I. CALL TO ORDER: Meeting called to order at 6:33.
2. ROLL CALL: Present: FELIX, ZASTROW, ASPITARTE, McCARREL. Absent: Pierce.
3. CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
· Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Mountain Estates Subdivision - Red Rock Develonment: Red Rock Development,
LLC, represented by Bryan D. Martin, P.E., with Toothman-Orton Engineering Co., is
requesting preliminary plat approval for Aguila Mountain Estates a 31-lot (24 buildable, 7
common) residential subdivision. The I 0.24-acre site is located at the northwest corner of
the intersection of East Hill Road and North Echohawk Way, approximately 420-feet west
of State Highway 55.

Walter Lindgren with Johnson Architects and Morton McMillen, P.E., with McMillen
Engineering, LLC, is requesting approval of an annexation and rezone from RUT (Rural
Urban Transition) to MU-DA (Mixed Use with a Development Agreement in lieu of a
PUD) and preliminary plat for Eagle Gateway South, a mixed use commercial and
residential development. The 56.86-acre, 98-lot subdivision, ] I 4-unit (7 I-single-family,
42-multi-family (contained with in 5-lots), 16-commercial, and 6-common) is located on
the southeast corner of State Highway 44 and E. Riverside Drive at ] 650 E. Riverside
Drive.

common). The site is located at 3633 W. Beacon Light Road approximately 650' east of
Park Lane, on the south side of W. Beacon Light Road. Staff is requesting this item he
continued to the May 21, 2007 meeting.

Proctor: TNT Holding and Lynn Proctor, represented by Trent Simpson, Todd Wilson
and Lynn Proctor are requesting annexation of II.80-acres and rezone from RUT (Rural
Urban Transition) to R-2-DA (Residential up to two (2) units per acre with a development
agreement), and a preliminary plat approval for Tabasco Trail Estates Subdivision. The
] 1.80-acre subdivision will consist of 14 lots (II new residential, 2 existing, I common
open space).

C. CU-04-07 - Conditional Use Annroval for Seven Mobile Offices (Portable
Classrooms for ArtsWest Fine Arts School- Ken and Ma Cenell: ArtWest Fine
Arts School represented by Ken and Mary Cenell is requesting conditional use approval to
install six portable classrooms and one portable bathroom unit totaling 4,400 square feet.
The 6.08-acre site is located on the south side of Flint Drive approximately I ,500-feet east
of Park Lane at 34] 5 Flint Drive. Staffis requesting this item he continued to the May
21, 2007 meeting.
Zastrow moves to continue CU-04-07 - Conditional Use Approval for Seven Mobile

Dwavne Lin!!:el: Dwayne Lingel is requesting annexation and a rezone with a
development agreement from RUT (Rural Urban Transition - Ada County designation) to
R-2-DA (Residential up to two units per acre with development agreement) and
preliminary plat approval for Dwayne LingeJ Subdivision (aka Adonai Subdivision), a
twelve lot (8 - buildable, 4 - common) residential subdivision. The 5.70 acre site is
located on the east side of Park Lane Road approximately 1,200 feet south of Beacon
Light Road at 2440 North Park Lane.

E. CU-05-07 - Condition Use Annroval for a Lacrosse Plavin!!: Field _ Jeff and Toni
Smith: Jeff and Toni Smith, represented by Bryan Hallowell and Jeffrey King with CT A
Architects/ Engineers, are requesting conditional use approval for a 59,400-square foot
lacrosse field and a 37,907-square foot (approximately) dirt parking area. The playing
field and associated parking area is proposed solely for use by high school age lacrosse
players as a practice facility. The 4.8-acre site is located Y. mile south of Floating Feather
Road on the east side of North Ballantyne Lane at 842 North Ballantyne Lane. The
applicant is requesting this item he continued to the May 21, 2007 meeting.

by Daren Fluke of J-U-B Engineers, is requesting City approval of a vacation to the final
plat of Merrill Subdivision No.2 to remove the portion of the plat note providing for a
utility/access easement on portions of Lot 2 and Lots 3 & 4, Block 4. The site is located 35
feet east of East Plaza Drive on the south side of East State Street at 1119 East Plaza
Drive.

B. 2006000265-S/ZC/PUDillA - Lanewood Estates Planned Unit Develonment-
Lanewood Investments. LLC (Ada Countv Annlication): Lanewood Investments,
LLC, represented by David Y orgason with Capital Development, Inc., is requesting a
rezone with a development agreement from Rural Urban Transitional (RUT-Ada County
designation) to Low Density Residential (R2-Ada County designation), planned unit
development, and preliminary plat subdivision approvals for Lanewood Estates, a 426-lot
(381-buildable, 45-common) planned residential development. The 190.52-acre site is
bordered on the south of W. Floating Feather Road, on the west by N. Lanewood Road, on
the east by N. Linder Road, and on the north by N. Beacon Light Road and is located at
2810 Lanewood Road. This site is located in the Eagle Area of Impact.

adoption of the new PUD ordinance and water issues.

Aspitarte moves to recommend for denial of 2006000265-S/ZC/PUDillA _ Lanewood
Estates Planned Unit Development - Lanewood Investments, LLC based on its failure to
meet either the existing or proposed PUD with the recommendation that the applicant
can meet those requirements that they are given the flexibility tying into the Bella Terra
water supply. The City of Eagle does not have concrete water rights at the time of the
application. Seconded by Zastrow. Discussion. THREE A YES ONE NAY (McCarrel).

facilitate the construction of a self storage facility. The 2.00-acre site is located on the
south side of E. Hill Road approximately 560' feet east of State Highway 55 at 2871 E.
Hill Road.

Commission pictures of her property. Discusses a fence along the property line. Claims the
applicant tore her fence down.

Zastrow moves to continue RZ-05-07 to June 18 meeting _ and ask that the developer,
Jeffry MowerlMike Fairchild be here long enough to answer to the problems that were
brought up at tonight's meeting regarding the adjacent fence. . Discussion. And that
the public meeting be kept open with regard to the fence and that Mike Echeita be at
that meeting as well to give some explanation on the City's behalf. Seconded by
McCarrel. ALL A YES...MOTlON CARRIES.
