Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: TANNER, ROEHLING, AIZPITARTE, SMITH, VILLEGAS. A
quorum is present.
3. CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of October 4,2010.
Roehling moves to approve the consent agenda as presented. Seconded by Aizpitarte. ALL
AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. PP/FP-01-10 & V-01-10 — Combined Preliminary and Final Plat and a Variance for a Private
Street for M3/Hanson Subdivision — M3 Companies, LLC: M3 Companies, LLC, represented by
Shawn Nickel with Stanley Consultants, Inc., is requesting combined preliminary plat and final plat
approval for M3-Hanson Subdivision, a five (5) lot residential subdivision (4-residential, 1-private street)
and a variance to allow for a private street within a subdivision. The 24.22-acre site is generally located
on the west side of North Hartley Road approximately 0.8-miles north of West Beacon Light Road. This
item was continued from the October 4, 2010 meeting.
Chairman Roehling introduces the item.
Shawn Nickel with Stanley Consultants 2264 S. Bonito Way Ste. 150 Meridian, Idaho representing M3
Companies. Mr. Nickel states that the applicant is requesting the postponement of final plat action to a
later date, but would like to move forward with the preliminary plat and variance applications tonight.
Nickel continues to review the remainder of the variance and preliminary plat portions of the application.
City Planner, Mike Williams reviews the staff report and recommended conditions of approval.
Discussion on private street requirements, precedence for waiving street light requirements and sidewalk
requirements.
Discussion amongst staff and the Commission regarding requirements for pressurized irrigation, run off
retention and dark sky ordinances.
Scott Wonders, Stanley Consultants, provides clarification on storm drain run off retention and
development mitigation
Staff is recommending that the Commission strike 9 & 10 in the standard conditions.
Chairman Roehling opens the public hearing.
CJ Petrosysky, 4831 Willow Creek Rd. representing North Ada Foothills Association. She applauds this
application because it fits so well with the comp plan and with the entire environment. She is also in

support of all of the waivers being requested by the applicant, regarding the curb and gutter and the street
light requirements.
Joan Langdon 4690 Hartley Rd. Eagle, Idaho. She is in favor of this application and lives across the
street from the property associated with this application. Ms. Langdon comments on ACHD
improvements that have recently occurred on Hartley Road. She is supportive of waiving the street light
requirement, and also notes that there are no sidewalks anywhere near this proposal. Ms. Langdon is in
favor of the proposal.
Shawn Nickel rebuts testimony commenting on the flexibility allowed in Eagle City Code to grant the
waivers requested tonight.
Chairman Roehling closes the public hearing.
Aizpitarte moves to recommend for approval PP-01-10 — Combined Preliminary for a private
street for M3/Hanson Subdivision M3 Companies LLC, with the following changes. Page 3 of 34
item #4: CDHD spelled out to read Central District Health Department. Item #5: where it
begins"...2) the two (2) travel lanes shall be a minimum of twelve feet (12') in width" strike #3, #4
and the end of #5 as follows., • • • . . . .

a cul-de-sac designed in accordance with the provisions of Eagle City Code subsection 9-3-2-1(G)
(circular turnaround having a minimum radius of fifty feet [50] of right of way ring a

provided at the time of submittal of a final plat application. (ECC 9-3-2-5 [B])". Page 29 of 34
standard conditions of approval striking both #9 and #10. Strike#13 replacing it with a "A clearly
visible and/or reflective monument shall be placed at the road entrance." I think that is all I have.
We are looking at a 24' road, oh and we are striking the street lights and we are striking the island.
Seconded by Roehling. Discussion. Aizpitarte amends his motion to strike site specific condition
#11, and replace that with language offered by Commissioner Smith and is also standard condition
#12 on page 29. Second concurs. Discussion. Aizpitarte amends his motion to add site specific
condition #16: Based on findings that surface irrigation water rights do not exist on the property
that the Planning and Zoning Commission recommends a waiver of the pressurized irrigation
system requirement. Second concurs. Discussion. ALL AYE...MOTION CARRIES.
