Minutes - 2015 - Planning & Zoning - 06/15/2015 - Regular 311 THE CITY OF EAGLE PLANNING AND ZONING COMMISSION June 15,2015 Minutes 1. CALL TO ORDER: Meeting called to order at 6:00 p.m. 2. ROLL CALL: Present: SMITH, SOELBERG, KOELLISCH, VILLEGAS AND WRIGHT. Absent: A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of June 1, 2015. B. Findings of Fact and Conclusions of Law for CU-03-15 — Craft Beer Bar — Patrick Weber: Patrick Weber is requesting conditional use permit approval for a craft beer bar located within the Clock Tower Center. The 0.92-acre site is generally located on the northeast corner of S. Edgewood Lane and E. State Street at 1580 East State Street. Soelberg moves to approve the minutes as presented. PUBLIC HEARINGS: A. CPA-01-15/A-01-15/RZ-04-15 —Linder Crossing— LR5, LLC: LR5, LLC represented by Shawn Nickel of SNL Planning, is requesting a Comprehensive Plan Text Amendment to amend the density language for the "Rim View Planning Area", a Comprehensive Plan Map Amendment to change the future land use map designation from Transitional Residential to Mixed Use, and annexation and rezone from RUT (Residential Urban Transition — Ada County Designation) to MU-DA (Mixed Use with a development agreement [in lieu of a conditional use permit])to construct a 166-unit apartment complex. Chairman Wright introduces the item. City Planner, Nichoel Baird Spencer, requests that this item be continued to the July 20, 2015, Planning and Zoning Commission meeting. Smith moves to table CPA-01-15/A-01-15/RZ-04-15 — Linder Crossing — LR5, LLC to July 20, 2015.Seconded by Koellisch.ALL AYES... MOTION CARRIES. C. CPA-03-15/RZ-06-15—JLG-5,LLLP: JLG-5,LLLP,represented Scott Noriyuki with Northside Management, is requesting a Comprehensive Plan Map amendment from Residential Three(up to 3 units per acre)to Mixed Use and a rezone from A(Agricultural) to MU-DA(Mixed Use with a development agreement in lieu of a PUD)to develop a 43-unit residential development(42-new and 1-existing,5.42-units per acre) . Scott Noriyuki,6810 Fairhill Drive,Boise.Mr.Noriyuki gives a detailed overview of the application. City Planner,Nichoel Baird Spencer,gives a summary of the Comprehensive Plan and addresses the Comprehensive Plan Map amendment application. Staff recommends approval for this Comprehensive Plan Map amendment. City Planner,Mike Williams, gives an overview of the Rezone application.The applicant is in agreement with all of staffs recommendations.Williams asks that if the Commission does recommend for approval, on condition 3.8,the applicant is required to do a 35 foot buffer adjacent to both Hill Road and Edgewood.Also, make a recommendation to Council on condition 3.13 to allow shared driveway access to more than two properties. Chairman Wright Opens the Public Hearing. Pat Town, 2004 Edgewood.Mr.Town does not understand the density associated with this project. Planner Williams provides clarity to Mr.Town's question on density. Teresa Johnson, 3417 N.Croft Way.Ms.Johnson has concerns with changing the zoning designation to Mixed Use and has heartburn about the density. Bob Wilson, 1642 Lurelwood.Mr.Wilson has concerns with the density and the potential sound that will occur due to the rooftop yards. Mr.Noriyuki provides a rebuttal and addresses the concerns that were addressed tonight. Chairman Wright closes the Public Hearing. General discussion amongst the Commission regarding density,zoning, and the Comprehensive Plan. Villegas moves to recommend for approval CPA-03-15/RZ-06-15 the Comp Plan Amendment from Residential Three to Mixed Use as well as to tie that in with a recommendation of approval of the rezone as well to the Mixed Use with a development agreement.And a recommendation to City Council that the 3.13 be amended to allow shared driveway access to more than two properties. Cherese: On 3.8 we had that fifty foot versus the 35 foot.Were you willing to take staff's recommendation on that?Villegas: Yes.Seconded by Soelberg.ALL AYES... MOTION CARRIES. 6.
