44 and East State Street inclusive of 1601, 1782, and 1794 East McGrath Road.

City Planner, Nichoel Baird Spencer, give a detailed overview of the Comprehensive Map
Amendment application.
City Planner, Mike Williams, gives a detailed overview of the Rezone application.
Chairman Wright opens the Public Hearing.
John Rennison, 410 East State Street, Eagle. Rennison is proposing a building height of the
multi - family structure of 40 -feet because it is a necessity, a drive -thru on Pad K and L for a
future tenant, and reduction in parking for the senior living building.
City Attorney, Cherese McClain, states that the applicant should not be introducing new
information during rebuttal.
Commissioner Villagas requests that staff have the opportunity to provide rebuttal to the new
information.
City Planner, Mike Williams, states he received the new information early this morning and
provides staff recommendations.

General discussion amongst the Commission regarding the application.
Smith makes a motion to recommend for approval CPA- 05- 15/RZ-11 -15 — TPC
Commercial, LLC with the conditions established by staff. With the following
modifications 3.17 words similar to owner shall install a 3 -foot high landscape berm or an
alternative measure from the center line State HWY 44 within a 30 -foot wide common lot
prior to the City Council meeting and item 3.21 that there is a comment here regarding
U.S. housing restricted to 55 years plus of age. Seconded by Koellisch. ALL AYES...
MOTION CARRIES.
C. CU -11 -15 — Coleman Homes, LLC: Coleman Homes, LLC, represented by Becky McKay
with Engineering Solutions, LLP, is requesting conditional use permit approval for a waiver

to reduce the front and rear setbacks on Lots 29 -35, Block 11, The Preserve Subdivision No.
5. The Preserve Planned Unit Development is generally located 650 -feet west of Linder Road
and north of State Highway 44.

overview of the application.

Seconded by Koellisch. Discussion. Koellisch makes a substitute motion to recommend for
approval 5C. CU -11 -15 — Coleman Homes, LLC with staff's recommendations. Seconded
by Villegas. ALL AYES... MOTION CARRIES.
