Minutes - 2013 - Planning & Zoning - 01/07/2013 - Regular THE CITY OF EAGLE PLANNING AND ZONING COMMISSION January 7,2013 Minutes 1. CALL TO ORDER: Meeting called to order at 6:08 p.m. 2. ROLL CALL: Present: ROEHLING, AIZPITARTE, SMITH. Absent: VILLEGAS, TANNER. A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner,member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of December 17,2012. There are not two Commissioners is attendance at tonight's meeting,that were in attendance at the December 17, 2012 meeting, City Attorney Fitzer advises that action on the minutes will need to be continued to the next meeting. Roehling moves to continue the minutes to the next regular meeting. Seconded by Aizpitarte. ALL AYE...MOTION CARRIES. 4. NEW BUSINESS: A. Election of Commission Chairman and Vice Chairman: Vice-Chairman Aizpitarte introduces the item. Roehling moves to appoint Aizpitarte to be Chairman of the Commission. Seconded by Smith. ALL AYE...MOTION CARRIES. Aizpitarte moves to appoint Gary Tanner as Vice-Chairman of the Commission. Seconded by Roehling. ALL AYE...MOTION CARRIES. 5. PUBLIC HEARINGS: A. RZ-05-12/CU-04-12/PPUD-02-12/PP-04-12 -Mace River Ranch Planned Unit Development —Mace Ranch LLC.: Mace River Ranch, LLC, Is Requesting A Rezone From A(Agricultural Up To One(1)Unit Per Twenty(20)Acres)To R-2-DA-P(Residential Up To Two(2)Units Per Acre With a Development Agreement PUD), Conditional Use, Preliminary Development Plan, Preliminary Plat Approvals For Mace River Ranch Subdivision A 283-Lot(255 Buildable And 28 Common) Residential Subdivision. The 192.76-Acre Planned Unit Development Is Generally Located At The North Side Of West Mace Road West Of Eagle Road At 800 West Mace Road. Mace River Ranch, Llc Mace River Ranch Planned Unit Development. This item was continued from the December 17, 2012 meeting. Chairman Aizpitarte introduces the item. Tommy Ahlquist 1263 W. Wickshire Ct. Eagle, Idaho. Mr.Ahlquist is a principle for Gardner Ahlquist and a 13 year resident of Eagle. Mr. Ahlquist reviews the proposed planned unit development for the Mace property. Jeff Wardel 877 Main Boise, Idaho—Legal Counsel for Mace Ranch LLC. They are generally in agreement with the conditions of the staff report and will go over a few items a bit later in the presentation. This application is in compliance with Eagle's Comprehensive Plan. They have worked diligently to maintain the access to the Boise River with the development of this land. Mr. Wardell discusses the previous land use developments pertaining to access to Mace Road,the use of Island Woods a properly constructed collector road,the submitted traffic studies and other transportation issues. Mr. Ahlquist has worked with the Two Rivers Homeowners Association (HOA)and is agreeable to additional conditions that have been between discussed. These conditions include prior to preliminary plat the lots on the south of the proposed development be dimensionally proportional to those to the north in Two Rivers; and work together on the landscaping and maintenance of Island Woods Drive. As to the staff report,the set backs and buffers,they would like the buffer be reduced to make it more cohesive to that of Island Woods,there is an issue with the existing septic system pertaining to the Mace Homestead—this has been granted a life estate and they want to make sure that that will work in the final approval,they are totally in agreement that they work with the City Engineer, City Staff and Two Rivers HOA to address any potential hydrological impact. Mr. Ahlquist introduces Mr. Tom Hill the president of ESI Construction 1122 W. Two Rivers Lane Eagle, Idaho. Mr. Hill has worked on a number of projects with Garner Company and they bring forward quality projects with great integrity. Clark Benson current President of Two Rivers Homeowners Association residing at 660 W. Headwaters. Mr. Benson speaks on behalf of the HOA Board, and does not speak on behalf of all of the Two Rivers residents. The have reviewed the proposed development, and understand that at sometime the Mace property will develop. They welcome the addition of Garner Ahlquist. One of the concerns is the impact of the existing Two River ponds as a result of the dewatering of the property during the construction phase. They have had numerous conversations and have verbal assurance that Garner Company will address and potential watering issues. As a Board they fully support the proposed development. Carl Gebhart, 10306 Harwood Street Dr. Boise, Idaho an Environmental Consultant. Mr. Gebhart reviews his proposals for the proposed park near Boise River. He also reviews other projects he has worked on to show the type of work he has done and what might be done is association with the Mace River Ranch project. Discussion. (The overhead projector shuts down. The Commission offers to have members of the audience to look at the monitors on the dais to follow along. Only one woman chooses to view from the dais. She sits only until Mr. Gebhart's presentation concludes. ) Chairman Aizpitarte discloses that his company in the past has worked with JUB, and he states that he does not have any pecuniary interests. Scott Wonders with JUB Engineers 250 S. Beechwood Ave. Boise, Idaho. Discussion of lots and property in the floodway and/or floodplain. City Planner,Mike Williams presents the staff report. Reviews density, open space requirements, private street requirements, clarifies that the existing septic system may remain until that property is phased into development. Planner Williams reviews the history of Mace Road. It was to be closed in 1999, but remained open for farm access so farm equipment would not have to drive