Special Meeting Minutes
1. CALL TO ORDER: Meeting called to order at 6:05 p.m.
2. ROLL CALL: Present: TANNER, ROEHLING, AIZPITARTE, SMITH, VILLEGAS. Absent:
TANNER.
3. PUBLIC HEARINGS:
A. ZOA-06-12—Zoning Ordinance Amendment—City of Eagle: A Zoning Ordinance Amendment
To Eagle City Code Title 8 "Zoning", Chapter 1 "Zoning Interpretation And Definitions", Chapter 2
"Zoning Districts And Maps", Chapter 2a"Design Review Overlay District",Chapter 3 "Performance
Standards", Chapter 4 "Off Street Parking And Loading", Chapter 5 "Nonconforming Uses", Chapter 6
"Planned Unit Developments", Chapter 7 "Zoning Administration And Enforcement", And Chapter 10
"Development Agreements."
Chairman Aizpitarte introduces the item.
Zoning Administrator Bill Vaughan reviews the changes as presented in the zoning ordinance
amendment. Discussion amongst the Commission,Zoning Administrator and City Attorney Cherese
McLain regarding proposed changes.
Chairman Aizpitarte opens the public hearing.
Steve Madigan 642 Steeple View Dr. Eagle, Idaho. He is here on behalf of his neighbor, Ray Smith 748
Steeple View Drive who is out of town. Mr. Madigan states that Mr. Smith was in last fall addressing
the rear property line setback of 30' and through the process of the City Council they amended City Code
8-2-4 for the rear setback for an accessory building if certain criteria were met within the variance
application. However, they overlooked the side setbacks and is trying to building an accessory building
and have better utilization of his entire lot. Discussion of Mr. Smith's situation. Mr. Madigan states that
Mr. Smith would like the code pertaining to side yard setbacks be amended maximize the use of the lots
space for accessory buildings.
At the request of the Commission, Zoning Administrator Vaughan reads the code section relating to side
yard setbacks. Discussion.
Chairman Aizpitarte closes the public hearing.
Discussion amongst the Commission, Zoning Administrator Vaughan and City Attorney Cherese
McLain.
Smith recommend for approval ZOA-06-12 with the changes discussed tonight. Seconded by
Villegas. Discussion. Smith amends to include for consideration the numerous and various
comments made this evening regarding the proposed language. Second concurs. ALL
AYE...MOTION CARRIES.
