Planning & Zoning Commission Minutes
November 3,2008
I. CALL TO ORDER: Meeting called to order at 6:03 p.m.
2. ROLL CALL: Present: Smith, Felix, Aizpitarte, Tanner, Roehling
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

C. Findinl!s of Fact and Conclusions of Law for PP-13-08 - Preliminarv Plat for Lonesome
Dove Subdivision IT: Lonesome Dove, LLC, represented by Kevin McCarthy, P.E., with
Rennison Fodrea, Inc., is requesting preliminary plat approval for Lonesome Dove II
Subdivision (a re-subdivision of Lot I, Block I, Lot I, Block 2, and Lot 5, Block 4 of the
approved final plat for Lonesome Dove Subdivision), a 72-lot residential subdivision (70-
residential, 2-common). The 4.35-acre site is generally located on the southwest comer of
Riverside Drive and State Street at 1505 Riverside Drive.
Smith moves that the Findings of Fact and Conclusions of Law for PP-13-08 - Preliminary
Plat for Lonesome Dove Subdivision IT be accepted as well as the minutes. Seconded by
Tanner. ALL AYES.. .MOTION CARRIES.
4. PUBLIC HEARINGS:
A. CU-04-08 - Retail and Wholesale Sales Area for Landscapinl! Products for Idaho
Concrete Companv: Idaho Concrete Company, represented by Jim Mihan with Beck and
Baird Engineering, is requesting conditional use permit approval to allow for a retail and
wholesale sales area for landscaping products. The 2-acre site is located 560-feet west of State
Highway 55 at 2755 E. State Street.
Aizpitarte introduces the item.
Jim Mihan, 2552 W. Hays, Boise. Reviews the application. They agree with all of the site
specific conditions proposed by the staff. Stands for questions from the Commission. No
questions from the Commission at this time.
Ted Vanegas, City Staff, reviews the staff report. This has been there for approximately 6 months.
The City requested a Conditional Use application. Stands for questions from the Commission.
Commissioner Felix states that Planner Vanegas mentioned the applicant has agreed to close off
one of the accesses to the site. Planner Vanegas says the access has been closed. This access,
there are two; currently one intersects with Highway 55 at the lighted intersection which is how
you access the site. There was a gated access further to the west along Highway 44 as well, which
has been closed for some time now. Commissioner Felix: That was one of my concerns. I have
purchased materials from Idaho Concrete. I've got a 20 foot goose neck dump trailer. When I
pulled out of there, I went right but the guy in front of me had a trailer and went left. He almost
caused a huge wreck. I'm glad to hear that that one is no longer there. Commissioner Felix asks
that the calculation on the parking be reviewed. Planner Vanegas reviews the process of the

calculations. Felix asks if the improvements will remain for the duration of the permit. Planner
Vanegas explains that these are permanent. Discusses the pathway network plan. Chairman
Aizpitarte asks if there was any consideration from Three Cities River Crossing. There were no
concerns received.
Aizpitarte opens the public hearing.
David Krueck, attorney, asks if the Commissioners have any questions for him as part of the
representing team.
Jim Mihan rebuts.
Aizpitarte closes the public hearing.
Discussion amongst the Commission.
Roehling likes to see the commercial part in that area.
Tanner concurs.
Smith discusses a radio program he had heard regarding Idaho Concrete. Feels the property is
being developed well.
Felix feels the path and the landscape is great.
Aizpitarte concurs with what has been said.
Smith moves to approve of CU-04-08 - Retail and Wholesale Sales Area for Landscaping
Products for Idaho Concrete Company. Seconded by Roehling. ALL AYES...MOTION
CARRIES.

6. ADJOURNMENT:
Aizpitarte moves to adjourn. Seconded by Tanner. ALL AYES...MOTION CARRIES.