through the Island Woods subdivision. With the creation of Island Woods Way, it is a residential collector and would be able to handle the traffic displaced by the closure of Mace Road. He reviews floodplain development requirements. Planner Williams reiterates that he analyses the applications in regard to compliance with existing City Code. Discussion. ITD has no objections for the Mace River Ranch project. It requires no new access to the State Highway system, and when the corridor was planned they anticipated this level of growth and the upcoming Lakemore project on the east-side of Eagle Road. The Mace Road access does not have an approach permit with ITD. In 1995 when they purchased right-of-way they also purchased the access rights. The Two Rivers Subdivision permit was approved and was required to close Mace Road when the Two Rivers intersection was constructed. For various reasons,Mace Road has been allowed to remain open. The Island Woods Drive roadway was planned between the City,ACHD and ITD to support this level of growth and as the traffic study shows the roadway has sufficient capacity to handle this traffic. ITD will work with the City to plan for the closure of Mace Road. The intention is to allow the continued use for park access(if the park is constructed)or emergency access, and make the permit to the City so the City could control it. It would not be a permit for a public street or for any use other than park and/or emergency access. Once the Mace Ranch project is approved then ITD will work with the city to phase the closure. If project does not proceed forward, ITD will still work with the City to close Mace Road access. Independent of action on this matter, ITD will continue to install raised medians on Eagle Road. Discussion. Chairman Aizpitarte opens the public hearing. Kim Thomas 978 S. Island Glenn Way. Her home backs up to the portion of Mace Road that they are talking about closing. She would like Mace Road closed and not used for construction. Ms. Thomas feels as if it would create an increased safety hazard were the road to remain open and be used for construction. The location of a parking lot will encourage traffic, and again possibly pose a safety hazard. She feels the emergency access should be on the north side of the river near Bella Aquila,not the south side at Mace Road. She is not opposed to the development. Rick Tory 779 W. Headwaters Drive. He would like to recommend that the conditions that Clark Benson mentioned be put in writing and also bring Garner Ahlquist into the loop to get their agreement as well. He would rather have the increased buffer of 35' rather than the reduced that had been mentioned by the applicant's representative. Tommy Ahlquist rebuts testimony. In regard to Ms. Thomas's testimony,they are agreeable to whatever the city determines they want for that area. It is about a 4 acre parcel. Pertaining to Mr. Tory's concerns,they have recommended the alignment of lots between his development and the Two River lots that abut, as well as landscape maintenance issue. Mr. Wardell reviews the additional conditions of approval regarding lot alignment, landscape maintenance, and hydrological mitigation. General discussion. Chairman Aizpitarte closes the public hearing. Discussion amongst the Commission. Smith has similar concerns to the parking lot off of Mace Road that Ms. Thomas mentioned. The applicant has been quite thorough and it is a well thought out application. There has been written comments by several individuals and they are all part of the record. Roehling appreciates the public engagement in this process. Aizpitarte encourages Mr. Benson to get everything agreed to with the developer, he is happy with the amount of public comment on the application. Discussion on Mace Road, buffering, and lot alignment. Roehling moves to recommend for approval RZ-05-12 Mace River Planned. Seconded by Aizpitarte. Discussion. Roehling amends his motion to include the site specific and standard conditions of approval. Second concurs. ALL AYE...MOTOIN CARRIES. Roehling moves to recommend for approval CU-04-12/PPUD-02-12/PP-04-12-Mace River Ranch Planned Unit Development—Mace Ranch LLC.with the following additions to the site specific conditions of approval. Add#40: Mace River Ranch will coordinate maintenance and operation of common landscaping with the Two Rivers Subdivision. Add#41: Private roads may provide access to the area west of the Chevron pipeline easement for all residences in this portion of Mace River Ranch. Second by Aizpitarte. Discussion. Roehling amends his motion for site specific condition#10 to read: The developer shall provide 2" minimum caliper shade class trees,changing the 3 to 2. Second concurs. Roehling amends his motion concerning the section of general site design features,onsite septic system. The existing residential dwelling is serviced by a septic system,the septic system may remain in operation until such time as this area of the property is developed. Wiliams point of clarification,he asks that this be added as a site specific condition of approval vs. modifying the body of the staff report specified and the purpose of the staff report in the section noted by Commissioner Roehling is to identify site characteristics,not designate conditions of approval. Roehling site specific condition#42: The existing residential dwelling is serviced by a septic system,the septic system may remain in operation until such time as this area of the property is developed. The applicant will be required to obtain the proper permits required to abandon a septic system prior to the City Clerk signing the final plat. Seconded by Aizpitarte. Discussion.
