June 25, 2007
I. CALL TO ORDER: Meeting called to order at 6:05 p.m.
2. ROLL CALL: Present: Felix, Zastrow, Pierce, Aspitarte, McCarrel
4. UNFINISHED BUSINESS:
A. CPA-5-06/Z0A-3-06/A-14-06/RZ-19-06-M3 Eal!le - M3 Eal!le: M3 Eagle, represented by
Gerry Robbins, is requesting a Comprehensive Plan Map Amendment to include +/- 6,005-
acres into the Eagle Comprehensive Plan designating the following land use and zones: 40-
acres Residential Rural (up to I unit per 5-acres), 1,627-acres Residential Estates (up to I unit
per 2-acres), 470-acres Residential One (up to one unit per acre), 670-acres Residential Two
(up to two units per acre), I ,250-acres Residential Three (up to 3 units per acre), 670-acres
Residential Four (up to four units per acre), nO-acres Village Center, 88-acres Mixed Use,
with an annexation with Pre-Annexation Agreement, a rezone with a Development
Agreement, Zoning Ordinance Amendment to Eagle City Code Section 8. The 6,005-acre site
is generally located north of the Farmers Union Canal and Homer Road, east of State Highway
16 and west of Willow Creek Road more specifically described in the meets and bounds
description on file with the City of Eagle. This item was continued from the June 11,2007
meeting.
ORIGINAL
Pierce introduces the item.
Pierce explains that the public hearings have been closed and the Commission will be deliberating
on these items.
Zastrow discusses that M3 was one of the first applications they have heard. Some confusion on
the commercial center and where it is located. Expresses concerns on the transportation, keeping
habitat protected. Biggest concern is the transportation.
Aspitarte would like to reiterate what Zastrow says. Uncomfortable with the text amendment as it
reads right now. Would recommend to move the map forward.
McCarrel agrees with what has been said. Has concerns with the transportation and schools.
Felix feels the cart is in front of the horse. Discusses the infrastructure and that he is not
comfortable with it.
Pierce discusses there needs to be somehow a way to get these things to the City.
Zastrow discusses the amount of testimony that has been heard. Has not heard anyone in favor of
this beside landowners/developers or someone who works for one or the other. Discusses
transportation issues and infrastructure.
Pierce discusses density and planned communities.
McCarrel discusses the people who have come in to testifY. Feels there should be some
community meetings.
Pierce discusses the density ofM3. The City was asked by the community to look at the foothills.
Felix feels that one developer will have a better project as a whole. Feels there is still too much
density.
Aspitarte moves to recommend denial of the map amendment for CP A-5-06. We feel there
is too much density and that the foothills planning process is still too premature to approve
this comprehensive plan map amendment. There are also concerns with transportation and
the location of the community center. Seconded by Felix. ALL AYES...MOTION

B. CP A-8-06 - ComDrehensive Plan MaD Amendment to desil!nate +/- 2.000-acres of BLM
land as Public/Semi-Public - Citv of Eal!le: The City of Eagle is requesting a
Comprehensive Plan Amendment to establish a land use designation on the Comprehensive
Plan Land Use Map of Public/Semi-Public for the BLM property. The +/- 2,000-acre site is
located approximately Yt-mile east of State Highway 16 and directly north of the Farmers
Union Canal.
Pierce introduces the item.
Zastrow discusses how the land is being utilized now and if the City makes it into a regional park.
Would be in favor of approval. Consensus amongst the Commission.
McCarrel moves to recommend approval. Seconded by Zastrow. ALL A YES...MOTION
CARRIES.
Aspitarte moves to move item H to item C, C becomes D, D becomes E. Seconded by
McCarrel. ALL AYES...MOTION CARRIES.
C. (H.) CPA-6-07 - Citv of Eal!le: The City of Eagle is proposing a Comprehensive Plan
Amendment to achieve the following:
I) Adoption of the Eagle Foothills Sub-area Plan and associated text and maps;
2) Adoption of Brookside Sub-area Plan and associated text and maps;
3) Update appropriate sections of the existing plan to ensue consistency with the proposed
amendments.
Pierce introduces the item.
Aspitarte discusses the plan. Discusses the Ada County Plan. Discusses the density of an
application going through the county. Discusses that an Ada County Commissioner testified that
the county plan was better than the City's. Aspitarte discusses the differences between the two
plans. Ifwe have no plan, it defaults to the county.
McCarrel agrees with Aspitarte. Feels the City is not ready for a comprehensive plan of 49
thousand acres. Feels there needs to be work between Ada County and the City.
Felix is struck by the involvement of the public. Feels the majority of citizens feel the plan is on
track. Critical problem is with the density, including traffic, funding, schools. Would not support
a recommendation of approval with these densities. Believes they should be removed.
Zastrow agrees with Felix regarding the public involvement. This is a complex and difficult
process. Traffic, water, potential impact on tax base. Ability to pay for schools in the foothills.
Feels there would be an issue if this fell onto the county. Main thing is transportation and roads.
Feels there is not enough information. 6 months away from ACHD master road plan. No
information from lTD. Discusses existing infrastructure. Discusses the report on the water.
Bothered by the default process that puts this to the county. Would not be in favor of
recommending this for approval.
Pierce recognizes that this is a comprehensive plan amendment. The Commission would be able
to see applications that come into the area. Staff was asked by the citizens to look at this area.
There is a difference between 10 and 12,000 acres between the city and county plans. Discusses
what the city would gain. Wants this process to get done right. Have to have an incentive for
property owners to come to the city rather than the county.
Aspitarte asks if they could advance the plan if the densities were taken out. (page 75)
Zastrow asks if the county has adopted the plan. Nichoel Baird Spencer states the county plan has
gone through Ada County P&Z. Council needs to have the plan to be able to have dialogue with
the county about it.

