CALL TO ORDER: Meeting called to order at 6:3] p.m.

CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
· Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Annexation and Rezone from RUT to R-E-DA and Prelimina Plat for Tran uil
Estates Subdivision - Garv and Janette Drew: Gary and Janette Drew, represented by
Angela Cornish, are requesting an annexation of27-acres, to rezone the property from
RUT (Rural Urban Transition - Ada County designation) to R-E-DA (Residential, one
unit per two acres with a Development Agreement) and preliminary plat approval for
Tranquil Estates Subdivision, a 3 lot, 7-acre subdivision (only a portion of the site is
proposed for development at this time). The 27- acre site is located on the southwest
intersection of North Ballantyne Lane and West Beacon Light Road at 2 j 4 I West Beacon
Light Road.

4. NEW BUSINESS:
A. V AC-04-07 - Vacation of ublic utili easement located on both sides of the lot line
common to Lots 27 and 29 Block 19 of Two Rivers Subdivision No.5 _ Joe Harris &
June Palmauist: Joe Harris & June Palmquist, represented by Wayne Barber of Briggs

Engineering, are requesting City approval of a vacation of a utility easement located on both
sides (for a total of fourteen feet (14 ')) of the lot line common to Lots 27 and 29, Block 19 of
Two Rivers Subdivision No.5, at 547 and 563 West Water Grove Drive.
Pierce introduces the item.
Aspitarte moves to recommend approval ofVAC-04-07 _ Vacation of public utility
easement located on both sides of the lot line common to Lots 27 and 29, Block 19 of
Two Rivers Subdivision No.5 - Joe Harris & June Palmquis. Seconded by McCarrel.
Aspitarte amends motion "with Staff recommendations." Second concurs. ALL
A YES...MOTlON CARRIES.
5. PUBLIC HEARINGS:
A. A-8-07 & RZ-I0-07 - Annexation and Rezone from RUT to MU-DA _ Hormaechea
LTD. Partnership: Hormaechea LTD. Partnership, represented by Michael Honnaechea, is
requesting approval of an annexation of3 72-acres and rezone from RUT (Rural Urban
Transition-Ada County Designation) to MU-DA (Mixed Use with a development agreement)
for 100-acres, R-4-DA (Residential up to 4 units per acre maximum with a development
agreement) for 140-acres, and R-2-DA (Residential up to 2 units per acre maximum with a
development agreement) for 132-acres. The 372-acre site is located north of Floating Feather
Road, south of Beacon Light Road, approximately 2,640 feet west of Lanewood Street east
and west of Palmer Lane. This item was continued from the June 11, 2007 meeting. The
applicant and staff are requesting this item he continued to the July 16,2007 meeting.
Pierce moves to continue A-8-07 & RZ-1O-07 - Annexation and Rezone from RUT to
MU-DA - Hormaechea LTD. Partnership to July 16. Seconded by Zastrow. ALL
AYES...MOTION CARRIES.
B. CU-08-07 - Conditional Use Permit to Convert a Two Sto Sin Ie Famil Residence
into an Attached Two-Familv Dwellinl!' - Garv P. Anderson: Gary P. Anderson is
requesting conditional use approval to convert a 2, 772-square foot, two story single f1unily
residence into an attached two-family dwelling (duplex). The 0.15-acre site is located on the
east side of South Harlan Place approximately 225-feet south of West State Street at 106
Harlan Place.
Pierce introduces the item.
Gary Anderson, the applicant, reviews the application.
Ted Venagas, City Staff, reviews the staff report.
Shane Chesnut, 274 Harlan Place, just purchased his parents house. Discusses rental occupancies
in this subdivision and CC&R's. Anderson's house is one of the best kept in the subdivision.
Gary Maddenford, feels this home was designed to be a duplex. Feels there would be less impact
on the community as a duplex. The City has set up standards for this type of use.
Cristy Watson, 9243 N. Hamlin Place, daughter of the applicant, in support of the application.
Mike Riles, 250 S. Harlan Street. Very quiet neighborhood. Some of the neighbors cannot see the
house. There is no one to maintain the covenants just the water board.
Gary Anderson rebuts testimony. Is not aware of any CC&R's.
Pierce closes the public hearing.
Zastrow moves to recommend approval. Seconded by Aspitarte. ALL AYES...MOTION
CARRIES.
