CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SMITH, SOELBERG, VILLEGAS, KOELLISCH, AND WRIGHT.
A quorum is present.
3_ CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of August 31, 2015.
B. Findines of Fact and Conclusions of Law for CU -06 -15 — Cabinet Shop & Waiver —
Cameron Luff: Cameron Luff, represented by Camilla Luff, is requesting conditional use
permit approval for the construction of a 5,500- square foot cabinet shop and a waiver to
reduce the required on -site parking by one space and to remove the requirement for the
construction of curb, gutter, and sidewalk along the portions of the site fronting East State
Street and Dunyon Street. The 0.30 -acre site is located on the north side of East State Street
approximately 525 -feet east of the intersection of Conover Street and East State Street at
2128 East State Street
C. Findin s of Fact and Conclusions of Law for RZ -12 -06 MOD/CU-10-15/PPUD-04-
151PP -10 -15 — Eaglefield Commons Planned Unit Development — The Preserve, LLC:
The Preserve, LLC, represented by Becky McKay with Engineering Solutions, LLP, is
requesting development agreement modification, conditional use permit, preliminary
development plan, and preliminary plat approvals for Eaglefield Commons Planned Unit
Development, a 22 -lot (16- single - family residential, 3- multi - family residential, and 3-
common) residential planned unit development. The 8.93 -acre site is located on the north
and south side of West Escalante Drive approximately 960 -feet north of the intersection of
North Linder Road and State Highway 44.
Soelberg moves to approve the consent agenda as presented. Seconded by Koellisch. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
PUBLIC HEARINGS:
A. CU -04 -15 — Accessory Dwelling Unit in excess of 1200 -s uare feet — Green: Johnny and
Kathleen Green are requesting conditional use permit approval for a waiver to allow the
construction of a 2,745- square foot (1,860- square foot living quarters) accessory dwelling
unit (maximum size limitation per ECC is 1,200- square feet). The 2.08 -acre site is located at
2095 North Greenview Court within Lexington on the Rim Subdivision.
This item was continued from the August 31, 2015, Commission hearing.
Chairman Wright introduces the item.
City Planner, Mike Williams, gives a detailed overview of the application. Staff is recommending

this item be continued to a date certain of November 2n1.
Chairman Wrights asks City Planner, Mike Williams to further address the irrigation for the site.
City Planner, Mike Williams, explains the pressurized irrigation options for the site.
General discussion amongst the Commission regarding the application.
Villegas makes a motion to table this thing to November and see exactly where this is at and
I would also like to see what staff is going to present us with because when I got our packet
I didn't see any recommendation whatsoever what they were supposed to pull out of those
CC &Rs. Chairman Wright clarifies there is a motion on the table to table item 5A to a date
certain of November 2"d. Smith Seconds. pour AYES (Wright, Smith, Villegas, Koellisch).

