Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: TANNER, ROEHLING,AIZPITARTE, SMITH,VILLEGAS.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
• Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of July 16,2012.
B. Findings of Fact and Conclusions of Law for A-02-12 & RZ-02-12 — Annexation and
Rezone - M3 Companies: M3 Companies, represented by Gerry Robbins is requesting
approval of an annexation and rezone from RR(Rural Residential—Ada County designation)
to R-E (Residential-Estates — up to one (1) unit per two (2) acres). The 9.96-acre site is
located on the east side of State Highway 16 at the northeast corner of State Highway 16 and
West Equest Lane at 8860 West Equest Lane(Lot 1,Block 1, Gulch Ranch Estates).
Roehling recommends approval of the consent agenda,all items on that agenda,as written.
Seconded by Smith. ALL AYE...MOTION CARRIES. Villegas abstains as he was not at the
hearings for these items.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. ZOA-03-12—Zoning Ordinance Amendment- Moffat Homes: An Ordinance Of The City
Of Eagle, Ada County Idaho Amending Eagle City Code Title 8 "Zoning", Chapter 2
"Zoning Districts And Map", Section 4, "Schedule Of Building Height And Lot Area
Regulations"; Providing A Severability Clause; And Providing An Effective Date.
Chad Moffat, 702 W. Beacon Light, Eagle, Idaho reviews the application and gives history
behind it. Zoning Administrator,Bill Vaughan addresses the commission. Discussion amongst
the commission, City Attorney Fitzer and staff.
Chairman Villegas opens the public hearing. Mr. Moffat addresses the commission again.
Villegas closes the public hearing. Commission discussion.
In general the commission is open to the change but feels they do not have sufficient information
at this time to support such a broad sweeping change that would affect the entire city.
Discussion on possible alternatives.
Aizpitarte moves to deny ZOA-03-12—Zoning Ordinance Amendment-Moffat Homes.
Seconded by Smith. Discussion. Tanner: Nay,Aizpitarte: Aye, Smith: Aye,Roehling: Aye,
Villegas: Aye. Four Ayes,one Nay...MOTION CARRIES.
