ROLL CALL: Present: FELIX, ZASTROW, PIERCE, ASPIT ARTE. Absent: McCarrel. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Anderson is requesting conditional use approval to convert a 2,772-square foot, two story single family residence into an attached two- family dwelling (duplex). The O. CU-05-07 - Conditional Use Aooroval for a Lacrosse Plavinl!: Field - Jeff and Toni Smith: Jeff and Toni Smith, represented by Bryan Hallowell and Jeffrey King with CT A Architects/Engineers, are requesting conditional use approval for a 59,400-square foot lacrosse field and a 37,907-square foot (approximately) dirt parking area. The playing field and associated parking area is proposed solely for use by high school age lacrosse players as a practice facility. Rezone from A-R and MU-DA to MU-DA. and Preliminary Plat for Eal!:le Island Crossinl!: - Gardner Ahlquist Develooment: Gardner Ahlquist Development, represented by Pamela Hall with Timberline Surveying, PLLC, is requesting a text amendment to the 2007 Eagle Comprehensive Plan, Section 6.8.2, "Park Lane Planning Area" (b) Design, (2) Flint Estates Area, allowing for densities up to ten (10) units per acre in the mixed use area. The applicant is also requesting a rezone with development agreement from A-R (Agricultural-Residential- one (1) unit per five (5) acres) and MU-DA (Mixed Use with a development agreement) to MU-DA (Mixed Use with a development agreement), and preliminary plat approval for Eagle Island Crossing Subdivision, a 17-lot, 81-unit (27 multi-family [contained within I-lot], 13-commercial, and 3 common lots) development. A-03-07/RZ-03-07/CU-02-07/PPUD-03-07/PP-07-07 - Annexation and Rezone from RUT to R-I-DA and Conditional Use Permit and Preliminary Develooment Plan and Pleliminarv Plat for Eal!:le Commons (AKA Bald Eal!:le Pointe) Planned Unit Develooment - Eal!:le Commons LLC: Eagle Commons LLC, represented by Van Elg with The Land Group, Inc., is requesting annexation and a rezone from RUT (Rural Urban Transition Ada County designation) to R-I-DA (Residential up to one unit per acre with a development agreement), conditional use permit, preliminary development plan, and preliminary plat approval for Eagle Commons (AKA Bald Eagle Pointe), a 55-lot (45- residential, 9-common, I-right of way) residential planned unit development. The 49.5- acre site is located approximately 1,800-feet west of Linder Road on the south side of West State Street (State Highway 44) and north of the north channel of the Boise River. This item was continuedfrom the June 4,2007 meeting. Pierce introduces the item. Van Elg, with the Land Group, gives an overview of the application. Stands for questions from the Commission. Aspitarte asks about access and if any traffic analysis has been done. Pat Dobie did the traffic analysis. Van Elg has concerns about one conditions of approval which deals with setbacks. Front yard less than 30000 square feet be 20 feet. Dave Alvord, City Planner, reviews the staff report. Discusses access issues. There is possibility of pre-annexation agreement. City engineer feels there should a flood plain permit application. Zastrow asks if this will go through the DR process. A landscape plan will have to be submitted. General discussion on pre-annexation agreement. Nichoel Baird Spencer discusses the access management for the area. Pierce opens the Public Hearing. Teri Aaron, 5960 W. Catfield Lane. Has concerns with the traffic and effects of the habitat. They have 5 acre lots and have not been given information about the development. Feels the applicant should work with the homeowners. Denny Wagstaff, 5906 W. Half Moon Lane. Has concerns with the traffic. Has concerns with the zoning because they have 5 acre lots and they are proposing I acre lots. Not all lots have been built on yet. Richard, 364 S. Moon Beam Way. Discusses traffic issues. Has concerns about trespassers and the lakes. 276 S. Moon Beam Way. Lives west of the development. Does know development does need to take place. Feels the proposal is too dense. Expresses concerns about traffic. Daryl Swaggert, Moon Valley Ranch. Thought that these were going to be five acre lots. Van Elg rebuts testimony. Touches on fencing. Visual amenities. Discusses access issues. Felix asks about transitioning. Options - Van - topological constraints. Pierce closes the public hearing. Discussion amongst the Commission. Aspitarte - Block #5 - against fencing for wildlife. Not happy with option #2. Felix, the transition bothers him. The pond does help, traffic is ugly. Aspitarte moves to recommend approval of A-03-07/RZ-03-07/CU-02-07/PPUD-03- 07/PP-07-07 - Annexation and Rezone from RUT to R-I-DA and Conditional Use Permit and Preliminary Development Plan and Pleliminary Plat for Eagle Commons (AKA Bald Eagle Pointe) Planned Unit Development - Eagle Commons with the folioing changes: keep the 30000 the same and the 30 feet the same. Condition on block #3 that lots 4,5 and 6, which are 3 lots are combined into 2 . On block #5 that lots # 8 and 9 are combined and 10 and 11 are combined so that there will be two lot in that area. Partnership, represented by Michael Honnaechea, is requesting approval of an annexation of 372-acres and rezone from RUT (Rural Urban Transition-Ada County Designation) to MU-DA (Mixed Use with a development agreement) for 100-acres, R-4-DA (Residential up to 4 units per acre maximum with a development agreement) for 140-acres, and R-2-DA (Residential up to 2 units per acre maximum with a development agreement) for 132-acres. The 372-acre site is located north of Floating Feather Road, south of Beacon Light Road, approximately 2.640 feet west of Lanewood Street east and west of Palmer Lane. Would like public road access. Ryan Wilhite, has property immediately west of the Johnson's. Does not have a problem with the split. Does have concerns with access. Does not want to lose the agricultural zoning at this point. Tim Johnson, 1651 Beacon Light. Discusses access issues. Discusses Pony Hollow Subdivision and the road that was proposed at that time. Recommend the applicant and neighbors make an attempt to work out some kind of a solution to the access agreement prior to this going before the City Council or they will be faced with the same dilemma we are.
