Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SMITH, VILLEGAS, ROEHLING Absent: KOELLILSCH,
WRIGHT. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of June 2,2014.
Smith makes a suggestion on the closing parts of the minutes on item#7. He'd like it to be more
complete for the record. He felt it would be standard that if he wasn't there for the previous
business and there was no real business then he wouldn't be in attendance. He expresses that for
the entire period of time he has sat on this Commission that was the only time that he has ever
failed to call in to indicate that he'd be absent.
Smith moves to approve the minutes of June 2, 2014 as presented with the additional
comments made by Commissioner Smith. Seconded by Villegas. ALL AYE... MOTION
CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. CU-02-13/PPUD-02-13/PP-04-13—Alderwood Village No.2 Planned Unit Development—
Tealev's Land Surveying: Tealey's Land Surveying represented by Pat Tealey, is requesting
conditional use,preliminary development plan, and preliminary plat approvals for Alderwood
Village No. 2 Planned Unit Development, a 18-lot(15-buildable, 3-common)residential
subdivision. The 4.7—acre site is located at 947 W. State Street approximately 430-feet west of
South Grandean Way.
Chairman Roehling introduces the item.
Pat Tealey, 12594 Explorer Boise, Idaho. Mr. Tealey reviews the application,the history associated with
this land, and also discusses the plan for the proposed project. The development will share the existing
20 foot alley. They would like to be a part of the original Alderwood Village HOA but the HOA is not in
agreement. Tealey has a concern with site specific conditions of approval #7 and request that it be
removed.
Chairman Roehling requests that the representative go over each question on the letter written by the
Aldwerwood Village HOA.
Tealey addresses each question written by the HOA president.
City Planner, Mike Williams gives an overview of the staff report and addresses the concerns over the

fence and access issues. In regard to site specific condition#7, that goes back to Eagle City Code 9-3-2-
1(H). He would request that the condition not be stricken. Regarding the park issue and fence area.
There is no need to remove any vinyl fence adjacent to the park areas because they're not utilizing that
area for access. The only area of the fence that really needs to be removed is adjacent to the alley.
Williams request that the Commission add a site specific condition of approval that they provide a surety
for 150% of the replacement costs of replacing the fence. That way the surety is sitting in place, so if
everything goes south on the development the City can come back in and act on the surety and replace
the fence.
Chairman Roehling states that there is also the issue of damage to the alleyway itself. What are your
thoughts on an alternative for the fence to provide a surety, is there a need for doing something similar on
a shared resource such as an alleyway?
City Attorney McLain states that there is a site specific condition that requires the two subdivisions to go
into a maintenance agreement of that shared access. At this time while a financial assurance for the
fence may be something to explore but would suggest not doing it for potential damage to the alleyway.
Chairman Roehling opens the public hearing.
Dave Yorgason, 14254 W. Battenberg Boise, Idaho. Mr. Yorgason has been working with the applicant
and stands in support of this project.
Rick Anderson, 191 S. Grandean Way. Mr. Anderson is the HOA president of Alderwood Subdivision
No. 1. His main concerns are with the alley and fence. He believes that the alley is not 20 feet wide at
most it is 19 feet wide. The other issue with the alley is that fire trucks can not make the turn from the
west alley at the southern end to Grandean. There was an incident in November where the Eagle Fire
Department was not able to make that turn. Regarding the fence, the fence provides a sense of security
for children and pets of the original Alderwood Village. They are worried about kids and pets getting out
to the State Street bypass.
Michelle Dell Colli, 153 S. Grandean Way. Dell Colli serves on the Alderwood HOA. She provides a
petition which will be put into the City Council packet. Her main concern is emergency access and
wants to ensure that when they prepare the CC&R'S they put a requirement that they share the
maintenance and snow plowing.
Anna Iverson, 11346 W. Hazelwood Drive Boise, Idaho. Iverson is concerned with the alleyway to the
west which will make it so she can't use that access route. When it becomes a fire lane she believes it
will affect the value of her property and feels that there will not be enough room for the garbage truck to
go down the alleys.
Wayne Swanson, 985 W. State Street. Mr. Swanson wants to ensure that he continues to receive flood
irrigation.
Guy Hendrickson, 408 S. Eagle Road. Hendrickson is a local realtor and resident of Eagle. He believes
it's a wonderful project that will stir up revenues for the City.
Tealey rebuts testimony and responds to the comments that were addressed tonight. He is in agreement
to provide a surety for the fence. The operation of the maintenance of the alley and the shared expenses
will be addressed with the current HOA and in the CC&R'S.
Yorgason expresses that they will try to delay the removal of the fence for as long as they can. They will
not be throwing away the fence, they will store the material on site and plan to reuse it in the event the
development went under. Regarding the maintenance agreement, he proposes a suggestion to add a
couple of words to condition#11. After the word cross access add the words and maintenance. In other
words the agreement would be both a cross access and maintenance agreement that they'd have with the
HOA. They fully agree with a 50/50 sharing cost.

General discussion amongst the Commission.
Chairman Roehling states that there are some points that need to be addressed in the site specific
conditions of approval. Condition #11 should be revised and after the word cross access add and
maintenance. Condition #23 should read, the applicant shall provide a surety of 150% of the cost to
replace the fence on the western border of the alley in the event that the development does not proceed.
Condition #24 should read, Construction vehicles may only use public streets for access during the
period of construction. Condition #25 should read, the applicant shall place signage at each end of the
alley indicating that the alley is private property and not open to construction traffic.
Smith moves to recommend for approval item 5A CU-02-13/PPUD-02-13/PP-04-13 — Alderwood
Village No. 2 Planned Unit Development with the comments that Commissioner Roehling had
already identified. Seconded by Villegas. ALL AYE... MOTION CARRIES.

A. Commission: General discussion on encouraging energy efficient development and the
process on policy changes and potential incentives.
