CALL TO ORDER: Meeting called to order at 6:03 p.m. 2. ROLL CALL: Smith, Aizpitarte, Tanner. Absent: McCarrel, Felix. 3. PUBLIC HEARINGS: A. A-01-07/RZ-01-07 & PP-01-07 - Annexation and Rezone from RUT to MU-DAand Preliminarv Plat for Old Vallev Plaza Subdivision - 4149 State Street. LLC: 4149 State Street, LLC, represented by Shawn Nickel with Rose Law Group, is requesting an annexation and rezone of two (2) parcels (totaI2.05-acres), from RUT (Rural Urban Transition) to MU-DA (Mixed Use with a development agreement) and preliminary plat approval for Old Valley Plaza Subdivision, a 1.88-acres, 8-10t (7-buildable, I common) commercial subdivision. Discusses some changes to the staff report. John Church is here tonight. Discusses the proposed changes to the Rim View planning area. Discusses page 28 of the staff report. Discussion on access points. The jurisdiction should be that of ITD and ACHD. Minor corrections to the table on page 31. Page 32, would like to keep the health spa. For 3.13, the last sentence, would like that to be clarified, improvements to be made prior to permanent occupancy. Discusses this application will go in font of Design Review. They want to fit in with the community and would like to do a quality development. Discusses some of the other facilities they have built in other areas. Discusses traffic issues. Stands for questions from the Commission. Smith asks about how many employees - approx. 200. Aspitarte asks about the size. They are also proposing a gasoline station at this site. Nichoel Baird Spencer, City Staff, reviews the staff report and goes through some changes to the report itself. Discusses Meridian AOI and that they have annexed properties within Eagle's AOI. Discussion of access. Discusses the development agreement. Discusses Rim View Planning area. Strike the last line under # I. Strike item D - parcels. There are a series of changes that staff is recommending. Reviews suggested changes. Discusses allowed uses. Does not have an issue with unstriking health spa, weight management, etc. 3.19 -,staff recommends the use of a 48 foot screen wall/vegetation. Staff will defer to Commission about Chinden frontage. Aizpitarte asks about cross access. Stands for questions from the Commission. Smith has concerns about road improvements proposed by the developer. This is a standard procedure. Aizpitarte asks about the floodway and Meridian annexing through the floodplain. Discussion of long range transportation plan and access points. Smith asks about the areas east. Merlin Bodily, 707 N. Linder. Has lived there for 50 years. Discusses development. In favor of the development. Jeff Beagley, 1640 N. Linder. Lives two parcels north of the development. In support of this development. Mimi Plum, 854 River Heights Drive. Reads a letter for the record. Would like the Commission to deny the application. Smith asks if there would be anything to change her mind. Greg Barney, 6687 N. Barney. To the west of the development. Discusses a proposed light. Discusses traffic issues. Ben Needler, 3398 W. Reads letters in support of the project for the record from Chi)ck. Rosco, Corey Elitharp and Douglas Hagemeier. Frank Lee, 60 I W. Bannock, here representing Foxtail Golf Course. They are in full support of the application. Feels this is the right location. Has issues with the access. Discussion of the access. Smith asks about the access. Discussion of cross access. Ted Epperly, 2180 Riveria Drive. Feels sad that those who have to gain financially rather than those who live in the area. Does not want this area to turn into a parking lot. Main concerns with traffic. Is there anything for the light pollution. Discusses noise pollution. There should be provisions made. Scott Trosper, 7110 Springcrest Place. Opposed to the application. Reads a letter for 'the record. Believes the project is too large. Discussion of transition. Asks the Commission to deny the application. . . Ivan Hoffman, 122 N. Linder. Feels the left hand turn would be near to impossible to get into. Feels this should be a four lane road. Andy Lawrence, 1685 W. Brandt Lane. Asks if Mr. Eisenberg is still planning on keeping the gas station in the same location. Asks if his well would get tainted. His house is on the corner. Also has concerns with traffic funneling. Feels there should be more logic put forth. Joe Marshall, 5937 N. Harliss Avenue. Gives some history of Eagle Road. Discusses past approvals of large commercial businesses off of Eagle Road. Believes all the neighbors are opposed of the application. Would rather see this developed in Eagle rather than Meridian. Discusses the situation of the buildings and the fueling station. Foad Rhogani. Most of what he was going to say has been said by others. Does not like the application as proposed. They need to redesign the layout. Discusses access roads and lights. Lee Swinder, 7176 N. Springcrest. Does not understand the whole application. Feels the Commission should be on the side of the residents. Teri Bath, 597 E. State Street. In support of the project. Would rather see the tax base in Eagle than Meridian. Larry Swider, Feels this development is too large. Mark Montier, 7175 N. Springcrest. Asks