1. CALL TO ORDER: Meeting called to order at 6:00 pm.
2. ROLL CALL: Present: TANNER,AIZPITARTE, SMITH
Absent: ROEHLING,VILLEGAS
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of April 2, 2012.
Smith moves to approve the minutes as written. Seconded by Tanner. ALL
AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. A-01-12/RZ-01-12 Annexation and Rezone From RUT (Rural—Urban Transition—Ada
County designation) to A-R-DA (Agricultural-Residential with a Development
Agreement) — Summer Lawns: Summer Lawns represented by Shawn Nickel with SLN
Planning is requesting approval of an annexation and rezone from RUT (Rural-Urban
Transition—Ada County designation)to A-R-DA(Agricultural-Residential up to one(1)unit
per five(5)acres with a development agreement). The five(5)acre site is located on the west
side of North Horseshoe Bend Road approximately 475-feet south of the intersection of
North Horseshoe Bend Road and East Floating Feather Road at 11075 North Horseshoe
Bend Road.
***Note, due to a failure in the recording equipment, the first part of the applicants presentation
is not part of the recording.***
Shawn Nickel, 1589 N. Estancia Place, Eagle reviews the application. City Planner Williams
reviews the application.
Discussion on how many horses the applicant has on the property, how the grass clippings will
be taken care of,how often they will be removed from the property. Set back discussion.
Aizpitarte opens the public hearing. No one from the public wishes to speak.
Shawn Nickel addresses the commission with clarification.Aizpitarte closes the public hearing.
Aizpitarte moves to approve A-01-12/RZ-01-12 Annexation and Rezone From RUT (Rural
—Urban Transition—Ada County designation) to A-R-DA (Agricultural-Residential with a
Development Agreement) — Summer Lawns with the following recommended language on
3.4 change that at any time if the accessory structures located adjacent to the north and
south property are removed or relocated they will comply with the 30 ft. side yard setback

prior to the city's adoption of a rezone ordinance for the site.
Seconded by Smith. Aizpitarte amends the motion language to the following: at any time if
the accessory structures are removed or relocated they will comply with 30 ft. side yard
setback as required by the city to that particular zone. Second concurs. Discussion. ALL
AYE...MOTION CARRIES.
6. NEW BUSINESS: None.
7. REPORTS:
A. Commission: Hill Road traffic light will be installed when? ACHD equipment rodeo.
B. City Attorney: None.
C. Staff: Building permits are up in numbers. Some expired plats are starting to see new
interest.
8. ADJOURNMENT:
Hearing no further business, the Commission meeting adjourned at 7:05 p.m.
