I. CALL TO ORDER: Meeting called to order at 5:36 p.m.
2. ROLL CALL: Present: FELIX, ZASTROW, PIERCE, ASPIT ARTE, MCCARREL, MY AC

3. CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
· Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
4. UNFINISHED BUSINESS:
A. CPA-5-06/Z0A-3-06/A-14-06!RZ-19_06_M3 Eal!Ie - M3 Eal!le: M3 Eagle, represented by
Gerry Robbins, is requesting a Comprehensive Plan Map Amendment to include +/_ 6,005-
acres into the Eagle Comprehensive Plan designating the following land use and zones: 40-
acres Residential Rural (up to I unit per 5-acres), 1,627-acres Residential Estates (up to I unit
per 2-acres), 470-acres Residential One (up to one unit per acre), 670-acres Residential Two
(up to two units per acre), 1,250-acres Residential Three (up to 3 units per acre), 670-acres
Residential Four (up to four units per acre), 770-acres Village Center, 88-acres Mixed Use,
with an annexation with Pre-Annexation Agreement, a rezone with a Development
Agreement, Zoning Ordinance Amendment to Eagle City Code Section 8. The 6,005-acre site
is generally located north of the Farmers Union Canal and Homer Road, east of State Highway
16 and west of Willow Creek Road more specifically described in the meets and bounds
description on file with the City of Eagle.

A. CP A-8-06 - Comprehensive Plan Map Amendment to desil!nate +/_ 2.000-acres of BLM
land as Public/Semi-Public - Citv of Eal!le: The City of Eagle is requesting a
Comprehensive Plan Amendment to establish a land use designation on the Comprehensive
Plan Land Use Map of Public/Semi-Public for the BLM property. The +/_ 2,000-acre site is
located approximately \I.,-mile east of State Highway 16 and directly north of the Farmers
Union Canal.
Pierce introduces the item.
Pierce moves to continue CP A-8-06 - Comprehensive Plan Map Amendment to designate +/_
2,000-acres of BLM land as Public/Semi-Public to the May 17, 2007 meeting. Seconded by Felix.

B. CPA-I0-06 - Comprehensive Plan Map Amendment to establish a Desil!nation of
Foothills Cluster and Foothills Conservation - Avimor. LLC: Avimor, LLC.,
represented by Robert Taunton, is requesting a Comprehensive Plan Map Text Amendment
to include +/- 23,320-acres into the Eagle Comprehensive Plan designating the following
land uses: +/- 7, 100-acres Foothills Cluster Development (not to exceed 2 units per acre)
and +/- 16,220-acres Foothill Conservation Development (\ unit per 40-acres). The +/_
23,320-acre site is generally located from Highway 55 on the east to Willow Creek Road via

Big Gulch on the west, the northern boundary is approximately five (5) miles north of the
Ada/Gem County line, the southern boundary abuts the Connolly and Kastera properties
more specifically described in the meets and bounds description on file at the City of Eagle.

C. CPA-6-07 - City of Eal!le: The City of Eagle is proposing a Comprehensive Plan
Amendment to achieve the following:
]) Adoption of the Eagle Foothills Sub-area Plan and associated text and maps;
2) Adoption of Brookside Sub-area Plan and associated text and maps;
3) Update appropriate sections of the existing plan to ensue consistency with the proposed
amendments.

D. CPA-2-07 - ComDrehensive Plan MaD Amendment from Residential Three to Mixed
Use - Stahl Properties, LLC: Stahl Properties, LLC, represented by Hans Linton of Red
Rock Development group, LLC, is requesting a Comprehensive Plan Map Amendment to
designate a land use designation on the Comprehensive Plan Land Use Map from
Residential Three (three (3) units per acre) to Mixed Use. The I 0.24-acre site is located on
the northwest corner of East Hill Road and North Echohawk Way more specifically
described in the meets and bounds description on file at the City of Eagle.

Brent Coles, reviews the application. Requests the Commission to move this application
forward.
Sherry McKibben, 515 W. Hays, Boise. Displays concept plan and discusses the application.

E. CP A-3-07 - Comprehensive Plan Map Amendment from Residential Three to Mixed
Use - DEB Properties, LLP: DEB Properties, LLP, represented by Shawn L. Nickel of
SLN Planning, Inc., is requesting a Comprehensive Plan Map Amendment to establish a
land use designation on the Comprehensive Plan Land Use Map from Residential Three
(three (3) units per acre) to Mixed Use. The one (I )-acre site is located approximately eight
hundred feet (800') west of Highway 55 more specifically described in the meets and
bounds description on file with City of Eagle.

