Minutes - 2015 - Planning & Zoning - 01/05/2015 - Regular THE CITY OF EAGLE PLANNING AND ZONING COMMISSION January 5, 2015 Minutes 1. CALL TO ORDER: Meeting called to order at 6:01 p.m. 2. ROLL CALL: Present: SMITH, VILLEGAS, SOELBERG, KOELLISCH, WRIGHT. A quorum is present. 3. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. • Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Smith makes a motion to amend the agenda to include the voting for a new chairman and vice chairman. Seconded by Soelberg.ALL AYES... MOTION CARRIES. General discussion amongst the Commission. Soelberg makes a motion to have Koellisch serve as vice chair and Wright as chairman. ALL AYES... MOTION CARRIES. A. Minutes of December 1, 2014. Smith moves to approve the consent agenda as presented. Seconded by Villegas. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE 5. PUBLIC HEARINGS: A. A-05-14/RZ-05-14/CU-05-14/PPUD-02-14/PP-07-14 - Lilac Springs - Coleman Homes, LLC.: Coleman Homes, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting an annexation, rezone from RUT (Rural-Urban Transition — Ada County designation) to R-3-DA-P (Residential with a development agreement and PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Lilac Springs Subdivision, a 132-lot (120-buildable and 12-common)residential planned unit development. The 64-acre site is generally located at the northwest corner of W. Floating Feather Road and N. Lanewood Road. This item was continued from the December 1, 2014, Commission hearing. Chairman Wright introduces the item. Becky McKay, 1029 N. Rosario Meridian, Idaho. McKay states that Putnam Hollis has expressed that he would like to be left out of the application. With regard to the conditions, they are requesting to strike condition#6 and change condition 16 to read a 5 foot interior setback and 5 foot easement. City Planner, Kristy Heller, states that they did meet with Hollis Putnam and he did express that he did not want to be apart of the application. With regard to condition #7, ECC requires pathways on major roadways to be 10 foot in width. Site Specific condition of approval #16, there was a discrepancy and staff was trying to fix that on the plat. He requests to stay out of the application process to keep costs down to a minimum. Wright closes the public hearing. General discussion amongst the Commission. Soelberg makes a motion to recommend for approval item 5A - A-05-14/RZ-05-14/CU-05- 14/PPUD-02-14/PP-07-14 -Lilac Springs - Coleman Homes,LLC with the removal of Condition#6 of staff recommendations. Seconded by Smith.ALL AYES... MOTION CARRIES. B. CU-04-14 — Personal Wireless Facility Height-Over 35-Feet - Doug Kofford/TAEC: Doug Kofford/TAEC is requesting conditional use permit approval for a cell tower(defined as "personal wireless facility height-over 35-feet" in Eagle City Code) to be located at the Eagle High School site in place of an existing baseball field light pole. The proposed 2,500- square foot lease area is located adjacent to the outfield fence of the Eagle High School baseball field approximately 175-feet east of North Park Lane at 574 North Park Lane. Staff is requesting the Commission remand this application to staff. Chairman Wright introduces the item. City Planner, Mike Williams, requests that this application be remanded back to staff. This item will be re-noticed for a later hearing. Koellisch makes a motion to remand back to staff item 5B—CU-04-14—Personal Wireless Facility Height-Over 35-Feet for a later time. Seconded by Smith.ALL AYES... MOTION CARRIES. C. A-04-14/RZ-04-14—Annexation and Rezone from RUT (Rural-Urban Transition)to R-E (Residential-Estates) - Shane and Sharon Mace: Shane and Sharon Mace, represented by Rick McGraw, are requesting approval of an annexation and rezone from RUT (Rural-Urban Transition — Ada County designation) to R-E (Residential-Estates). The 4.6-acre site is located approximately 1200-feet west of the intersection of South Chipper Way and South Locust Grove Road at 1960 West Joplin Lane. D. CU-07-14—Mobile Home (Occupied by a Family Member) and Setback Waiver—Shane and Sharon Mace: Shane and Sharon Mace, represented by Rick McGraw, are requesting conditional use permit approval to allow a mobile home occupied by a family member to continue to be located upon a lot in which a single-family dwelling already exists. The applicant is also requesting conditional use permit approval of a setback waiver to allow existing accessory structures (which are located within a required setback) to remain upon annexation. Seconded by Soelberg. ALL AYES... MOTION CARRIES. E. RZ-06-14/PP-08-14 — Predico EP Subdivision - Eagle M. F. Partners, LLC: Eagle M.F. Partners, LLC, represented by Doug Russell with The Land Group, Inc., is requesting a rezone with development agreement from A (Agricultural — up to one (1) unit per 20-acres), A-R (Agricultural-Residential — up to one (1) unit per five (5) acres) and R-2-DA-P (Residential—up to two (2)units per acre