B. RZ- 10- 15/PP -06 -15 — Eagle Lakes Subdivision — Pacific Partners Residential: Pacific
Partners Residential, represented by Kasey Ketterling with T -Q Engineers, Inc., is requesting
a rezone from MU (Mixed Use) to MU -DA (Mixed Use with a development agreement in
lieu of a PUD, including a height exception) and preliminary plat approvals for Eagle Lakes
Subdivision, a 78 -lot, 322 -unit (51- single - family, 270- multi- family (contained within 6- lots),
12- commercial, and 9- common) subdivision. The 75 -acre site is generally located on the
south side of State Highway 44, approximately 1,129 -feet west of the intersection of State
Highway 55 and State Highway 44.
Chairman Wright introduces the item.
Dean Martin, 430 East State Street, Eagle. Martin is the President of Pacific Partners Residential
and gives a brief overview of the application.
Kasey Ketterling, TO Engineering, 332 N Broadmore, Nampa, ID. Ketterling gives a brief
overview of the application.
Douglas Gibson, DG Group Architecture PLLC, 430 East State Street, Suite 100, Eagle, ID.
Gibson gives a brief overview of the architecture for this application.
City Planner, Mikes Williams, gives a detailed overview of the application.
Chairman Wright opens the Public Hearing.
Ann Ybergen, 3007 East Lakeland Lane. Ybergen is a neighbor to the east. Ybergen is not
opposed to the development, but she is opposed to any developments being proposed around
Idaho Concrete Company. Ybergen is concerned with the exposure of crystal silica and
recommends tabling this item until they know the issue they are dealing with.
Bob Ward, 3007 East Lakeland Lane. Ward does not oppose the application. Ward is concerned
with the crystal silica and expressed that the hospital has an environmental team looking at Idaho
Concrete health hazard in the area and has only had the information for a week.
Nick Hanson, 2711 Lakeland Lane. Hanson does not oppose the application but is concerned
about the effects of silica dust.
Applicant provides a rebuttal and explanations to the public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Soelberg requests that the applicant works with the homeowners regarding the public safety issue
of the gravel pit.
City Planner, Mike Williams, expresses staff's recommendation for condition 3.4 to include a
street side setback of 10 -feet with the additional verbiage of no access should be taken from the
street side, 12 -feet setback on the east side, and 10 -feet setback on the west boundary. Williams

clarifies no change for staff recommendations to interior side west, interior side east, or the side
east will have 12 -feet.
Soelberg recommends for approval RZ- 10- 151PP -06 -15 -- Eagle Lakes Subdivision — Pacific
Partners Residential, for approval with the following changes: 3.4 of staff
recommendations to be changed as noted with the setbacks. 3.7 the height exception to be
moved to 41 feet, section added for 3.22 that parking is subject to design review with
requirements for 1.80 for two bedroom and 1.85 for three bedroom and above. Discussion.
City Planner, Mike Williams, clarifies the applicant requested 1.85 on the Northern section
and 1.80 on the southern section. Williams requests they provide staff with an exhibit that
we can incorporate into the development agreement showing where they are with the
Northern and Southern sections. Motion continued by Soelberg adding to section 3.22 for
parking subject to design review with the language noted. Changed to section 7 side walk
setbacks and planter strips, on this I would like to add an or section if they want to do
attached with trees, section 19 with the landscape area I would like to go with staff's
recommendation that they put in a sidewalk there so that would be no change and I believe
that is everything. The side setback needs to include language for no access. Smith seconds.

Commissioner Smith requests to be excused for the evening due to not feeling well.

C. CU -07 -15 — Sin le- Family Dwelling within the Central Business District — Paradigm
Construction, LLC: Paradigm Construction is requesting conditional use permit approval
to construct four (4) single - family dwelling units within the CBD (Central Business District).
The .49 -acre site is located on the north side of East Idaho Street approximately 260 -feet east
of the intersection of North 2nd Street and East Idaho Street at 348 East Idaho Street.
Chairman Wright introduces the item.
Applicant gives a brief overview of the application.
City Planner, Holly Csencsits, gives a detailed overview of the application.
Chairman Wright opens the public hearing.
Michael Roberts, 341 East Amanita Street, Eagle, 83616. Roberts does not oppose the project
and endorses the project. Roberts has concerns with the row of trees on the East that provide
shade and privacy for the residents and would like to see the trees stay. Roberts would also like
to discuss adequate landscaping to provide privacy for the other home owners. Roberts also has
issues with parking around the site.
Richard Ames, 120 North 2 "d Street. Ames is concerned with the traffic on the street.
Applicant provides rebuttal and addresses the concerns of the public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Villegas recommends for approval CU -07 -15 — Single- Family Dwelling within the Central
Business District — Paradigm Construction, LLC with all staff site specific conditions.
Koellisch seconds. ALL AYES... MOTION CARRIES.
G, NEW BUSINESS:
A. Comprehensive Plan Review Committee — Meeting in a Bag: Outreach to the Planning
and Zoning Commission to discuss the City's successes, challenges, and future.
