Minutes - 2012 - Planning & Zoning - 09/17/2012 - Regular THE CITY OF EAGLE PLANNING AND ZONING COMMISSION September 17,2012 Minutes 1. CALL TO ORDER: Meeting called to order at 6:00 p.m. 2. ROLL CALL: Present: TANNER, ROEHLING, SMITH, VILLEGAS. Absent: AIZPITARTE. A quorum is present. 3. CONSENT AGENDA: NONE 4. UNFINISHED BUSINESS: NONE 5. PUBLIC HEARINGS: A. RZ-04-12 — Rezone From A-R (Agricultural-Residential) to MU-DA (Mixed Use with a Development Agreement)—Eagle Island Crossing, LLC: Eagle Island Crossing, LLC, represented by Eric Anderson with A L Collaborative, is requesting approval of a rezone from A-R (Agricultural- Residential — up to one (1) unit per five (5) acres) to MU-DA (Mixed Use with a development agreement). The 5.5-acre site is located on the south side of West Flint Drive approximately 870-feet east of the intersection of North Park Lane and West Flint Drive at 3605 West Flint Drive. Chairman Villegas introduces the item. Eric Anderson with A L Collaborative, representing Eagle Island Crossing LLC., reviews the application and has no problems with the recommended staff conditions of approval. Discussion regarding noise from the school adversely affecting the residents of the assisted living center; phasing of the development; and attendance at the community meeting, and fencing between adjoining properties. Craig Driver, Garner Company the Project Manager for the Eagle Island Project. The meeting began at 5:30 and stayed significantly later than what was required. City Planner Mike Williams reviews the staff report and the conditions of approval. Villegas opens the public hearing. Ken Washburn, owns the property to the west 3855 Glen Eagle, Idaho. He states the high school noise may pose a problem to the elderly; also the road issue is of concern as the teenagers from the school are driving very quickly and aggressively and will pose risk. Discussion regarding his desire to have fencing or a barrier installed. City Planner, Williams reads Eagle City Code 4-9-6(c) states that schools are exempt from the City's noise ordinance. Mr. Anderson states that they will need to look into the street safety. Mr. Driver states that any fencing will be mutually beneficial to the adjoining property owner and the owners of Eagle Island Crossing. Chairman Villegas closes the public hearing. Discussion amongst the Commission. Smith recommends for approval item 5A,RZ-04-12—Rezone From A-R(Agricultural-Residential) to MU-DA (Mixed Use with a Development Agreement)—Eagle Island Crossing, LLC with the site specific and standard conditions of approval with stipulation that a condition be added between the property owner, Mr. Washburn, and the applicant that an agreement can be reached for the type of fencing, etcetera to be installed as described in tonight's hearing . Seconded by Roehling. Discussion. Smith amends his motion to re-state the additional condition of development 3.13: Owner shall enter into a formalized agreement for the construction of a 6' fence to provide buffering to the adjacent property owner to the west.
