1. CALL TO ORDER: The meeting was called to order at 6:04 P.M.
2. ROLL CALL: Present: FELIX, ZASTROW, PIERCE, AIZPITARTE, McCARREL.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

5. PUBLIC HEARINGS:
A. CU-15-07 - Childcare Facility (Davcare Center with preschool) within and existinl!
Multi-tenant Office Buildinl! - Bryan Syverson and Sarah Johnson: Bryan Syverson and
Sarah Johnson are requesting conditional use permit approval of an I 890-square foot
Childcare Facility (Daycare Center with preschool) within Unit 1, Building A, of Inland
Condominiums. The I.64-acre site is located on Lot I, Block I, of Inland Subdivision on the
south side of East Iron Eagle Drive approximately 500-feet east of East Plaza Drive at 1107
E. Iron Eagle Drive. Stal/is requesting this item be continued to the February 25,2008,
meeting.
Zastrow moves to continue this item to the February 25, 2008, meeting. Seconded by
Pierce. ALL AYES... MOTION CARRIES.
B. A-15-071RZ-22-07 & PP-15-07 - Annexation and Rezone from RUT to MU-DA and
Preliminary Plat for Lan!!tree Subdivision Single-Family and Multi-Family Townhouse
Residential Development Land Associates, represented by Chris Todd with Landmark
Engineering and Planning, is requesting an annexation and rezone from RUT (Rural Urban
Transition) to MU-DA (Mixed Use with a Development Agreement) and preliminary plat
approval for Langtree Subdivision, a 45-10t, 54-unit (33-single-family, [19 multi-family, and
I duplex, contained within 3-lots], 9 common) residential subdivision. The 9.57-acre site is
located on the north side of State Highway 44 (State Street) approximately 1,330 feet west of
Linder Road at 5342 West State Street.
Clint Boyle, 332 North Broadmore Way, Nampa, Idaho, was present to address this item.
This project is an extension of Eagle Field Estates and is located at Linder Road and Hwy 44.
The entrance is off of Escalante Drive which is a collector coming in from Linder Road. The
project complies with the City's Comprehensive Plan. The project is roughly 9.57 acres, 36
buildable lots including an exterior perimeter of single family homes, an alley-load concept in
the central area of detached units, and North of Escalante a 16-unit complex, a duplex and a
triplex. The 16-unit building includes parking under the building. The applicant discussed
the landscaping and the common areas of the project as well as the unique and challenging
features of the area. Exceptions to the lot sizes and setbacks are noted by the applicant.
Applicant offered further detail and explanation regarding the project and answered questions
from the commission.

Mike Williams, City Planner, presented the staff report. Planner Williams addressed the
applicant's comments and requested exceptions. He reviewed City of Eagle code and other
pertinent rules and regulations as they relate to the exceptions, offered staff recommendations
and answered questions from the commission.
There were no other citizen comments on this issue. Chairman Aizpitarte called for a five
minute break.
The hearing resumed at 7:45 P.M.
Applicant rebuttal. Mr. Boyle addressed the comments of the staff and commission members
and restated the exceptions they were requesting approval for.
Pam Walsh, Land Associates, 839 Winding Creek, Eagle, offered her rebuttal comments
regarding some of the commission members' remarks and the staff report. She presented
pictures showing areas in town where front setbacks have been reduced.
Having no further public comment, the Public Hearing was closed at 8: 14 P.M.
Chairman Aizpitarte called for discussion from the commission members.
Commissioner Felix commented on the terms of the setbacks. He was supportive of the
request for the living space to be moved up and the driveways moved back. The rear
setbacks for lots 2-20, 15 feet is fine on the East side if the applicant reaches agreement with
the ditch company. He cannot support less than the 20 feet on the West side, it puts a burden
on the property owner adjacent to that. If the lots become difficult to build, the applicant may
need to look at the lot numbers. He was pleased with the knuckle concept at the multiple unit
area and the applicant's open-mindedness to it. He liked that they provided additional
parking in the open areas. He liked the looks of the 16-unit family dwelling.
Commissioner Zastrow agrees with Commissioner Felix in regards to the setbacks. He would
like the applicant to stay within the 70% lot coverage maximum with both things in question.
He liked the look of the multi-unit building. He expressed concern with the parking area of
it, getting in and out. Overall, the project looks good. He agreed with the restriction on the
lots to the west.
Commissioner Pierce agreed with the other Commissioner's comments and added that the
end alley-loading lots should have I 0' setbacks for safety reasons.
Commissioner McCarrel commented that he was not in favor ofthe plan, there was too much
density. The South and East ends can be moved around. The maximum height and
maximum lot coverage should be maintained.
Commissioner Aizpitarte commented that he liked the appearance of the project, the
appearance on the South end looks good coming into Eagle. He agrees with the comments
from the other commissioners. He also likes the knuckles.
City Planner, Mike Williams, assisted the Commissioners in organizing their wishes into
motion format.
Aizpitarte moves to recommend approval of A-15-07/RZ-22-07 with no added
conditions and condition 3.10 to be restated as follows: Lots 2-6 have a 20' setback
measured from the back (rear), and that Lots 8-20 have a 15' rear setback, the front on
Lots 2-20 have a 10' setback measured from the back of the sidewalk and that the
garage is 15' with no conditions or restriction, and Lots 1-7, Blk 2 and Lots 1-8 Blk 3,
the detached units, 5' front setbacks, 10' rear setbacks, side street 10' setbacks, no
change in the attached units, change the language below to strike the limitation on
single story homes, but keep the language on the 70% maximum lot coverage. Lot 2 B1k
4, Lot 2 B1k 6, stay the same. Lot 2, Blk 5, the multi family dwelling will stay the same.
Seconded by Pierce. Point of clarification was made that these conditions had to be
made for the annexation and rezone because these recommendations will be made a
condition of the development of the rezone. FOUR AYES, ONE NAY (McCARREL)...

City Planner, Mike Williams, reminded the Commission to include the two site specific
conditions they discussed.
Aizpitarte moves to recommend PP-15-07 for approval with the following site specific
conditions: Site condition #34, the revised preliminary plat will show the canal
easement on the east side of the property is at 15'; site specific condition #35 the revised
preliminary plat will show Larksdale removed and a knuckle or equivalent type of stub
on the end of the street will show the multi family dwellings will meet the requirements
of the setbacks that are 15' front, 10' rear and 10' side minimum with a maximum lot
coverage not to exceed 70% before final plat approval will be issued. Seconded by
Pierce. No further discussion. FOUR AYES, ONE NAY (McCARREL)... MOTION
CARRIES.
