THE CITY OF EAGLE PLANNING & ZONING COMMISSION MINUTES March 17, 2008 1. CALL TO ORDER: Meeting called to order at 6:00 p.m. 2. ROLL CALL: Present: FELIX, AIZPITARTE, McCARREL 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of February 25, 2008. McCarrel moves to approve the Consent Agenda. Seconded by Aizpitarte. ALL A YES...MOTION CARRIES. 4. PUBLIC HEARINGS: A. RZ-I-08 & PP/FP-I-08 - Rezone from A-R to R-E-DA & Combined PreliminarvlFinal Plat for Drv Creek Estates Subdivision - Mark A. and Deborah L. Wald: Mark A. and Deborah L. Wald, represented by Larry Koerner with ALS Land Surveying & Civil Engineering, are requesting a rezone from A-R (Agricultural-Residential) to R-E-DA (Residential-Estates with a development agreement) and a combined preliminary plat and fmal plat approval for Dry Creek Estates Subdivision a two (2) lot residential subdivision. The 4.77-acre site is located on the west side of North Edgewood Road approximately 500' south of Beacon Light Road, on Lot 2, Block 3, of Rocket Bar Subdivision, at 2641 North Edgewood Road. Aizpitarte introduces the item. Christina Nimmick, with ALS Land surveying and Civil Engineering, reviews the application. Would like to change some of the conditions. Would like to have shade trees waved and requirement to provide a detailed landscape plan. Discusses standard conditions. Stands for questions from the Commission. Discussion on setbacks and trees. Mike Williams, City Planner, reviews the Staff Report. Stands for questions from the Commission. Rich Felix asks about irrigation. This is addressed in Site Specific Condition #3. Aizpitarte opens the public hearing. Mark Wald, property owner. Discusses the bam structure which has been an existing 12x20 building to store bikes, garden tools, etc. Aizpitarte closes the public hearing. McCarrel discusses the trees. Feels it should be approved with the conditions. Discusses the 20 foot setback. Felix agrees with McCarrel. Is not a fan ofre-subdividing within a subdivision but this does fit with the comprehensive plan. Aizpitarte moves to recommend approval ofRZ-1-08 & PP/FP-I-08 - Rezone from A-R to R-E-DA & Combined PreliminarylFinal Plat for Dry Creek Estates Subdivision - Mark A. and Deborah L. Wald with the following: under Staff Recommendation for rezone 3.3 will Page 1 of2 K\P&Z\MINUTES\Temporary Minutes Work Area\PZ.03-17-08MIN.doc say - The residential dwelling unit shall be a 50 foot front yard set back with the exception of the existing residential dwelling unit that shall be grand fathered at 43 feet setback. 3.4- with the exception of the accessory structure adjacent to the southern property line all other buildings shall be either relocated or will comply with the 20 side yard setback according to the City ordinance. Addition of a Site Specific Condition #7 - the installation of a fire protection sprinkler system is required for all new dwelling units within the subdivision. The system shall be installed prior to the issuance of a certificate of occupancy. Seconded by Felix. Discussion. Mike Williams will provide language recognizing the existing structure available in the Findings of Fact. ALL AYES...MOTION CARRIES. B. CU-OI-08 - Conditional Use Permit for a Research and Development Facilitv for Ue:obe. Inc.: Ugobe, Inc. is requesting conditional use approval to operate a 9,380-square foot research and development facility within Building No.2 of Rooster Condominiums. The .16- acre site is located on the southeast comer of East State Street and East Plaza Drive in Merrill Subdivision No.2, at 1125 East State Street. Aizpitarte introduces the item. Julia Demaree, 335 N. Edgewood, reviews the application. Gives a description of the product that is being developed by the company. This location would be for research and development. Ted Vanegas, City Planner, reviews the Staff Report. Felix asks why there is a CU required for R&D. The CU would protect what the City like to see in mixed use development - office, retail, etc. Aizpitarte opens the public hearing. Aizpitarte closes the public hearing.