Use - Elov Chaparro. Jr: EJoy Chaparro Jr., represented by Shawn L. Nickel of SLN
Planning, Inc., is requesting a Comprehensive Plan Map Amendment to establish a land use
designation on the Comprehensive Plan Land Use Map from Residential Two (two (2) units
per acre) to Mixed Use. The 1.97-acre parcel is located approximately Y. mile north of
Chinden Blvd. Specifically described in the meets and bounds description on file with City
of Eagle.

G. CPA-5-07 - Comprehensive Plan Map Amendment from Residential Estate to
Residential One - Mark Beckman: Mark Beckman, represented by Chris Todd of Landmark
Engineering and Planning, Inc., is requesting a Comprehensive Plan Map Amendment to
establish a land use designation on the Comprehensive Plan Land Use Map from Residential
Estate (one (1) unit per two (2) acres) to Residential One (one (I) unit per acre). The 27.74-
acre site is located on the northeast corner of Meridian Road and Floating Feather Road more
specifically described in the meets and bounds description on file at the City of Eagle.
Chris Todd, Landmark Engineering, gives overview of the application. Stands for questions from

Nichoel Baird Spencer, City Planner, reviews the staff report. Stands for questions from the
Commission.

Sondra McDavid, Canterbury Estates, opposes the application. Discusses the higher density in the
area. Would like to see 2 acres and above lots in this area.

Jeff Schroeder, 1140 N. Meridian Road, have lived there since 1976. Discusses irrigation water
and the water users used to share. Cannot split his property through the current comprehensive
plan.
Ken Freitag, 2924 W. Floating Feather. Discusses water in the area and the surrounding
properties in the area.
Mark Beckman, W. Floating Feather. Has been researching doing something with his property for
quite a while. Jeff Gilbertson, the neighbor to the west, has been difficult to get a hold of. Only
lives at the residence part time. To continue using this agricultural is not economically feasible for
him. Stands for questions from the Commission.
Commissioner Pierce reads a letter from Mr. Gilbertson.
Terry Harris, 1628 N. Meridian Road. Comments on the letter that Mr. Gilbertson submitted.
Discusses surrounding growth in the area. Discusses that there are two existing one acre parcels in
this area. Discusses accesses for the location. Stands for questions from the Commission.
Chris Todd rebuts testimony.
Pierce closes the public hearing.
Discussion amongst the Commission.
McCarrel moves to table this item to the May 17,2007 meeting. Seconded by Aspitarte.

Due to the size and complexity of the above referenced application staff requests that the
Planning and Zoning Commission table the above referenced applications the special hearing on
May 17, 2007 to begin at 6:00pm.
Under Idaho Code 67-6509(d) the commission can only make recommendations to the Future
Land Use map of the City's Comprehensive Plan once every six months. With this limitation in
mind staff requests that the commission open the hearing, take testimony and close the hearing
on the remaining Comprehensive Plan Amendments on the May 14' 2007 and then table final
action to the date determined for the Foothills applications. Once the hearings have been held for
the Foothills applications (CPA-5-06, CPA-8-06, CPA-10-06, and CPA-6-07) the commission
will then take action on all the map amendments at that or a future meeting.

Below is a brief overview of the policies being established by the Eagle Foothills Plan as
proposed. Due to the size and detail of this application staff will be prepared to provide a
complete verbal overview at the hearing.
I Land Use — Change to potential units, miscalculation of slopes, removal of Rural
Residential area (north of Beacon Light)— now calculated at 1/5. (See attached
Table.)
Planned Communities- There has been significant discussion about the County plan and
the inclusion of planned communities into the base densities. The most recent
draft from the county establishes a density between Hwy 55 and Hwy 16 to the
County line of approximately 11,000 on 32,000 acres or 1 unit/ 3.5 acres. The
plan does not provide direction as to the location of higher density areas or for
the overall open space design within the foothills.
II. Habitat/Open Space — Minimum of 40% gross area of the foothills. Priority for 40%
open space is to come from habitat, slopes, floodway. If constrained areas do not
consume 40% of site. The open space overlay to provide direction to massing &
connectivity within the larger regional frame work.
Funding -Plan requires that developer help fund the long-term maintenance of the open
space.
