Minutes - 2008 - Planning & Zoning - 09/15/2008 - Regular THE CITY OF EAGLE Planning & Zoning Commission Minutes September 15, 2008 1. CALL TO ORDER: Meeting called to order at 6:00 p.m. 2. ROLL CALL: Present: Smith, Felix, Aizpitarte, Tanner, Roehling. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Findine:s of Fact and Conclusions of Law for CU-03-08 - Conditional Use Permit for an Ambulance Service Dispatch Station - Sf. Lukes Health System: St. Luke's Health System, represented by ZGA Architects and The Land Group, Inc., is requesting conditional use permit approval to provide accommodations for an on site ambulance service dispatch station located at the St. Luke's Regional Medical Center. The 14.49-acre site is located at the southwest comer of State Highway 44 and Horseshoe Bend Road at 3101 East State Street. Aizpitarte moves to approve the Consent Agenda as stated. Seconded by Tanner. ALL AYES...MOTION CARRIES. 4. NEW BUSINESS: A. 20080019 S-CU-MSP - Preliminary Plat. Conditional Use Permit and Master Site Plan For A Residential Subdivision and Church Facility - The Heie:hts Church. Inc.: The Heights Church, Inc., represented by Ryan Mackowiak with CSHQA, is requesting preliminary plat approval for Heights Subdivision and approval for a conditional use permit and master site plan for a church. The 20.91-acre site is generally located on the northwest comer of Eagle Road and Beacon Light Road. This site is located in the Eagle Area of Impact, Aizpitarte introduces the item. Ted Vanegas, City Staff, reviews the application. Stands for questions from the Commission. Roehling asks about buffering and lot size. General discussion. Smith discusses the building. Will there still need to be a buffer between the church and the residential lots? Planner Vanegas - there should be buffering in the area. Aizpitarte asks why they are going through the County, There were pre-application meetings held with Mike Williams. Planner Williams discusses the process. Discusses ACHD requirements. Roehling has questions of the Site Specific Conditions. Planner Vanegas explains the process. Smith feels the application is straight forward. Happy there are five acre lots. Tanner moves to approve application 20080019 S-CU-MSP - Preliminary Plat, Conditional Use Permit and Master Site Plan for A Residential Subdivision and Church Facility - The Heights Church, Inc. subject to the Site Specific Conditions of Approval recommended by staff with the addition of Site Specific Conditions of Approval #10 that would read: provide a revised preliminary plat that indicates a 35-foot wide landscape buffer to be constructed adjacent to the western boundary of lot #1. The revised preliminary plat shall be reviewed and approved by Ada County Development Services, Seconded by Aizpitarte. ALL AYES,. ,MOTION CARRIES. 5. PUBLIC HEARINGS: A. A-04-08/RZ-09-08 & PP-04-08 - AnnexationlRezone & Preliminarv Plat for Svrine:haven Subdivision -Beacon Lie:ht Homestead. LLC: Beacon Light Homestead, LLC, represented by Matt Smith is requesting an annexation and rezone from RUT (Rural-Urban Transition - Ada County designation) to R-E-DA (Residential- Estates, one unit per two acres with a development agreement) and preliminary plat approval for Springhaven Subdivision an 8-lot (6-buildable, 2- common) residential subdivision. The 14.36-acre site is generally located on the south side of East Beacon Light Road approximately 1,984 feet east of the intersection of North Eagle Road and East Beacon Light Road at 671 East Beacon Light Road, Aizpitarte introduces the item. Nate Honestack, 10221 W. Emerald Street, Suite 100. Gives an overview of the project. Stands for questions from the Commission. Smith feels the subdivision was well planned. Asks about the neighborhood meeting. There were some questions from the neighbors but no major concerns were brought up. Mike Williams, City Staff, reviews the staff report. Stands for questions from the Commission. Roehling asks about the length of the cul-de-sac. General discussion. There were no comments from the fire department. Tanner asks about Site Specific Conditions #4 & 5. Asks about the dedications of the easements. Clarification from Planner Williams. Felix asks if Planner Williams has met with anyone on the east side of the this property. Clarification from Planner Williams. Aizpitarte opens the public hearing, Sheri House, 801 Beacon Light Road, has a question on the easements. Represents the owners of the property to the east. Wants to make sure they will be notified when the vacations are done. Mike Perry, 650 Los Luceros Drive, neighbor to the south. There was a time a while back that this was put on hold due to DEQ and septic issues. They're property has wells. Has concerns with the density. He would rather see one street rather than two. Has concerns with the vacation of the easement. Smith asks what Mr. Perry's definition of privacy is. The land is flat out there. Does not expect someone to donate their land for his own preserve. Aizpitarte goes over CDH's and DEQ's comments. General discussion of groundwater problem. Asks ifthe Commission have the leeway to look ahead at future potential development. Matt Smith, 1133 E. Covery Run. Answers questions brought up earlier. There is an agreement in place with ACHD. The easements will go away. They will work with the owner's to the east on those easements. Discusses the nitrate issues. They have been working with DEQ on this. Tanner asks about an unplatted parcel on the southwest corner and if there would there be a utility easement in place for this parcel. The water would be supplied to this parcel. Roehling asks about the vacating the easements. General discussion. Aizpitarte closes the public hearing, Roehling has concerns with the ground water contamination. Has concerns about the easements and two access points on Beacon Light Road. Tanner discusses the requirement to vacate the easement. His concern is with the parcel feels there should be a public utilities easement. Smith asks about vacating easements. Planner Williams explains the process. Tanner adds some additional information. Felix has concerns with multiple Beacon Light Road accesses. Feels other concerns can be mitigated. Tanner asks ifthere is a minimum distance for access points that ACHD requires. Access points are based on the type of the road and the speed. Aizpitarte feels that everyone has expressed most of his concerns. Discusses access points on Beacon Light. Tanner moves to approve application A-04-08/RZ-09-08 & PP-04-08 - Annexation/Rezone & Preliminary Plat for Springhaven Subdivision - Beacon Light Homestead, LLC. with all the Site Specific Conditions of Approval and Standard as provided by staff with the addition that the applicant provide a public utility easement that will service the unplatted parcel located approximately at the southwestern corner of the development, Seconded by Aizpitarte. Discussion. Planner Williams asks ifhe can just add that to Site Specific Condition #6. Tanner agrees. Aizpitarte would like to put in a note of concern regarding the access issues. Tanner discusses the distance between the current access and the property to the east. Discusses ACHD standards. Roehling concurs with Tanner's comments. Discusses the vacation of the easements and this will be an issue to be dealt with in the future. ALL A YES.,.MOTION CARRIES. B.