about the pre-annexation agreement. Presents a video. Feels there should be rules that need to be followed. Carol Montier, 7175 N. Springcrest. Does not feel there should be a change. Very concerned about the traffic. Displays a video of traffic. Lynn Trosper, 7110 N. Springcrest Place. Was here two years ago. The current plan allows for commercial. Does not feel this is what the community wanted. Feels there should be consideration to the other businesses in the area. Has concerns if this development falls through. Does feel this would be bettered managed by Eagle. Wants the zoning to stay as is. Jeremy Evans, 1024 W. McCall Street. Has concerns about buffering. Feels that the area will get bigger. Feels the Commission should not be pushed by developers. Feels there will need to be something done about the smells if there are fast food restaurants. Julie Granger, Locust Grove and Chinden. In favor of having a store that is closer. Feels that may take some of the traffic off the roads. In favor of the project. Paul Farmer, Springcrest. What is Eagle's intention. Is there anything being said about the adjacent properties. Feels this will end up being a land slide. Against the application at this side. ' Karen Bageley. 6940 N. Linder. Does not oppose this development. A short recess is called. Meeting reconvenes at 9:07 p.m. Joanne Butler rebuts testimony. Agrees with the video about the traffic. They agree that it is horrible. The road improvements would be done as a condition of the development agreement. The current plan does not meet Eagle's goals. Would like a clarification to the condition referencing the traffic island. Jason Densmer, discusses traffic issues. Stands for questions from the Commission. Don Forest discusses cross access easement. Also discusses the access points for the project. Would be willing to consider a restricted delivery schedule. Stands for questions from the Commission. Smith feels there should be more time developers should spend with surrounding neighbors. Eisenberg elaborates on the meetings they had with surrounding property owners. Has concerns with changes in the area within the current plan and that Meridian has annexed. Feels this area is underserved. The jobs and taxes would be a tremendous benefit. Smith concurs with Tanner. Feels the project is interesting and exciting. Leaning towards the proposal at this point. Discussion of cross access. Aizpitarte was here two years ago. Not sure if it is a fit at this location. Tanner feels the improvements that are proposed are definitely needed. Smith discusses the design. There should be consideration for the neighbors. There should be an alternative design for the fuel station. Discusses half mile access points. Box 1520 Eagle, ID 83616 Attn: Nichoel Baird Spencer To Whom It May Concern: As a resident of the Lochsa Falls Subdivision, I would like to express my concern about the proposed big box development at the corner of Chinden and Linder Road. I am already concerned about the increase in the traffic situation with the opening of Rocky Mountain High School on Linder. Adding the big box development will make the traffic even more congested on that corner. I walk every morning along Chinden, between Long Lake and Linder, and the traffic along Chinden between 8:00 and 9:00 a.m. is bumper-to-bumper at that time, as well as at other peak times during the day. Adding the high school traffic to that already over- loaded situation will be a nightmare for those of us living in the Lochsa Falls subdivision. I appreciate the fact that lights will be installed at the entrance to Lochsa Falls, and I know Linder has been widened there,but I don't think those additions will help the situation enough to make it amenable to the residents here. There is also a new Challenger School opening on Chinden near the corner of Chinden and Linder, which will increase the traffic flow there. The proposed development is well beyond the one agreed upon two years ago by the mayor and city council that there would be no single business of more than 50,000 square feet. Even with the proposal of turn lanes at the intersection,the overall quality of service is only a"D"on an"A"to"F" scale. The anticipated traffic studies show even more numbers than were shown two years ago. I would like to go on record as opposing this big box development project. Thank you, i&•.144-teje- She' a D. This will bring needed shopping closer to Eagle and north Meridian. Right now we spend many hours per month driving Eagle Rd down to Eagle and Fairview and I am hoping that a nice shopping center at the northern end of town will cut down on my family's driving as well as many others. I know that many people from Emmitt and Star as well as Eagle and north Meridian would welcome not having to drive so far. This will probably cut down traffic overall and not increase total traffic as some may be arguing. Please support and approve this development. A440(1001,6an• P. The Site shall be limited to three (3) drive-thru restaurants, one (1) drive-thru bank, and one (1)fuel service island. The City retains the right to limit the hours of operation of all drive-thru uses to ensure compatibility with adjacent uses.
