January 26, 2009
1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: SMITH, TANNER, ROEHLING, AIZPITARTE
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of January 5, 2009.
B. Findin!!s of Fact and Conclusions of Law for A-07-07/RZ-09-07/PP-11-07 - Stillwater
Business Park - Tri Cedars Mana!!ement Co. LLC: Tri Cedars Management Co. LLC,
represented by Ron Bath, is requesting annexation and rezone from RUT (Rural Urban
Transition), PS-DA (Public/Semi-public with a development agreement) and A-R
(Agricultural Residential) to BP-DA (Business Park with a development agreement) and
preliminary plat approval for Stillwater Business Park, a 16-lot (I3-buildable, 3-common)
commercial development. The 30.38-acre site is located approximately 1,300 feet west of
West Ballantyne Road on the south side of West State Street (SH 44) at 2505 West State
Street (SH 44).
Aizpitarte moves to accept the Consent Agenda as written. Seconded by Roehling. ALL
A YES...MOTION CARRIES.
4. PUBLIC HEARINGS:
A. A-06-08/RZ-12-08 - Annexation and Rezone from RUT to A-R-DA - Abundant Life
Baptist Church: Abundant Life Baptist Church, represented by Jim Main with Design West
Architects, is requesting approval of an annexation and rezone from RUT (Rural Urban
Transition - Ada County designation) to A-R-DA (Agricultural-Residential- up to one (I)
dwelling unit per five (5) acres with a development agreement) to facilitate the construction of
a church facility. The 5.78-acre site is generally located approximately 1000 feet east of North
Park Lane on the south side of West Floating Feather Road at 3633 West Floating Feather
Road.
Tanner introduces the item.
Tanner opens the public hearing.
Jim Main, 216 S W 5th, Meridian, begins by introducing Matt Adams as he is more familiar with
this portion of the application.
Matt Adams, 462 E. Shore Drive, Eagle, reviews the application.
Aizpitarte asks if there were any objections from the neighbors. There was a neighborhood
meeting. Jim Main states that none of the neighbors were in attendance. Aizpitarte also discusses
average daily traffic. Tanner asks if Mr. Adams has any issues with how the conditions are
drafted. There are no concerns and they will be revising their site plan.
Mike Williams, City Staff, reviews the staff report.
Smith asks about the phases of this project. Will the first building remain if they build another?
Planner Williams adds that the first building may be used as a parsonage once the new church is

constructed. The applicant wilJ address this further. Smith asks about the situation of the
proposed ball field. Planner WilJiams shows where this site abuts two ball fields for Eagle High.
Smith asks about public meetings. He assumes that since no one attended the meeting that there is
no opposition. Planner WilJiams discusses that there are many churches in the general area. Smith
also asks about the Drainage District #2 letter regarding trees in their easement. Planner Williams
points out where the existing trees are. General discussion.
Aizpitarte withdraws his earlier question in regard to the ACHD response. Discussion on the right
of way. General discussion.
Roehling asks about drive and parking surfaces. Planner WiJIiams states City Code 8-2A requires
pavement and would be required through the Design Review process. Also asks how much the
current septic system could handle in the meantime. There wiJI be a permitting process and
Central District Health Department wiJI look at that again prior to occupancy.
No one from the public is here to speak.
Jim Main rebuts testimony. The pastor's desire is to put in a ball field to be used by the
community. Doesn't think that it would be much bigger than a T-Ball field or little league field.
They wiJI revisit that. There are not any plans to do any work on the southern portion of the site.
Discussion on the traffic loads. There wiJI only be seating for a hundred people when they open.
They would like to utilize the existing septic as it would be more cost effective and bring the sewer
services at a later time.
Tanner closes the public hearing.
Smith has lived in the area for 12 or 13 years. Likes the phasing of the project. Likes that the
parking is behind the building. Has no concerns on this going ahead.
Aizpitarte agrees with what has been said.
Roehling is very much in support.
Roehling moves to recommend for approval A-06-08/RZ-12-08 - Annexation and Rezone
from RUT to A-R-DA - Abundant Life Baptist Church - accept this proposal with the
recommended conditions of development. Planner Williams clarifies motion. Motion retlects
changes. Seconded by Aizpitarte. All AYES...MOTION CARRIES.
5. REPORTS:
A. Commission: Roehling asks about the downtown parking and when that wiJI be coming in
front of them again. StaffwiJI get a timeline and give an update.
B. City Attorney: None.
C. Staff: Planner Williams gives a brief update on the Terra View application.
6. ADJOURNMENT:
Hearing no further business the Planning & Zoning Commission meeting adjourned at 6:35 p.m.
