Findings of Fact and Conclusions of Law for CU-12-06 - Building Expansion and Height Exception for United Methodist Church - United Methodist Church: United Methodist Church, represented by Bruce Poe with Cole and Poe Architects, is requesting conditional use approval for a 23,500 square foot building expansion and building height exception of 49 feet-4 inches for the Eagle United Methodist Church. The 4.63-acre site is located on the west side of Eagle Road approximately ½-mile north of the State Street at 651 North Eagle Road. Staff is requesting this item be continued to the May 21, 2007 meeting. This site is located approximately 4,000 feet north of Beacon Light Road just north of Beacon Light Estates No. 2, near the northern terminus of Holl Road. This site is located in the Eagle Area of Impact. Pierce introduces the item. David Alvord, City Planner, reviews the staff report. Penelope Riley asks the Commission hear this item after Chester Place (AKA Catalpa) so she can familiarize herself with the staff report. Pierce moves to move this to item 5G. Seconded by McCarrel. ALL AYES…MOTION CARRIES. 5. PUBLIC HEARINGS: A. PP-05-07 – Preliminary Plat for Chester Place (AKA Catalpa) Subdivision - West Wind Investments: West Wind Investments, LLC, represented by Penelope L. Riley with Treasure Valley Engineers, is requesting approval of a preliminary plat for Chester Place (AKA Catalpa) Subdivision, a 12-lot (9 residential, 3 common) residential subdivision. The 17.90-acre site is located on the east side of North Meridian Road between Beacon Light and Floating Feather Road at 2650 North Meridian Road. This item was continued from the April 2, 200 7 meeting. Pierce introduces the item. Penelope Riley, Treasure Valley Engineers, reviews the application. Aspitarte moves to recommend for approval PP-05-07 – Preliminary Plat for Chester Place (AKA Catalpa) Subdivision with the following changes: Site Specific Condition #6 is stricken. Site Condition #13 it reads as follows: The driveway access to the barn at 2650 N. Meridian Road shall be abandoned. Site Specific Condition #17 stays the same. Site Specific Condition #5 and 7 are also stricken. The applicant will work with staff on Site Specific Condition #3 to rectify inconsistencies with the City Engineer’s letter dated March 29, 2007 and to be consistent with our recommendations. Add Site Specific Condition #25 – an easement to the pump house located at the southeast corner and a revised plat reflecting that. Seconded by Felix. Discussion. Aspitarte moves to recommend for approval of PP-02-07 - Preliminary Plat for Aguila Mountain Estates Subdivision – Red Rock Development with the following conditions: Site Specific Condition #13 – The applicant shall submit a Design Review application with trees, landscape, berming, proposed signage, fence, sending in plan details with the required buffer along Hill Road abutting the site for review and approval by Design Review prior to submittal of the final plat application. B erming will be a minimum of 8 feet on lots 20 through 27 and lot #22. Site Specific Condition #19 – add that the CCR’s will specifically address the noise impacts for the lots on the east side of the development resulting from Highway 55, which those lots are 20-27, in particular. The 56.86-acre, 98-lot subdivision, 114-unit (71-single-family, 42-multi-family (contained within 5-lots), 16-commercial, and 6-common) is located on the southeast corner of State Highway 44 and E.
