Minutes - 2008 - Planning & Zoning - 12/15/2008 - Regular THE CITY OF EAGLE Planning & Zoning Commission Minutes December 15, 2008 1. CALL TO ORDER: Meeting called to order at 6:03 p.m. 2. ROLL CALL: Present: Smith, Felix, Aizpitarte, Tanner, Roehling. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on'the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of November 3, 2008. Aizpitarte moves to accept the Minutes of November 3rd, 2008 per the Consent Agenda. Seconded by Roehling. ALL AYES...MOTION CARRIES. 4. DISCUSSION ITEMS: Meeting date for the second meeting in January. Commission agrees that January 26, 2009 will be the meeting date. 5. PUBLIC HEARINGS: A. A-07-07/RZ-09-07/PP-ll-07 - Stillwater Business Park - Tri Cedars Mana!!ement Co. LLC: Tri Cedars Management Co. LLC, represented by Ron Bath, is requesting annexation and rezone from RUT (Rural Urban Transition), PS-DA (Public/Semi-public with a development agreement) and A-R (Agricultural Residential) to BP-DA (Business Park with a development agreement) and preliminary plat approval for Stillwater Business Park, a 16-lot (l3-buildable, 3-common) commercial development. The 30.38-acre site is located approximately 1,300 feet west ofW. Ballantyne Road on the south side ofW. State Street (SH 44) at 2505 W. State Street (SH 44). Staffis requesting this item he continued to a date specific to he determined hy the Planning & Zoning Commission. Aizpitarte moves to continue A-07-07/RZ-09-07/PP-ll-07 - Stillwater Business Park - Tri Cedars Management Co. LLC to the date specific time of January 5th, 2009. Seconded by Tanner. ALL A YES...MOTION CARRIES. B. PP/FP-02-08 - Arts West Subdivision No.2 - Ea!!le Island Crossin!!. LLC: Eagle Island Crossing, LLC, represented by Kammie Oates with Horrocks Engineers, is requesting combined preliminary plat and final plat approval for Arts West Subdivision No.2 (a re- subdivision of Lot 6, Block 2 of Arts West Subdivision). The 2.78-acre subdivision will consist off our (4) commercial lots. The site is located on the north side of State Highway 44 approximately 1,320 feet east ofN. Park Lane, on Lot 6, Block 2, of Arts West Subdivision. Kammie Oates, Horrocks Engineers, presents the Commission with handouts and a slideshow of the application. Agrees with the conditions in the staff report. Aizpitarte asks why there is not a letter from lTD. There was already an approval for the light at the site. Mike Williams, City Staff, reviews the staff report. Discusses the light. There was a response from ITD, and all traffic concerns have been addressed. Stands for questions from the Commission. Roehling has nothing to add. Supports the proposal as it exists. Tanner has no concerns as the applicant has no issues with the conditions of approval. Smith concurs with what has been said. Believes the project looks very nice. Felix concurs with what has been said. Tanner moves to recommend approval of item 5B on tonight's agenda - PP/FP-02-08 - Arts West Subdivision No.2 - Eagle Island Crossing, LLC with all of the Site Specific Conditions of Approval and Standard Conditions of Approval recommended by staff. Seconded by Felix. ALL AYES...MOTION CARRIES. 6. REPORTS: A. Commission: Aizpitarte discusses the upcoming election for chair and vice-chair at the January meeting. Would like someone else to have the opportunity to serve as Chairman. B. City Attorney: None. C. Staff: None. 7. ADJOURNMENT: Aizpitarte moves to adjourn. Seconded by Smith. Preliminary Plat The applicant may request that the subdivision application be processed as both a preliminary and final plat if all the following exist: ➢ 1.The proposed subdivision does not exceed ten(10)lots; • 2.No new street dedication or street widening is involved; • 3. No major special development considerations are involved such as development in a floodplain,hillside development or the like; • 4. All required information for both preliminary and final plat is complete and in an acceptable form;and > 5.The proposed subdivision is not in conflict with the comprehensive plan or any provision of the zoning title of the city. Conclusion • This request is to subdivide Lot 6, Block 2 of Arts West Subdivision into 4 commercial lots. • The purpose and use of this land will not deviate from the use granted under the Arts West Subdivision. The utilities and public services for the site have been previously designed, approved and deemed adequate to serve the development through the review and platting of Arts West Subdivision. . This subdivision will not require any changes or modifications to the current improvements as approved and constructed for Arts West Subdivision. 3
