I. CALL TO ORDER: Meeting called to order at 6:36 p.m.
2. ROLL CALL: Present: ZASTROW, PIERCE, ASPITARTE, McCARREL. Absent: FELiX.
A quorum is present.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence detennined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Findinl!s of Fact and Conclusions of Law for CU-04-07 - Conditional Use Aooroval
for Seven Mobile Offices (Portable Classrooms) for ArtsWest Fine Arts School-
Ken and Mary Cenell: ArtsWest Fine Arts School, represented by Ken and Mary
Cenell, is requesting conditional use approval to install six portable classrooms and one
portable bathroom unit totaling 4,400 square feet. The 6.08-acre site is located on the
south side of Flint Drive approximately I ,500-feet east of Park Lane at 3415 Flint Drive.
B. Findinl!s of Fact and Conclusions of Law for A-05-07/RZ-06-07 & PP-08-07 -
Annexation and Rezone from RUT to R-2-DA and Preliminary Plat for Lockev
Subdivision - Lakeside Develooment Grouo. LLC: Lakeside Development Group,
LLC, represented by Jake Merrill, is requesting approval of an annexation and rezone
from RUT (Rural-Urban Transition-Ada County designation) to R-2-DA (Residential up
to two units per acre maximum with a development agreement), and preliminary plat
approval for Lockey Subdivision, a 36-10t (33-buildable, 3-common) residential
development. The 20.47-acre site is located on the south side of W. Beacon Light Road
approximately 650-feet east of Park Lane at 3633 W. Beacon Light Road.
C. Findinl!s of Fact and Conclusions of Law for A-OI-07/RZ-OI-07 & PP-OI-07-
Annexation and Rezone from RUT to R-2-DA and Preliminary Plat for Dwavne
Linl!el Subdivision (aka Adonai Subdivision) - Dwavne Linl!el: Dwayne Lingel is
requesting annexation and rezone from RUT (Rural Urban Transition-Ada County
designation) to R-2-DA (Residential, up to two units per acre with development
agreement) and preliminary plat approval for Adonai Subdivision. The proposed 5.70
acre residential subdivision will consist of 12 lots (8-buildable, 4-common). The site is
located on the east side of Park Lane Road approximately 1 ,200-feet south of Beacon
Light Road at 2440 North Park Lane.
D. Findinl!s of Fact and Conclusions of Law for A-06-07/RZ-08-07 & PP-IO-07-
Annexation and Rezone from RUT to R-2-DA and Preliminary Plat for Tabasco
Trail Estates Subdivision - TNT Holdinl! and Lvnn Proctor: TNT Holding and Lynn
Proctor, represented by Trent Simpson, Todd Wilson and Lynn Proctor are requesting
annexation and rezone from RUT (Rural Urban Transition Ada County designation) to R-
2-DA (Residential up to I. I units per acre maximum with a development agreement), and
preliminary plat approval for Tabasco Trail Estates Subdivision. The 11.80-acre
subdivision will consist of 14-lots (II-new residential, 2-existing, I-common). The site is
located on the east side of Park Lane approximately 'I.-mile south of Beacon Light Road
at 3664 & 3665 Tabasco Trail Lane.

4. PUBLIC HEARINGS:
A. CU-05-07 - Conditional Use Aooroval for a Lacrosse Plavinl! Field - Jeff and Toni
Smith: Jeff and Toni Smith, represented by Bryan Hallowell and Jeffrey King with CT A
Architects/Engineers, are requesting conditional use approval for a 59,400-square foot
lacrosse field and a 37,907-square foot (approximately) dirt parking area. The playing field
and associated parking area is proposed solely for use by high school age lacrosse players as
a practice facility. The 4.8-acre site is located \1. mile south of Floating Feather Road on the
east side of North Ballantyne Lane at 842 North Ballantyne Lane. This item was continued
from the May 21, 2007 meeting. The applicant is requesting this item be continued to the
July 16, 2007 meeting.
Pierce moves to continue CU-05-07 - Conditional Use Approval for a Lacrosse Playing
Field to the July 16,2007 meeting. Seconded by McCarrel. ALL AYES...MOTION
CARRIES.
B. A_03_07/RZ_03_07/CU_02_07/PPUD-03-07 - Annexation and Rezone from RUT to R-l-
DA and Preliminary Plat for Eal!le Commons Subdivision. (AKA Bald Eal!le Pointe):
Eagle Commons LLC, represented by The Land Group, LLC is requesting approval of an
annexation and a rezone from RUT (Rural Urban Transition - Ada County designation) to R-
I _ DA (Residential-One with a development agreement) for Eagle Commons (aka Bald
Eagle Pointe), a 45-unit residential housing development. The 49.48-acre site is located west
of Linder Road, south of State Street (Highway 44) and north of the South Channel Boise
River in the SI/2 Section II and N 'h Section 14, T4N, RI W. This item was continuedfrom
the May 21, 2007 meeting. Staffis requesting this item be continued to the June 18,2007
meeting.
Pierce moves to continue A-03-07/RZ-03-07/CU-02-07/PPUD-03-07 - Annexation and
Rezone from RUT to R-I-DA and Preliminary Plat for Eagle Commons Subdivision to the
June 18,2007 meeting. Seconded by McCarrel. ALL A YES...MOTION CARRIES.
C. CU-07-07 - Conditional Use Aooroval for Eal!le Emerl!encv Service Facility for the
Eal!le Fire Deoartment - Fire Protection District: Fire Protection District, represented by
Aaron Randell with JGT Architecture, is requesting conditional use approval to construct a
5,730-square foot emergency service facility. The 0.63 I-acre site is located on the southeast
corner of North Linder Road and West Clearfield Drive within Copperfield Subdivision at
1225 North Cactus Creek Avenue (Lots I and 2, Block 2, Copperfield Subdivision).
Chairman Pierce introduces the item.
Aaron Randall of JGT Architecture, 1212 12'11 Avenue S. Nampa, reviews the application. Stands
for questions from the Commission.
Ted Vanegas, City Planner, gives an overview of the staff report. Stands for questions from the
Commission.
Pierce opens public hearing.
Deborah Pruett, 4440 Briar Rock Court, states that she is in support of the proposed plan. She has
been told it will not lower property value for surrounding homes. She will feel much more
comfortable with assistance being located that close and she also feels the appearance is pleasing.
John Peterson, 741 N. Cactus Creek, feels that the proposed plan is not compatible to other
buildings in the area and it needs to be located in a commercial area. He is bothered with
possibility of noise issues and that it will decrease the standard of living for the neighborhood.
Discussion regarding exact location of residence.

