1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SOELBERG, SMITH AND WRIGHT. Absent: KOELLISCH AND
VILLEGAS.A quorum is present.
3. CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner,member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of August 3,2015.
Soelberg moves to approve the consent agenda as presented. Seconded by Smith. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. CPA-01-15/A-01-15/RZ-04-15—Linder Crossing—LRS.LLC: LR5, LLC, represented by
Shawn Nickel with SLN Planning, is requesting, a Comprehensive Plan Text Amendment to
amend the density language for the "Rim View Planning Area", and a Comprehensive Plan
Map Amendment to change the future land use map designation from Transitional Residential
to Mixed Use, and annexation and rezone from RUT (Residential Urban Transition — Ada
County Designation) to MU-DA (Mixed Use with a development agreement [in lieu of a
conditional use permit])to construct a 166-unit apartment complex.
This item was continued from the July 20, 2015, Commission hearing.
Chairman Wright introduces the item.
John Rennison, 410 East State Street,Eagle, is with Rennison Engineering and is representing
the applicant.Rennison gives an overview of the application.
Chairman Wright asks the applicant to further discuss what a continuous flow intersection is,
and also asks for clarification on the sewer capacity for this application.
Smith inquires why the Eagle Sewer letter presented by the applicant was not in the packet.
Staff expresses that it was not received in time.
City Attorney, Cherese McLain, asks the applicant to address the height of the apartment
complex and the alternatives for traffic so that the public will have the full presentation before
they testify.
City Planner,Nichoel Baird Spencer provides a detailed overview of the Comprehensive Plan

City Plattner, Mike Williams, provides a detailed overview of the annexation and rezone
• applications.
Chairman Wright opens the Public hearing.
Matt Eells, 6910 North Linder Road. Eells is in favor of the project and says it fits with what
the city needs and feels it is the appropriate time for this project.
Merilee Morton, 7305 Ribier Drive, Meridian. Morton strongly opposes a change to the
amendment.It would affect the sewer,water tables in the area,and traffic.
Hal Bunderson, 582 River Heights Drive. Bunderson opposes the application. Bunderson
provides testimony in regard to height,buffer,traffic,and location.
Merilyn Bodily, 7075 North Linder Road. Bodily opposes the application and agrees with Hal
Bunderson.
Ted Epperly, 2180 Ribier Drive. Epperly opposes the application. He is in agreement with
staff's recommendations,and has concerns with the sewer capacity,traffic considerations,and
the quality of life for the neighborhood.
Jeremiah Williamson, 2181 Ribier Drive.Williamson is asking for a denial of the application.
Williamson has not heard a need for this project and is concerned with incompatibility with
the Rim area. Williamsons says approving this application will undermine the Comprehensive
Plan,and the additional traffic that this project will create.
Carol Montierth, 7175 North Springcrest. Montierth lives in the Sandy Springs subdivision
and is opposed to this application. She was not invited to the neighborhood meeting.
Montierth is concerned about another change to the comprehensive plan. She also thinks the
application is too dense for the area, and she is concerned about the 1,100 additional traffic
trips per day.
John Laca, 6751 North Barney Lane. Laca is concerned with the quality of life. Laca opposes
the application.
Evelyn Petty, 2101 Almaden Drive. Petty does not want the added traffic. She is requesting
denial of this project.
Ken Mallea, 2241 Almaden Drive. Mallea opposes the application entirely. He agrees with
staff's recommendations.
Avery Epperly, 2180 Ribier Drive. Epperly feels it violates the Rim View Planning Area.
Epperly strongly opposes the application.
Foad Rodhani, 2273 Ribier Drive. Rodhani feels the application is too dense for the area and
does not fit in the area.Rodhani opposes the application.
Scott Trosper, 7110 North Springcrest. Trosper feels the transition does not meet the Comp
Plan.Trosper opposes the application.

Larry Woodard, 1701 Almaden. Woodard feels this application is far off the charts for this
area.Woodard opposes the application.
Jule Eberle, 7100 North Rhine Avenue. Eberle opposes the application for the following
reasons: residential impact of increased traffic and impacts to the neighborhood are not being
considered,and they will lose water.
Tim Gibson,2074 Ribier.Gibson opposes the application.
John Rennison provides a rebuttal and addresses the concerns that were made tonight.

