ROLL CALL: Present: FELIX, ZASTROW, PIERCE, ASPITARTE, McCARREL 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. NEW BUSINESS: A. 200600327-CU (Ada County Annlication) - Indoor Commercial Ridinl! Arena- Mary Lawson Murnhv: Mary Lawson Murphy is requesting approval ofa conditional use permit to construct an 8,OOO-square foot (approximate) indoor commercial riding arena. The five (5)-acre site is located on the west side ofN. Willow Creek Road approximately % ofa mile north Beacon Light Road on the southwest comer ofN. Heikes Lane and N. Willow Creek Road at 4145 N. Willow Creek Road. This site is located in the Eagle Area of Impact. Pierce introduces the item. Mike Williams, Planning Staff, reviews the application and staff's recommendation of denial to Ada County. Asks the Commission to recommend denial based on four items, etc. revised building elevations. Felix asks the attorney if this would be a conflict of interest for him as he is in the same type of business. Attorney Paul Fitzer asks if there would be direct economic benefit. Indirect benefit could be perceived. Felix requests to recuse himself from this vote. McCarrel asks about the parking lot. Discussion amongst the Commission. Zastrow moves to deny 200600327-CU Indoor Commercial Riding Arena on the basis that it lacks architectural compatibility, it exceeds the 35'height requirement, there is no landscape plan provided to address screening of the facility, and that it is definitely less than 300 feet from other residences. There is a potential for noise nuisance, etc. all in contradict to the Eagle City Code, as much as it is in the area of impact, it stilI falls within the area of impact of the City. Rezone from A-R and MU-DA to MU-DA. and Preliminary Plat for Eal!le Island Crossinl! _ Gardner Ahlquist Develonment: Gardner Ahlquist Development, represented by Pamela Hall with Timberline Surveying, PLLC, is requesting a text amendment to the 2007 Eagle Comprehensive Plan, Section 6.8.2, "Park Lane Planning Area" (b) Design, (2) Flint Estates Area, allowing for densities up to ten (10) units per acre in the mixed use area. The applicant is also requesting a rezone with development agreement from A-R (Agricultural-Residential- one (I) unit per five (5) acres) and MU-DA (Mixed Use with a development agreement) to MU-DA (Mixed Use with a development agreement), and preliminary plat approval for Eagle Island Crossing Subdivision, a 17-lot, 81-unit (27 multi-family [contained within I-lot], 13-commercial, and 3 common lots) development. The 20.97 acre site is located on the south side of Flint Drive approximately 875 feet east of Park Lane on Lots 3,5,6, and 8, Block 2, of the Amended Plat of Flint Estates, at 3605 Flint Drive, 3450 West State Street, 3415 Flint Drive, and 3300 West State Street. RZ-19-07 & PP-16-07 - Rezone from R-3 to MU-DA & Preliminary Plat for Cantera Subdivision - Red Rock DeveloDment. LLC: Red Rock Development, LLC, represented by Hans Linton, is requesting a rezone from R-3 (Residential-up to three units per acre) to MU-DA (Mixed Use with development agreement) and preliminary plat approval for Cantera Subdivision, a 65-lot subdivision, 68-unit (52-single-family, (8 multi-family and 8 commercial contained within two lots), II common) mixed use development. The 10.24 acre site is generally located at the northwest comer of the intersection of East Hill Road and North Echohawk Way, approximately 420 feet west of State Highway 55. The applicant is requesting this item be continued to the October 15, 2007 meeting. Pierce moves to continue RZ-19-07 & PP-16-07 - Rezone from R-3 to MU-DA & Preliminary Plat for Cantera Subdivision to the October 15, 2007, meeting. Seconded by Zastrow. ALL AYES...MOTION CARRIES. C. RZ-20-07 - Rezone from A-R to R-E-DA - Colette Nvbore:: Colette Nyborg, represented by Shawn Nickel with SLN Planning, Inc., is requesting approval of a rezone from A-R (Agricultural Residential) to R-E-DA (Residential Estates with a development agreement) to facilitate the re-subdivision of a portion of Lot 15 & Lot 16 to eliminate two (2) non-conforming parcels. The +/- 2.28 acre and +/- 2.5- acre parcels are located approximately 1/3 of a mile south of Floating Feather on the northeast comer of the Ballantyne Lane and Hereford Drive intersection at 660 North Ballantyne Lane. CU-I0-07 - Conditional Use Permit for a Sewer Lift Station - Eal!le Sewer District: Eagle Sewer District, represented by Lynn Moser, is requesting a Conditional Use Pennit for the construction of a 2,232-square foot sewer lift station facility to be located within an area currently zoned R-2-DA-P (Residential-up to two units per acre with a development agreement-planned unit development). The 32,400-square foot site is located on the east side ofN. Palmer Lane approximately 2,700 feet north of State Highway 44, at 830 N. Palmer Lane. Pierce introduces the item. Lynn Moser, Eagle Sewer, reviews the application. Brian Gilbreath, ZGA Arcitects, W. Myrtle, Boise, displays pictures of the building. Aspitarte asks how loud the pumps will be. Lynn Moser states the pumps will be 40 feet down in the ground. There will be very little traffic to and from the Site. Felix asks about the 500 foot buffer area. Phil Johnson with MWH, displays a landscape plan for the application. Mike Williams, Planning Staff, reviews the staff report and ACHD comments for the application. CU-13-07 - Conditional Use Permit for a Heil!ht ExceDtion for Arts West Music Academv - Gardner-Ahlquist Develonment: Gardner-Ahlquist Development, represented by Pamela Hall with Timberline Surveying, PLLC, is requesting conditional use approval for a 43' -0" peak of roof, building height exception for the Arts West Music Academy. The height exception (the portion of the building above 35-feet) is for the purpose of accommodating the design and pitch of the roof with spires. The 3. 75-acre site is located approximately 600-feet north of State Highway 44 at 3415 West Flint Drive. Pierce introduces the item. Pamela Hall, Timberline Surveying, reviews the application. Aspitarte Dave Alvord, City Staff, reviews the staff report. Zastrow asks about the change in the elevation. Hired someone new and changed the architecture. Colonial Revival. Robert Pedersen, Eagle, reviews the application. Zastrow asks what flex space is. A mixture of office space and storage. Felix asks about access to the rear of the building. He also asks how many parking spaces there were going to be. Dave Alvord, City Staff, reviews the staff report. Makes some clarifications on questions asked by the Commission.
