November 3,2014
Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SMITH, VILLEGAS, ROEHLING, KOELLISCH, and WRIGHT. A
quorum is present.
3. CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Soelberg moves to approve the consent agenda as listed. Seconded by Smith. ALL AYE...

4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. A-04-14/RZ-04-14-Annexation/Rezone—Shane and Sharon Mace: Shane and Sharon
Mace,represented by Rick McGraw,are requesting approval of an annexation and rezone
from RUT(Rural-Urban Transition—Ada County designation)to R-E(Residential-Estates up
to one(1)unit per two(2)acres). The 4.6-acre site is located approximately 1200-feet west of
the intersection of South Chipper Way and South Locust Grove Road at 1960 West Joplin
Lane. The applicant and staff are requesting this application be remanded to staff.
Chairman Wright introduces the item.
City Planner,Mike Williams, states that the applicant requested that the application be remanded
back to staff due to other applications that they have to fulfill.
Villegas makes a motion to remand application A-04-14/RZ-04-14—Annexation/Rezone.
Seconded by Soelberg. ALL AYES... MOTION CARRIES.
B. RZ-20-06 MOD/PP-06-14-Riverscape Subdivision-OC Holdings,Inc: OC Holdings,
Inc., represented by Dave Yorgason with Tall Timber Consulting, is requesting a development
agreement modification and preliminary plat approvals for Riverscape Subdivision, an 87-lot
(79-buildable, 7-common, and 1-private street)residential subdivision. The 22.17-acre site is
generally located at the southwest corner of West OldValley Road and North Linder Road
Chairman Wright introduces the item.
Dave Yorgason is with Tall Timber Consulting and is representing the applicant. Yorgason gives an
overview of the application and the history associated with this property. There are two items in the
development agreement that they're requesting changes to. He is requesting to strike the last sentence in

condition 3.13 and remove 3.16. With regard to the staff report, he requests to delete condition #5 and
#10. And remove the first sentence in condition#9.
City Planner, Mike Williams, gives an overview of the application. Staff requests that condition 9 and 10
remain as written. With regard to the development agreement, 3.13 should remain the same because it is
a Council discussion. There was a request from Parks and Rec for a sportsman's access, so he would
request item 3.16 remain as is. He also requests to add an item F to 3.16 per Fish and Games condition of
approval.
Chairman Wright opens the public hearing.
Mike Payne, 4034 N. Reese Creek Place, Meridian. Mr. Payne believes that there should be some sort of
safe access to the river.
Yorgason provides a rebuttal and clarity to the concerns tonight.
Chairman Wright closes the public hearing.
General discussion amongst the Commission regarding the application and sportsman's access.
City Planner,Williams,requests that there be two separate motions for the RZ and the Plat.
Villegas makes a motion to recommend for approval RZ-20-06 MOD with the following
modifications 3.13 that we recommend that the city council strike or remove the previously
attached and recorded Memorandum of Agreement as requested by the applicant. Specifically,the
last sentence of 3.13. 3.16 as to the sportsman access, with the modification to the language from
the staffs recommendation to provide that the applicant shall work with the Eagle Parks and Rec
Director and PPDC to formalize an agreement to provide a sportsman's access. Williams
recommends striking and a parking area for a minimum of ten vehicles. Add item F to insert the
language as stated by Fish and Game. Seconded by Wright. Discussion on water availability. ALL
AYES... MOTION CARRIES.
Soelberg makes a motion to recommend for approval PP-06-14 - Riverscape Subdivision with the
following changes to site specific conditions listed in the staff recommendations. Site specific
condition #5 to be removed. Site specific condition #9 to be kept in the conditions and site specific
condition#10 to be removed.Villegas seconded.ALL AYES... MOTION CARRIES.
