Minutes
I . CALL TO ORDER: Meeting called to order at 6:02 p.m.
2. ROLL CALL: Present: KOELLISCH, VILLEGAS, SMITH AND WRIGHT. A quorum is
present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of October 19, 2015.
KoelIisch moves to approve the consent agenda as presented. Seconded by Smith. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
PUBLIC HEARINGS:
A. CU -04 -15 — Accessory Dwelling Unit in excess of 1.200 - square feet — Green: Johnny and
Kathleen Green are requesting conditional use permit approval for a waiver to allow the
construction of a 2,745 - square foot (1,860- square foot living quarters) accessory dwelling
unit (maximum size limitation per ECC is 1,200- square feet). The 2.08 -acre site is located at
2095 North Greenview Court within Lexington on the Rim Subdivision.
This item was continued from the September 21, 2015, Commission !tearing.
Chairman Wright introduces the item.
City Planner, Mike Williams, gives a detailed overview of the application.
City Attorney, Cherese McLain, provides an update on outstanding mediation items.
General discussion amongst the Commission regarding the application.
Villegas recommends for approval item 5A. CU -04 -15 with the staffs recommendations for
approval including the following requirements placed on the CUP:
1. That the accessory unit, that the structure be accessory to the single family residence to
be used solely as part of the single family dwelling, by a guest, a family member, or
household employee and not for commercial purpose as a separate rental unit.
2. That the structure match in design and color of the primary residence.

B. CPA- 04- 15/RZ- 07- 15/PP -04 -I5 — Stillwater Subdivision — Next Level Develo men
LLC: Next Level Development, LLC, represented by Kevin McCarthy, is requesting a
Comprehensive Plan text amendment, rezone from BP -DA (Business Park with a
development agreement) to MU -DA (Mixed Use with a development agreement in lieu of a
PUD) and preliminary plat approvals for Stillwater Subdivision, a 94 -lot (60- residential, 12-
live /work, l 1- commercial, 1 -flex, 10- common) subdivision. The 39.7 -acre site is located on
the south side of State Highway 44 at the southwest corner of West State Street and State

Highway 44.
This item was continued from the October 19, 2015, Commission hearing.
Chairman Wright introduces the item.
Corey Elitharp, Next Level Development, 724 Lone Brook Way, Eagle, Idaho, 83616, gives a
brief overview of the application.
City Planner, Nichoel Baird Spencer, gives a detailed overview of the Comprehensive Plan text
amendment application.
City Planner, Mike Williams, gives a detailed overview of the rezone and preliminary plat
applications.
Chairman Wright opens the Public Hearing.
The applicant provides rebuttal to staff's recommended site specific conditions of approval.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Smith makes a motion to recommend for approval item 5B. CPA- 04- 151RZ- 07- 15/PP -04 -15
— Stillwater Subdivision with the following recommendations:
Condition 3.5 — Applicant will provide documentation showing the sewer easement along
the rear of the lots within Block 1 have been abandoned/vacated and the rear setback shall
be 15 -feet.
Condition 3.11 — Applicant shall provide documentation showing the 50 -foot maintenance
easement with Eagle Sewer District and provide documentation for the lot line adjustment
prior to the signing of the final plat.
Condition 3.22 — Strike condition.
Condition 13 — Add common lots identified as Lot 7, Blocks 5 & 6 shall have a zero setback.
Condition 14 — The plat shall show no more than four dwelling units taking access via the
common drive labeled as Lot 14, Block 1.
Condition 16 — Relocation of Lot 6, Block 6 outside of the existing Eagle Sewer District will
not be needed provided the applicant provides documentation showing the Eagle Sewer
District easement has been vacated.
Seconded by Villegas. ALL AYES... MOTION CARRIES.

C. PP -09 -15 — Crest point PIace Subdivision — Northside Management: Northside
Management, represented by Scott Noriyuki, is requesting a preliminary plat approval for
Crestpoint Place Subdivision, a 52 -lot (43- buildable and 9- common) residential subdivision.
The 7.74 -acre site is located on the west side of South Edgewood Lane approximately 1,290 -
feet north of East State Street at 103 South Edgewood Lane.
Chairman Wright introduces the item.
Scott Noriyuki, Northside Management. 6810 North Fairhill Place, Boise, ID 83714, gives a brief
overview of the application. Noriyuki is requesting modification to Site Specific Conditions 4
and 10 that the 8 -foot planter strip be changed to a 6 -foot planter strip with a root barrier and Site
Specific Condition #13 that the 35 -foot wide buffer area show 33 -foot wide buffer which would
include the ACHD right -of -way of 13 -feet.

Steven Nielson, 122 S Cooksom Avenue, Eagle, Idaho. Nielson requests clarification from the
applicant on a few items.
Applicant provides rebuttal and answers questions brought forward from public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Villegas moves to recommend for approval PP -09 -15 with all of the recommendations as set
forth in the staff report with the modifications that the two requested modifications from
the applicant be incorporated and the original ones be stricken. Seconded by Koellisch.
ALL AYES... MOTION CARRIES.
D. CPA- 05- 15/RZ -11 -15 — . East End Marketplace — TPC Commercial. LLC: TPC
Commercial, LLC, represented by Shawn Nickel, is requesting a Comprehensive Map
Amendment from Mixed Use to Commercial and a rezone from BP (Business Park) to MU-
DA (Mixed Use with a development agreement [in lieu of a Conditional Use Permit]) and C-
2 (General Business District) to develop a 48 -unit senior apartment building and commercial
area consisting of retail, financial, and restaurant uses with drive - thrus.
Staff is requesting this item be continued to the November 16, 2015, meeting.
Chairman Wright approves continuing this item to the November 16, 2015, meeting.