General discussion amongst the Commission regarding the application.
Soelberg makes a motion for recommendation of denial for CPA-01-15/A-01-15/RZ-04-
15 — Linder Crossing — LR5, LLC. Seconded by Smith. ALL AYES... MOTION
CARRIES
Chairman Wright states they will take a five minute recess at 8:12 p.m.
Meeting resumes at 8:21 p.m.
B. A-03-15/RZ-06-15/PP-05-15—Springhouse Subdivision—CBH Homes: CBH Homes,Inc.,
represented Scott Wonders with J-U-B Engineers, Inc., is requesting an annexation, rezone
from RUT(Rural-Urban Transition—Ada County designation)to MU-DA(Mixed Use with a
development agreement in lieu of a PUD) and preliminary plat approvals for Springhouse
Subdivision, a 58-lot(52-buildable, 6-common)residential subdivision. The 18.39-acre site is
generally located on the west side of North Park Lane approximately 750-feet north of the
intersection of State Highway 44 and North Park Lane.

Scott Wonders, 250 South Beachwood Avenue, Boise. Wonders is with J-U-B Engineers and
is representing the applicant.He gives an overview of the application.
City Planner,Mike Williams,gives a detailed overview of the application.
Chairman Wright opens the public hearing.
Steven Ricks, 3085 Terra Drive, Boise 83709, represents Ballantyne West Lateral Users
Association. Ricks is working with the applicant on pipe size. He has objections to the
condition amendment the applicant discussed.
Allan Ulves, 338 North Havasu Court, Eagle, Idaho. Ulves is concerned with the subdivision
having smaller lots which will cause property values to go down.Ulves is also concerned with
planting trees too close to the pipeline which will cause irrigation issues in the future.
Joe King, Secretary/Treasurer of the Ballentyne Ditch Company, 170 North Sierra View Way,
Eagle. King is concerned with pipe size and needs to know who the members of the
Ballantyne West Lateral Users Association are.
Jason Taylor, 352 North Havasu Court, Eagle. Taylor provided written testimony. Taylor is
concerned about the effects the ditch and T box will have on his property. Taylor is also
concerned with the quality of the homes that CBH Homes will build.
Wonders provides his rebuttal and expresses he is willing to work with the ditch companies.

General discussion amongst the Commission regarding the application.
City Planner, Mike Williams, states that the applicant was requesting two modifications.
Should the board choose to approve, staff recommends the following modifications: 1)modify
3.7 in the areas where it references the Ballentyne Ditch Company,the documentation should
be changed to reflect the Ballantyne West Lateral Users Association. Also, site specific
condition No. 2 in regards to the pressurized irrigation for the maintenance around the pond
easement.
Smith makes a motion to recommend approval item 5B A-03-15/RZ-06-15/PP-05-15 —
Springhouse Subdivision: with the following exceptions, item number 2 on the specific
conditions and then item 3.7 that references the Ballentyne, be changed to Ballantyne
West Lateral Users Association. Seconded by Soelberg. ALL AYES... MOTION

C. CU-05-15/PPUD-02-15/PP-06-15 — Shadowbluff Planned Unit Development — Envision
Homes, Inc: Envision Homes, Inc., represented by Shawn Nickel with SLN Planning, is
requesting conditional use permit, preliminary development plan, and preliminary plat
approvals for Shadowbluff Planned Unit Development, an 18-lot (15-buildable, 3-common)
residential planned unit development. The 4.35-acre site is generally located at the west side
of North Horseshoe Bend Road approximately a 1/4-mile south of the intersection of East
Floating Feather Road and North Horseshoe Bend Road at 10895 North Horseshoe Bend
Road.

Chad Olsen, 12790 West Telemark Street Boise, Idaho. Olsen is representing the applicant
and gives a brief overview of the application.
City Planner,Mike Williams,gives a detailed overview of the application.
Chairman Wright opens the public hearing.
Chris Todd, 3047 East Shadowwolf Drive, Eagle, Idaho. Todd is representing Shadowridge
Homeowners Association. Todd is requesting one lot be removed due to the lot lines not
matching up with the adjacent houses. In addition he is requesting a landscape buffering and
moving the common lot to a more centralized location.
George Aspen, 3029 East Shadowband Court. Aspen would like the land filled in. Aspen
would like to work with the developer on minor adjustments.
Ron Skinner, 2998 East Shadowwolf. Skinner would like to see the park in the center so
everyone would have access to it.
Applicant provides rebuttal and address the concerns that were made tonight.

Smith makes a motion to recommend for approval item 5C. CU-05-15/PPUD-02-15/PP-

7. REPORTS:
A. Commission: Commissioner Soelberg asks for clarification on the 300-foot homeowner
notifications for Land Use applications. City Attorney,Cherese McLain,explains the 300-feet
requirement is in all directions and for cell towers it is 1000-feet.
B. City Attorney: Cherese McLain states the Green mediation is taking place tomorrow for the
Lexington Hills issue.
C. Staff:NONE
