Special Meeting Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: TANNER, ROEHLING, AIZPITARTE, VILLEGAS. Absent:
SMITH. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner,member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of August 6,2012.
Chairman introduces the item.
Roehling states regarding the zoning ordinance amendment in the notes regarding the discussion.
His point was that he was open to the change, but did not feel that they had sufficient information
to act on the change at the last hearing. He would like the minutes modified to reflect that
position. Discussion. City Planner Baird Spencer suggests the following language: "In general
the commission is open to the change but feels they do not have sufficient information at this
time to support such a broad sweeping change that would affect the entire city."
Roehling moves to approve the consent agenda with the changes as presented by Nicole.
Seconded by Aizpitarte. ALL AYE...MOTION CARRIES.

5. PUBLIC HEARINGS:
A. CPA-01-12/ZOA-01-12—Comprehensive Plan Text Amendment and Zoning Ordinance
Amendment to amend the maximum allowable density in the Mixed Use Zone—City of
Eagle: A comprehensive plan text amendment to change the maximum density of residential in
the Mixed Use future land use designation from 10 units to 20 units per acre and A Zoning
Ordinance Amendment to Eagle City Code Title 8 "Zoning", Chapter 2 "Zoning Districts and
Maps", SECTION 1, "Districts Established"to change the maximum density in the Mixed Use
Zone from 10 to 20 units per acre.
Villegas introduces the item.
City Planner Baird Spencer reviews the application, as well as the more recent changes of this
section of the Comprehensive Plan.
Villegas opens the public hearing.
No one chooses to speak.
Villegas closes the public hearing.
General discussion.
Aizpitarte moves to recommend for approval CPA-01-12/ZOA-01-12—Comprehensive Plan

B. ZOA-05-12 — Zoning Ordinance Amendment — City of Eagle: A Zoning Ordinance
Amendment to Eagle City Code Title 8 "Zoning", Chapter 1 "Zoning Definitions", Section 2,
"Rules and definitions", Chapter 2 "Zoning Districts and Maps", Section 3 "Schedule Of District
Use Regulations", and Chapter 3 "Performance Standards", Section 5, "Unique Land Uses" to
establish standards for the provision of accessory dwelling units in residential zones.
Chairman Villegas introduces the item.
City Planner Baird Spencer reviews the proposed zoning ordinance agreement.
Discussion of accessory units and regulations pertaining to CC&R's. lot size and coverage, what other
jurisdictions are doing; attached vs. detached assessor units; requiring owners to live on site. Staff is
directed correct the document to insure consistency of the use of the term "accessory dwelling unit" The
terms "accessory unit" and "accessory dwelling" need to be changed to "accessory dwelling unit" to
maintain the integrity of the defined term.
Villegas opens the public hearing.

Discussion amongst the Commission.
Roehling moves to recommend for approval ZOA-05-12—Zoning Ordinance Amendment—City of
Eagle A Zoning Ordinance Amendment to Eagle City Code Title 8 "Zoning", Chapter 1 "Zoning
Definitions", Section 2, "Rules and definitions", Chapter 2 "Zoning Districts and Maps", Section 3
"Schedule Of District Use Regulations", and Chapter 3 "Performance Standards", Section 5,
"Unique Land Uses" to establish standards for the provision of accessory dwelling units in
residential zones. Seconded by Aizpitarte. ALL AYE...MOTION CARRIES.
