Minutes - 2013 - Planning & Zoning - 08/19/2013 - Regular THE CITY OF EAGLE PLANNING AND ZONING COMMISSION August 19,2013 Minutes 1. CALL TO ORDER: Meeting called to order at 6: 02 p.m. 2. ROLL CALL: Present: TANNER, AIZPITARTE, SMITH, Absent: ROEHLING, VILLEGAS. A quorum is present. 3. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner,member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Findings of Fact and Conclusions of Law for CU-03-13/PPUD-03-13/PPUD-03- 13/PP-05-13 - Snoqualmie Falls Subdivision No. 4-Horseshoe Flats,LLC. Horseshoe Flats, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting a conditional use, preliminary development plan, and preliminary plat approvals for Snoqualmie Falls Subdivision No. 4 a 55-lot(43 buildable and 12 common)residential subdivision. The 23.83-acre planned unit development is generally located south of Floating Feather Road, west of Linder Road at the terminus of West Signature Drive. Smith moves to approve the consent agenda as presented. Seconded by Aizpitarte. Smith the approval is with the correction on page 14 — the vote should be 3 to 0 (Tanner & Roehling absent). TWO AYE...ONE ABSTAIN (Tanner was not in attendance at this meeting). MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE 5. PUBLIC HEARINGS: A. RZ-24-06 MOD4 & PP-03-12 -Renovare Subdivision-Renovare Development,LLC.: Renovare Development, LLC, represented by John Rennison with Rennison Engineering is requesting a development agreement modification and preliminary plat approval for Renovare Subdivision a 67-lot (55 buildable, 11 common, and 1-park site)residential subdivision. The approximately 37.38-acre site is generally located on the east side of South Edgewood Road approximately 710-feet south of State Highway 44. This item was continued from the August 5, 2013 Chairman Aizpitarte introduces the item. John Rennison 430 E. State St. Eagle, Idaho representing Renovare Development LLC. The proposal is for a gated community with private roads. This is not the type of development that has been seen in Eagle before, but they are confident the Commission will support it after the presentation. Mr. Rennison reviews the application. The configuration was based on pond location and other physical constraints on site. Site layout, set backs, sidewalk placement, lot size, street width, building pad size and structure orientation are reviewed. General discussion. Loren Emms,Landscape Architect, having worked on several projects in Eagle. Mr. Emms discusses the plan for the proposed project. Discussion. City Attorney requests a 5 minute break, City Attorney Buxton states that the item 5B is also on the agenda tonight. After consulting with M3's representatives and City Staff, and with the understanding that the plan is to bring the entire ZOA-01-13 back for public hearing meeting on September 16, we are asking the Commission continue this item until it can be re-noticed for hearing. Chairman Aizpitarte really liked the cover memo staff provided for ZOA-01-13 giving a synopsis of the items being reviewed. Aizpitarte moves to continue ZOA-01-13—M3/Spring Valley—M3 Eagle, LLC to September 16th or until it is re-noticed for public hearing. Seconded by Tanner. ALL AYE...MOTION CARRIES. Mr. Rennison continues reviewing the applicants requested changes to the site specific conditions. Discussion. 8:05 p.m. City Planner, Mike Williams reviews the staff report. He reviews Ada County Highway District road construction standards, as well as Eagle City Code requirements regarding streets, sidewalk locations, street width and landscaping. Discussion. Eagle Parks and Recreation Director, Mike Aho, discusses the proposed pathway and how it will integrate into the long range plans of the pathway system in Eagle and the surrounding area. Chairman Aizpitarte opens the public hearing. Mike Ford 1545 E. Lone Shore Eagle, Idaho. Mr. Ford had submitted a letter opposing a parking lot location, but after the presentations tonight he understands that it will be in a different location. Comments on the proposed park location and is concerned with the increase in traffic. Mr. Ford relays some of the problems they are currently encountering involving dogs off leash, and public intoxication. He doesn't have a problem with a gated community, as it is only 55 units. Charles Wood, 1778 W. Copperfield Nampa, Idaho. He owns the property. Dave Buich 2415 W. Sugar Crest Eagle, Idaho. Mr. Buich states that both he and Mr. Wood own the property. City Attorney Buxton states that in order to keep the record straight, Mr. Wood and Mr. Buich would be able to address rebuttal comments after public testimony has been taken, as the applicant's representative concluded his presentation and public testimony has began. Karen Elithorp 724 S. Lone Brook Eagle, Idaho. She lives in the River District, is the head real estate agent in the River District, and she and her husband manage the development of the River District. She is very protective of this area. She would like more enforcement of leash laws and no trespassing laws. The greenbelt needs to be better maintained. When will the park be developed? She is also going to be one of the lead real estates agents at Renovare. There is a lot of interest in this type of project and community. Corey Elithorp 724 S. Lone Brook Eagle, Idaho. He and Karen manage the River District and is also a builder down there. He hopes the Commission embraces the unique community that is being proposed. The contemporary style will be embraced by the market. The trash and trespassing is a big impact to the River District. If the pathway is approved a plan for maintenance, clean up and enforcement would need to be addressed. Maury Levi 1171 S. Edgewood Ln. Eagle, Idaho. He echoes what Mr. Ford testified. While signage has been installed for the no parking and bike lanes, there is still a problem. Trash and dog feces is a big problem down in this area. Restricted parking is not enforced. He is concerned if a park is developed and people are actually encouraged to increase use what the impact will be to those already living there. Chairman Aizpitarte calls a 5 minute break. It has been his intent to donate the land ever since Mrs. Merrill was with the City. He would discourage a parking lot back there, it adds to the vandals and trouble makers that are around to a degree now. He has been in touch with the Land Trust and their representatives are amenable to taking the property. John Rennison provides rebuttal. Discusses lot access, phasing of amenities, street width and speed limit enforcement. General discussion. Dave Buich 2415 Sugar Crest Drive Eagle, Idaho. Mr. Buich relays his vision of the proposed community. Comments on the location of the pathway. General discussion. Chairman Aizpitarte closes the public hearing. Discussion amongst the Commission. Commissioner Smith and Tanner are in general in favor of the application. Chairman Aizpitarte has a few concerns and would like staff and the applicant to tighten up the conditions. He also has concerns with the gated community and the private roads. Discussion. The Commission is looking to have Staff and the applicant work towards hammering out the setbacks, the park, and parking lot,the possible land locked parcel. And a tighter presentation would be better. Smith moves continue this item to September 16, 2013 meeting. Seconded by Tanner. ALL AYE...MOTION CARRIES. B. ZOA-01-13—M3/Spring Valley—M3 Eagle,LLC: M3 Eagle, LLC, is requesting a zoning ordinance amendment to establish development standards and processes for the M3/Spring Valley Planned Development consistent with the Pre-Annexation/Development Agreement(PADA) and the condition of development. This item was continued from the August 5, 2013 See motion above. 6. NEW BUSINESS: NONE 7. REPORTS: A. Commission: Smith thanks the Fire Department. Discussion regarding the electronic format of documents received by the Commission for review. B. City Attorney: No report. C. Staff: No report Tanner states that due to scheduling conflicts and personal commitments that he will soon be resigning from the Commission. 8. ADJOURNMENT: Aizpitarte moves to adjourn.