with a Development Agreement—PUD)to MU-DA (Mixed Use with a Development Agreement in lieu of a PUD, including a height exception) and preliminary plat approval for Predico EP Subdivision a 4-lot (3 commercial, 1 residential [88 units]) subdivision. The 10.68-acre site is generally located on the northeast corner of North Ballantyne Lane and West State Street. Chairman Wright calls for a five minute break. Chairman Wright introduces the item. Doug Russell, 462 E. Shore Drive, is with The Land Group and is representing the applicant. Mr. Russell gives a detailed overview of the application and provides a PowerPoint presentation. He is requesting a height exception to the residential buildings of 38 feet 7 inches. City Planner, Williams gives an overview of the application and gives a brief history on the Comprehensive Plan and mixed use zoning in Eagle. With regard to height limitations, pursuant to ECC 8-2-4, the maximum is 35 feet. There have been acceptations to height within Eagle. Staff recommends that if they do waive the height exception, to round up to a whole number. Staff requests to strike a portion of 3.5, all buildings shall be constructed with a craftsman style of architecture. Staff is requesting approval of the applications. Chairman Wright opens the public hearing. Phillip Tuttle, 231 N. Flower Place. As a citizen of the city he is opposed to the project and urges the Commissioners to not approve this application. Mr. Tuttle has fire district and public safety concerns. If there was a three story fire, can they handle it? Mr. Tuttle is retired police force and within the 22 years of doing special investigations cases, he cannot express how many came from large apartment complexes. In his experience with large apartment complexes he has seen vandalism, drug dealing, prostitution rings, abandoned vehicles,nuisance parking, etc.He would like to see condos instead. Brett Johnson, 508 N. Clear Point Way. Mr. Johnson is opposed to the application. He has concerns with traffic safety,noise and congestion. Robert Foster, 2150 W. South Fourth Drive. This expansion is going to create some problems in the schools. He recommends they look at it another way and reduce the height. Karen Howell, 72 N. Lost Canyon Place, is in agreement with the last comment. Eagle Middle School is over capacitated. Ralph Swift, 2311 South Fork Drive, is opposed as it is proposed and dittos the previous comments. George Broyles, 2200 W. Forest Court, is opposed to the application and has concerns with the traffic. Terry Sayer, 2151 W. Forest Hill Court, is the President of the HOA. Mrs. Sayer has concerns with what was purposed with acreage and the number of units. Cindy Poulsen, 2274 W. Forest Hill Court, is opposed to this application. She feels that it does not meet Eagle's vision and there may be better uses for the site. She provides photos of acceptable buildings in Eagle. Glade Poulsen, 2274 W. Forest Hill Court. Mr. Poulsen is a builder here in Eagle and is not clear with what indicates a variance. Megan Hoiosen, 242 Flower Place. Hoiosen is a teacher here in Eagle and her school is over capacity as it is. Cheryl Bloom, 2153 N. Hollybrook Place. Bloom was a P&Z Commissioner when this property first came through the process. She expresses that high density was never discussed. There will be issues with traffic and the project is not compatible with the surrounding area. Laura Borio, 328 N. Lost Canyon Way,touches on a developer's view of investing their capital into land. She also has concerns with child safety. Glen Moore feels as if the property values of the surrounding area may diminish due to the proximity of the multi-family residential units. Doug Russell provides a rebuttal and clarity to the concerns that were addressed tonight. Chairman Wright closes the public hearing. General discussion amongst the Commission regarding the Comprehensive Plan, access points, child safety, school district over growth, compatibility and height concerns. Smith moves to make a motion on 5E for denial RZ-06-14/PP-08-14 - Predico EP Subdivision - Eagle M.F.Partners,LLC. City Planner,Williams informs the Commission to make two separate motions. Soelberg makes a motion to remand RZ-06-14/PP-08-14 - Predico EP Subdivision - Eagle M. F. Partners,LLC back to staff and the applicant due to the Commission's findings that it is not in the spirit of the comp plan. Seconded by Koellisch. Wright makes a substitute motion to recommend for denial of the application 5E. Seconded by Smith. Three AYES (Wright, Smith, Villegas). Two NAYS (Koellisch, Soelberg)... MOTION CARRIES. Soelberg makes an amendment motion to reflect the denial of 5E to a unanimous 5-0 decision in favor of denial. General discussion amongst the Commission and City Attorney regarding proper practice to reflect a unanimous 5-0 decision. McLain expresses that she is going to consider this a Scrivener's error and that the Commission had a 5-0 no vote and that it was a misunderstanding.
