CALL TO ORDER: Meeting called to order at 6:35 p.m. 2. ROLL CALL: Present: FELIX, ZASTROW, PIERCE, ASPITARTE, McCARREL 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Preliminarv Develonment Plan and Preliminarv Plat for Eal!:le Commons (AKA Bald Eal!:le Pointe) Planned Unit Develonment - Eal!:le Commons LLC: Eagle Commons LLC, represented by Van Elg with The Land Group, Inc., is requesting annexation and a rezone from RUT (Rural Urban Transition Ada County designation) to R-I-DA (Residential up to one unit per acre with a development agreement), conditional use permit, preliminary development plan, and preliminary plat approval for Eagle Commons (AKA Bald Eagle Pointe), a 55-lot (45-residential, 9-common, I-right of way) residential planned unit development. Partnership, represented by Michael Hormaechea, is requesting approval of an annexation of 372 acres and rezone from RUT (Rural Urban Transition-Ada County Designation) to MU-DA (Mixed Use with a development agreement) for 100 acres, R-4-DA (Residential up to 4 units per acre Maximum with a development agreement) for 140 acres, and R-2- DA (Residential up to 2 units per acre maximum with a development agreement) for 132 acres. The 372-acre site is located north of Floating Feather Road, south of Beacon Light Road, approximately 2,640 ft west of Lane Wood Street east and west of Palmer Lane. G. Findinl!:s of Fact and Conclusions of Law for A-IO-07 & RZ-12-07 - Annexation and Rezone from RUT to R-E-DA - Tim Johnson: Tim Johnson, represented by Clint Hansen, PLS, with Land Solutions, PC, is requesting approval of an annexation and rezone from RUT (Rural Urban Transition-Ada County Designation) to R-E-DA (Residential-Estates-one unit per two acres with a development agreement). The 3.98-acre site is generally located on the south side of Beacon Light Road approximately eight hundred feet (800') east of Ballantyne Lane at 165 I West Beacon Light Road. A-ll-07/RZ-ll-06 & PPIFP-OI-07 - Annexation and Rezone from RUT to A-R-DA and Combined Preliminarv Plat and Final Plat for Vil!:ne d' Al!:uila Subdivision - Al!:uila LLC: Aguila LLC, represented by Doug Russell with The Land Group, Inc., is requesting annexation and rezone with development agreement from RUT (Rural Urban Transition) to A-R-DA (Agricultural-Residential- up to one (1) unit per five (5) acres with a development agreement) and combined preliminary plat and final plat approval for Vigne d' Aquila Subdivision, a five (5)-lot residential subdivision. The 26.22 - acre site is generally located on the northeast comer ofN. Ballantyne Road and W. Beacon Light Road at 1964 W. Beacon Light Road. This item was continuedfrom the July 16,2007 meeting. Pierce introduces the item. Lloyd Mahaffey gives an overview of the project. Doug Russell, The Land Group, gives overview of the application and the site plan submitted to the Commission. Believes the project will be a catalyst for the newly established Eagle wine region. Stands for questions from the Commission. Mike Williams, City Planner, reviews the staff report. Stands for questions from the Commission. Pierce opens the public hearing. Jack Van Wyck, 2184 W. Valli Hi Road. Heard something about a proposed winery. Wants to know why this piece of property should be annexed to the City. Commissioner Pierce explains that the applicant came to the City with an application. Lloyd Mahaffey rebuts testimony and discusses the Site Specific Conditions within the staff report. Responds to the question regarding annexation and discusses the reasoning for it. Mike Williams rebuts testimony. Pierce closes the public hearing. Discussion amongst the Commission. Felix feels it is a good plan. Zastrow feels it is good to see something new come through. In favor of the project. Also likes the street design. McCarrel feels it is a neat concept. Aspitarte in favor of the project. Pierce feels excited about the projected. Aspitarte moves to recommend approval of A-ll-07/RZ-ll-06 & PPIFP-OI-07- Annexation and Rezone from RUT to A-R-DA and Combined Preliminary Plat and Final Plat for Vigne d' Aguila Subdivision - Aguila LLC with the following change, #2.6 under staff recommendations for the rezone - 2.6 reads the following: The developer shall ensure all existing structures (houses, garages, barns, etc.) shall be removed from the site lots #4 and #5 prior to issuance of a building permit. Demolition permits shall be obtained prior to removal of these said structures. Seconded by McCarrell. ALL A YES...MOTION CARRIES. B. CPA-07-07/RZ-13-07 & PP-13-07 - Comnrehensive Plan Text Amendment. Rezone from A-R and MU-DA to MU-DA. and Preliminarv Plat for Eal!:le Island Crossinl!: - Gardner Ahlquist Develonment: Gardner Ahlquist Development. represented by Pamela Hall with Timberline Surveying, PLLC, is requesting a text amendment to the 2007 Eagle Comprehensive Plan, Section 6.8.2, "Park Lane Planning Area" (b) Design, (2) Flint Estates Area, allowing for densities up to ten (10) units per acre in the mixed use area. The applicant is also requesting a rezone with development agreement from A-R (Agricultural-Residential- one (I) unit per five (5) acres) and MU-DA (Mixed Use with a development agreement) to MU-DA (Mixed Use with a development agreement), and preliminary plat approval for Eagle Island Crossing Subdivision, a 17-10t, 81-unit (27 multi-family [contained within I-lot), 13-commercial, and 3 common lots) development. The 20.97 acre site is located on the south side of Flint Drive approximately 875 feet east of Park Lane on Lots 3,5,6, and 8, Block 2, of the Amended Plat of Flint Estates, at 3605 Flint Drive, 3450 West State Street, 3415 Flint Drive, and 3300 West State Street. The +/- 3.03-acre site is generally located approximately 1,200 feet northeast of the Greenbrook Street and Horseshoe Bend Road intersection adjacent to Eagle/Ada Sport Complex. A-13-07/RZ-17-07 - Annexation and Rezone from RUT to PS-DA - City of Eal!:le & Idaho State Denartment of Parks and Recreation: The City of Eagle is requesting approval of an annexation and rezone from RUT (Rural Urban Transition-Ada County Designation) to PS (Public/Semi-Public) for the inclusion of Eagle Island State Park into the corporate limits of the City. The 545.86-acre site is generally located on the south side of State Highway 44 between the north and south channels of the Boise River, approximately twenty-seven hundred feet (2700') east of Linder Road along Hatchery Road. Pierce introduces the item. Mike Williams, City Planner, reviews the staff report. Pierce opens the public hearing. Robert Rippey, 1401 Trout Road. Would like to know why the City of Eagle wants to annex the park. Mike Williams rebuts testimony. Discusses the pre-annexation agreement. The Park will not have to follow the City rules. The City will be able to expand within the area of impact with the park being a path of annexation. Will link the pathway systems. Partnership with the state. Pierce closes the public hearing.
