Minutes
1. CALL TO ORDER: Meeting called to order at 6:02 PM.
2. ROLL CALL: Present: TANNER, ROEHLING, VILLEGAS. Absent: AIZPITARTE,
SMITH. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Chairman, a
Commissioner, member of City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent Agenda
will be placed on the Regular Agenda in a sequence determined by the Rules of
Order.
♦ Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Planning & Zoning Commission's
Consent Agenda approval motion unless specifically stated otherwise.
A. Minutes of November 19, 2012
Chairman Villegas introduces the item.
Roehling moves to approve the minutes of November 19, 2012, as written.
Seconded by Tanner. ALL AYES. MOTION CARRIES.

5. PUBLIC HEARINGS:
A. RZ-05-12/CU-04-12/PPUD-02-12/PP-04-12 - Mace River Ranch Planned Unit
Development — Mace Ranch LLC.: Mace River Ranch, LLC, Is Requesting A Rezone
From A (Agricultural Up To One (1) Unit Per Twenty (20) Acres) To R-2-DA-P (Residential
Up To Two (2) Units Per Acre With a Development Agreement PUD), Conditional Use,
Preliminary Development Plan, Preliminary Plat Approvals For Mace River Ranch
Subdivision A 283-Lot (255 Buildable And 28 Common) Residential Subdivision. The
192.76-Acre Planned Unit Development Is Generally Located At The North Side Of West
Mace Road West Of Eagle Road At 800 West Mace Road. Mace River Ranch, LLC Mace
River Ranch Planned Unit Development.
Chairman Villegas introduces the item.
Commissioner Tanner asks if any members of the commission have any conflicts or
disclosures regarding the item being discussed. Commissioners Roehling and Villegas state
they do not. Commissioner Tanner discloses that he is a resident of Two Rivers which is
adjacent to the property. He doesn't feel it will impair his decision making. In addition, he has
done legal work for the HOA at Two Rivers. He states he is certain he can make an impartial
decision. Legal Counsel, Paul Fitzer, asks Commissioner Tanner some follow-up questions
for clarification. Is he within 300 feet of the development and received notification of the
hearing? Commissioner Tanner stated he did not receive notice thru the official mailing but did
receive notice thru his HOA. Will he be materially impacted by this? He will not. Did he
legally represent anyone in the HOA in regards to this application? No he did not nor has he
had any ex-parte contact. He again stated he believes he can make an impartial decision.
Commissioner Tanner stated that he would like to have the ACHD staff report in front of them
as well as have the participation of the other two commission members in reviewing this

application. Mike Williams, City Planner, read a letter from ACHD which in short said that
ACHD has no issues with the application and a staff report will be forth-coming.
Commissioner Roehling agrees that having the full commission in attendance would be a
benefit but he is fine with moving forward with the hearing. Commissioner Villegas explains
that there is the potential for continuing the hearing until such time that the entire commission
can be available and he would also like to see the ACHD report.
Tanner moves to continue the hearing to a date certain pending receipt of the report
from ACHD. Hopefully a date and time with a full commission. Seconded by Roehling.
No further discussion. TWO AYES, ONE NAY. MOTION CARRIES. The next date certain
is January 7, 2013 or after that is January 28, 2013. Planner Williams requests the earlier
date as there are already several applications scheduled for the second date. Tanner moves
to amend his motion to a date certain of January 7, 2013, at 6:00 PM. Seconded by
Roehling. TWO AYES, ONE NAY. MOTION CARRIES. Commissioner Villegas thanked
everyone for being present and explained the importance of this item to them, therefore this
public hearing will be continued to January 7th at 6:00 PM.