Felix did not comment on the Ada County plan. Not sure it is relevant. Their role is to make a
recommendation to the Council. Feels there does need to be a plan but not until they're ready.
Discusses what the community feels about the densities. There was not input on the densities.
Feels to recommend approval to the Council without the density table. Feels it needs to go
forward.
Aspitarte asks about removing the table. Nichoel Baird Spencer discusses the tables and
residential densities, asks about removing the two tables and paragraph regarding densities.
Comments on 1.1. Discusses the tables.
4.3.4 - add Community Outreach for Safety and Cooperation.
4.4.4 E - continue employee training
4.6.3 - B - Protect water quality where feasible mandating using municipal wells.
4.6.4 - R - Develop public to develop.
4.9.2 - Electricity Goals - designate-
5.0 - Work with Idaho Power to encourage - including visual impacts.
4.9.3 - review IP implementation plan to ensure cooperation for future planning operations.
5.5 - J, L&N - should include the foothills planning area.
Discussion.
Strike under 6.3.20, strike the second paragraph.
6.8.11 - focus development to less visible or non-visible areas.
Page 75 - delete density table.
Page 76 - delete the bottom table.

6.8.12 - Add Rodeo Basin.
6.8.15 - Connolly - feels that would be premature at this time.
9.6.4 - Implementation strategies (141) encourage developers to identifY all wildlife migration
corridors to planned open space.
142 - Charles Bond letter - regarding natural open space.
Discussion amongst the Commission.
Aspitarte recommends for approval CP A-6-07 with the following changes: 4.3.4 E -
Community Outreach education for safety and cooperation. 4.4.4 E - continue employee
training and education classes to improve readiness. 4.6.3 - protect groundwater quality
where feasible mandating the use of municipal wells. 4.6.4 R - develop public education
programs to promote water conservation. 4.9.2 - under Bl - Electricity Goals - designate
the general location and visual impacts of existing and proposed electrical facilities. 4.9.2 1-
work with Idaho Power to encourage communication, cooperation on landscape design and
facility locations including visual impacts. 4.9.3 D - Review the Idaho Power long term
implementation plan to ensure cooperation in the future planning efforts. 5.5 J, L&N -
include the words foothills planning area. 41 - Discussion about percentages of business
parks versus industrial that business park/technical would be 3% and industrial would be
1 %. 43, 6.3.20, Foothills Residential, second paragraph would be stricken starting with the
residential densities should be calculated to be commiserate with existing land conditions.

table. Any density calculations be removed. 6.8.12 - Add Rodeo Basin to be included in the
Brookside sub-plan. 9.6.4, G -Encourage developers to identify all wildlife migration
corridors to planned open space. On 142, Natural open space habitat, natural open
recreation - to encourage the staff and Council to look at Charlie Vaughan's comments.
Restrict this plan to geographic boundaries of the planning area to Hwy 16 to 55 and gem
county to Beacon Light. Seconded by Felix. TWO AYES (Felix, Aspitarte). THREE
NAYS (Zastrow, Pierce, McCarrel)...MOTION FAILS.
Discussion amongst the Commission.
Zastrow feels there needs to be more studies on transportation. Does not think this amendment
possesses enough information.
Pierce feels it turned too generic.
Discussion amongst the Commission.
Zastrow moves to recommend for denial for reasons having been stated - inadequate
information regarding long term plans and transportation issues. Seconded by McCarrel.
TWO AYES (Zastrow, McCarrel). THREE NAYS (Pierce, Felix, Aspitarte )...MOTION
FAILS.
Discussion amongst the Commission.
Aspitarte moves to recommend approval as exactly the same as my previous motion.
Discussion. Zastrow would like to add a requirement adequate public facilities component
be included in the plan. Seconded by Felix. FOUR A YES (Felix, Zastrow, Pierce, Aspitarte)
ONE NAY (McCarrel)...MOTION CARRIES.
D. (C.) CPA-I0-06 - ComDrehensive Plan MaD Amendment to establish a Desil!nation of
Foothills Cluster and Foothills Conservation - Avimor. LLC: Avimor, LLC.,
represented by Robert Taunton, is requesting a Comprehensive Plan Map Text
Amendment to include +/- 23,320-acres into the Eagle Comprehensive Plan designating
the following land uses: +/- 7,1 OO-acres Foothills Cluster Development (not to exceed 2
units per acre) and +/- 16,220-acres Foothill Conservation Development (1 unit per 40-
acres). The +/- 23,320-acre site is generally located from Highway 55 on the east to
Willow Creek Road via Big Gulch on the west, the northern boundary is approximately
five (5) miles north of the Ada/Gem County line, the southern boundary abuts the
Connolly and Kastera properties more specifically described in the meets and bounds
description on file at the City of Eagle.
Pierce introduces the item.
Nichoel Baird Spencer displays a map of the area. Briefly explains the proposal. This will be
separate sub-area than the foothills plan.
Zastrow feels the Avimor plan is a little more palatable. They put more of the commercial
development closer to the corridor.
Felix feels the same. Feels the densities proposed is too much.
McCarrel does not feel comfortable with it.
Aspitarte feels the same.
Pierce feels we should have some guidance for this area.
Discussion amongst the Commission. Would recommend denial of this application.
Zastrow moves to recommend denial ofCPA-10-06 - Comprehensive Plan Map Amendment
to establish a Designation of Foothills Cluster and Foothills Conservation - Avimor, LLC
based on the same constraints that we talked about density, transportation. Seconded by

