1. CALL TO ORDER
2. ROLL CALL: TANNER, ROEHLING, AIZPITARTE, VILLEGAS ABSENT: SMITH
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated othl~rwise.

Villegas states that his name is misspelled on pag~: 2.
Tanner moves to approve the minutes with the spelling correction on page two. Seconded
by Roehling. ALL AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. RZ-19-06 MOD - Development Aereement Modification - M3 Companies, LLC.: M3
Companies, LLC, represented by Gerry Robbins, is requesting a modification to the pre-
nnexation/rezone/development agreement for the M3 Eagle Development to include site
specific hillside and grading standards as required within the original development
agreement. The 6,005 acre site is generally located north of the Farmers Union Canal and
Homer Road, east of State Highway 16 and west of Willow Creek Road. Staff is requesting
this item be continued to the August 3, 20m' meeting.
Tanner moves to continue RZ-19-06 MOD - Development Agreement Modification - M3
Companies, LLC to Aug, 3, 2009 meeting. Seconded by Aizpitarte. ALL AYE...MOTION
CARRIES.
B. A-06-09/RZ-07-09 Annexation and Rezone from RUT (Rural- Urban Transition - Ada
County desienation) to R-E-DA (Residential-Estates with a Development Aereement)
Clarence and Carolvn Stockstill: Clarenc~: and Carolyn Stockstill represented by Karla
Williams with MarKar Custom Homes, LLC, are requesting approval of an annexation and
rezone from RUT (Rural-Urban Transition-Ada County Designation) to R-E-DA
(Residential-Estates up to one unit per two (2) acres with a development agreement). The
5.00-acre site is generally located on th{: north side of W. Floating Feather Road
approximately 220 feet east of N. Ballantyn'~ Lane at 1980 and 1984 W. Floating Feather
Road. (MJW)
Karla Williams, 2065 E. Fairview, Meridian, Idaho 83642 reviews the application. Staff member
Lowe reviews the application. Further discussion with the applicant. Tanner closes the public
hearing. Commission discussion.

Aizpitarte moves to approve A-06-09/RZ-07-09 Annexation and Rezone from RUT (Rural -
Urban Transition - Ada County designation) to R-E-DA (Residential-Estates with a
Development Agreement) Clarence and Carolyn Stockstill with the following amendments:
3.4 All structures currently existing on the site are recognized in their locations which mayor
may not comply with the set back requirements of Eagle City Code relative to the RE
zoning district. No further encroachment in the required setbacks are permitted, no
further development or building permits shall be permitted until such time as a parcel
division is approved and recorded. Any parcel division shall comply with Eagle City
Code.
3.5 The existing home may continue to use the existing potable water septic tank, however the
applicant shall provide a stub out for central and sewer services located on parcel A
which is also 1984 Floating Feather. The applicant shall not provide a stub out for 1980
(dwelling) for central water to existing home, parcel B, in the event that potable water
fails. The stub out line shall be provided prior to the city clerk signing record of survey.
3.6 Upon failure of the potable well, the owner for the residential dwelling (1980 Floating
Feather) shall be required to obtain approval from IDWR for another well for the sole
purpose of supplying the heating and cooling system.
Seconded by Tanner. Discussion. Aizpitarte amends the motion:
The applicant shall provide a stub out for central water to the existing home on the parcel A, which
is 1984 Floating Feather Road.
3.9 Upon failure of potable well for parcel A, which is 1984 Floating Feather Road the owner of
the residential dwelling shall be required to obtain approval from IDWR for another well for the
heating and cooling system. Discussion. Second concurs. Discussion. ALL AYE.. ..MOTION
CARRIES.
***Commissioner Villegas has concerns in regard to ACHD's request to exact the right of way and
dedication of such, this is not the city's task and ACHn should do their own request for this rather
than the city requiring it.
