Minutes - 2008 - Planning & Zoning - 10/20/2008 - Regular THE CITY OF EAGLE Planning & Zoning Commission Minutes October 20, 2008 1. CALL TO ORDER: Meeting called to order at 6:03 p.m. 2. ROLL CALL: Present: Smith, Felix, Aizpitarte, Tanner, Roehling 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of October 6, 2008. Aizpitarte moves to continue the minutes the next meeting. Seconded by Roehling. ALL AYES...MOTION CARRIES, B. Findine:s of Fact and Conclusions of Law for RZ-IO-08 - Rezone From R-4 (Residential - uv to four dwelline: units ver acre) to CBD-DA (Central Business District with a Develovment Ae:reemenO - Cottonwood Eae:le Road. LLC: Cottonwood Eagle Road, LLC, represented by Van Elg with The Land Group, Inc., is requesting approval of a rezone from R-4 (Residential- up to four units per acre) to CBD-DA (Central Business District with development agreement). The 3.87-acre site is located on the west side of North Eagle Road approximately 375-feet north of State Highway 44 at 235,247,265 and 403 South Eagle Road. Aizpitarte removes item B from the Consent Agenda. Aizpitarte is concerned with the entrance/exit is a right in right out only - there is nothing that signifies that. Expressed as concern to City Council. Appreciative of Roehling's no vote because of traffic concerns. Would like to see an island there. Feels traffic is critical there. Smith discusses the south exit. Discussion. Would like staff to develop a memo to Council expressing concerns. Aizpitarte moves to approve Findings of Fact and Conclusions of Law for RZ-10-08- Rezone From R-4 (Residential- up to four dwelling units per acre) to CBD-DA (Central Business District with a Development Agreement) - Cottonwood Eagle Road, LLC. Seconded by Tanner. 4. PUBLIC HEARINGS: A. PP-13-08 - Preliminarv Plat for Lonesome Dove Subdivision II: Lonesome Dove, LLC, represented by Kevin McCarthy, P.E., with Rennison Fodrea, Inc., is requesting preliminary plat approval for Lonesome Dove II Subdivision (a re-subdivision of Lot 1, Block 1, Lot 1, Block 2, and Lot 5, Block 4 of the approved final plat for Lonesome Dove Subdivision), a 72- lot residential subdivision (70-residential, 2-common). The 4.35-acre site is generally located on the southwest corner of Riverside Drive and State Street at 1505 Riverside Drive. Commissioner Smith discloses that he is acquainted with Mr. Longsen. He will be able to give fair and accurate judgement Chad Longson, 2615 E. Aspen Court, developer of the property. Discusses the history of the property and the current application. Discusses changes to the Site Specific Conditions. The application was originally approved with 6 feet wide pathways. Mr. Longson explains the changes. Do the paths connect anything on the end? Mr. Longson explains the main flow. Smith wants to know what a micro-path is. Micro-paths are separate from sidewalks and have multi-uses within a subdivision. Ted Vanegas, City Staff, reviews the staff report. Discusses meetings with ACHD and Eagle Fire. Not opposed to striking # 11. Smith reads text -asks where the movie theatre, ect. is located. Planner Vanegas points out where these buildings are located. Roehling asks about the dwelling units per acre. Asks for clarification. Planner Vanegas discusses the calculations of the entire project. Discussion of residential buildings being located near a collector which buffering is required. Area does not appear to be pedestrian friendly. Roehling comments on the density and access to the greenbelt. Planner Vanegas discusses that the micro-pathway will have access to the greenbelt. Aizpitarte opens the public hearing. No one from the public chooses to speak. Chad Longson rebuts testimony. The entire project is pedestrian friendly. Lone River drive was originally approved as an alley. Wanted to help with traffic mitigation. They have built the streets in accordance with ACHD. Aizpitarte closes the public hearing. Discussion amongst the Commission. Smith has no problems and no questions. Felix has no issues with the proposal and supportive of changes of # 11 from 8 feet to 6 feet. Tanner concurs with what has been said. Roehling has no further questions. Has concerns with density and pedestrian friendliness. Aizpitarte concurs with what has been said. Tanner discusses the 16 foot wide easement - can be stricken. Roehling moves to approve PP-13-08 - Preliminary Plat for Lonesome Dove Subdivision IT, modification to Site Specific Conditions to strike condition 11. Seconded by Smith. Discussion. Roehling amends motion - Site Specific Condition #11: provide a revised preliminary plat that shows all micro-pathways within the development to be to be six feet wide. The rest of the motion to remain the same. Include Site Specific Condition 19, strike - and located within sixteen foot wide easement throughout. The revised preliminary plat shall be reviewed and approved by staff prior to the submittal of a final plat application. Second Concurs. ALL AYES...MOTION CARRIES. 5. REPORTS: None 6.