E. (D.) CPA-2-07 - ComDrehensive Plan MaD Amendment from Residential Three to Mixed
Use - Stahl ProDerties. LLC: Stahl Properties, LLC, represented by Hans Linton of Red
Rock Development group, LLC, is requesting a Comprehensive Plan Map Amendment to
designate a land use designation on the Comprehensive Plan Land Use Map from
Residential Three (three (3) units per acre) to Mixed Use. The 10.24-acre site is located on
the northwest comer of East Hill Road and North Echohawk Way more specifically
described in the meets and bounds description on file at the City of Eagle.
Pierce introduces the item.

Felix asks what staff had recommended. Staff recommended approval of this application.
Zastrow feels this was a favorable use for this property. Would be in favor of approval.
McCarrel, Aspitarte, Felix and Pierce concur.

Pierce moves to recommend approval with staff recommendations. Seconded by McCarrel.

F. (E.) CP A-3-07 - ComDrehensive Plan MaD Amendment from Residential Three to Mixed
Use - DEB ProDerties. LLP: DEB Properties, LLP, represented by Shawn L. Nickel of
SLN Planning, Inc., is requesting a Comprehensive Plan Map Amendment to establish a
land use designation on the Comprehensive Plan Land Use Map from Residential Three
(three (3) units per acre) to Mixed Use. The one (1 )-acre site is located approximately
eight hundred feet (800') west of Highway 55 more specifically described in the meets and
bounds description on file with City of Eagle.
Pierce introduces the item.
Planner Baird Spencer displays a map and gives brief overview of the application. Staff
recommended for professional office.
Felix feels this is a very small parcel with limited possibilities.

Felix moves to recommend approval with staff recommendations. Seconded by Aspitarte.

G. (F.) CPA-4-07 - ComDrehensive Plan MaD Amendment from Residential Two to Mixed
Use - Elov ChaDarro. Jr: Eloy Chaparro Jr., represented by Shawn L. Nickel ofSLN
Planning, Inc., is requesting a Comprehensive Plan Map Amendment to establish a land
use designation on the Comprehensive Plan Land Use Map from Residential Two (two (2)
units per acre) to Mixed Use. The 1.97-acre parcel is located approximately y" mile north
of Chinden Blvd. Specifically described in the meets and bounds description on file with
City of Eagle.
Pierce introduces the item.
Planner Baird Spencer displays a map and gives brief overview of the application. Staff
recommended for professional office.
McCarrel asks if there is an access issue for this application.
Planner Baird Spencer explains that there is an access issue but this is a comprehensive plan

application. This issued would be dealt with through a development agreement.
Discussion amongst the Commission. Would recommend approval with staff recommendations.

H. (G.) CPA-5-07 - Comorehensive Plan MaD Amendment from Residential Estate to
Residential One - Mark Beckman: Mark Beckman, represented by Chris Todd of Landmark
Engineering and Planning, Inc., is requesting a Comprehensive Plan Map Amendment to
establish a land use designation on the Comprehensive Plan Land Use Map from Residential
Estate (one (1) unit per two (2) acres) to Residential One (one (I) unit per acre). The 27.74-
acre site is located on the northeast corner of Meridian Road and Floating Feather Road more
specifically described in the meets and bounds description on file at the City of Eagle.
Pierce introduces the item.
Planner Baird Spencer displays a map and gives brief overview of the application. Staff is
recommending denial at this time.
McCarrel would go with staff recommendation. All Commissioners in concurrence.
McCarrel moves to recommend denial because it is incompatible with surrounding uses.
Seconded by Aspitarte. ALL AYES...MOTION CARRIES.