Chairman Pierce asks for any other questions. No one chooses to speak.
Dan Friend, Fire Chief, 92 S. Eagle Road, discusses the lots, Fire Department response time, and
station as a haven for children after schoo\.
Discussion regarding Fire Department response time and other road safety concerns between
Commissioners and Fire Chief Friend.
Greg Tullson- 1212 121h Ave South. Nampa, Architect on the design team explains how they tried
to keep their focus with warm tones and rock, making it more comfortable with existing homes in
area. Also explains when alarm is going off on interior, exterior does not become brighter and at
night the lighting is not drastic.
Mark Rabdau- 771 Ranch Drive- Works for fire department and is in support. He explains how a
Fire crew is more like a family of four with a daily schedule; arrive in the morning, shift change
in the evening. The sirens are to be used when approaching the Linder State Hwy 44 intersection.
There will not be flashing bright lights on the exterior of the building, just internal sounds. He
discusses how the trucks have really been upgraded, no louder than a Cummin's Deisel and the
exhaust systems have been through all emission tests. They will be good neighbors.
Scott Pruett, 4440 Briar Rock Court, shares how he is in favor. He appreciates the public and
community service. It will offer convenience, safety, and peace of mind. As far as others having
worries about noise: the noise from the traffic of Linder will be far worse than the new station.
Also, when driving in the school zone, the crew is required to follow traffic rules and will do so.
The sirens will be used when necessary- not recklessly. He then used a comparison to give an
idea of the call value for a year for those concerned about traffic increasing. A high call volume
would be 700 calls a year. This breaks down to less than 2 calls a day. This is not a big issue and
that is using a very high number estimate.

Discussion amongst the Commission. Commissioner Zastrow comments on the great job JGT
Architecture did making it look nice for the residential area. Also he feels the Fire Department
presents a great case for being good neighbors. Commissioner McCarrel states that as a School
Principal he can't think of anything better. He also gives a compliment to those who are in
opposition to this and thanks them for their letters. Commissioner Aspitarte states he is also in
favor. He feels the architecture is great and that all issues have been covered with noise,
emissions and lighting.
McCarrel moves to approve CU-07-07 - Conditional Use Approval for Eagle Emergency
Service Facility for the Eagle Fire Department - Fire Protection District. Seconded by
Aspitarte. ALL AYES.....MOTION CARRIES
D. PP-07-07 - Preliminary Plat for Brutsman Subdivision - Donna Weston: Donna Weston,
represented by Craig McCullough with Doumecq Development, is requesting preliminary
plat approval for Brutsman Subdivision. The 4.86-acre, 17 lot (13 residential, 4 common)
subdivision is located approximately I ,200-feet south of Floating Feather Road and on the
west side of Horseshoe Bend Road at 10895 Horseshoe Bend Road.
Pierce introduces the item.
Craig McCullough- 847 Park Center Way, Nampa, of Doumecq Development, gives an overview
of the application. Stands for questions from the Commission.
Discussion regarding irrigation concerns between Commissioners and Mr. McCullough.
Ted Vanegas, City Planner, reviews the staff report and stands for questions from the
Commission.

Pierce opens public hearing.
Robert Scarett, 3052 East Shadow View Street, Eagle has questions pertaining to the entrance
being shared between construction and residence. Also wants to know of any plans for the
existing fence; he feels it needs to look better. Also, he feels the walkway is a great idea along
with the thought of using the existing well for a water source.

General Discussion.
Aspitarte moves to recommend approval of PP-07-07 - Preliminary Plat for Brutsman
Subdivision with the following conditions #28; that any non-potable connections to the
potable water system should comply with the Department of Environmental Quality
requirements such as any back flow prevention devices, etc. Add new site specific Condition
#29, if feasible construction traffic should be routed directly off of Horseshoe Bend Road, to
the east of the development, through the cul-de-sac and, at the end of build out the access
should be closed. Seconded by McCarrel. All AYES...MOTION CARRIES.
