CALL TO ORDER: Meeting called to order at 5:39 p.m. 2. ROLL CALL: Present: Felix, Zastrow, Pierce, Aspitarte, McCarrel 3. PUBLIC HEARINGS: A. CPA-5-06/Z0A-3-06/A-14-06/RZ-19-06 - M3 Eal!:le - M3 Eal!:le. LLC.: M3 Eagle LLC, represented by Gerry Robbins of The M3 Companies, is requesting a Comprehensive Plan Map Amendment to include +/- 6,005 acres into the Eagle Comprehensive Plan designating the following land uses: +/- 40 Acres Rural Residential, +/- 1,627 acres Residential Estates, +/- 470 acres Residential One, +/- 670 acres Residential Two, +/- 1,250 acres Residential Three, +/- 670 acres Residential Four, +/- 770 acres Village Center, +/- 88 acres Mixed Use; +/- 100 Acres Commercial, an Annexation and rezone with a Pre-Annexation and Development Agreement for +/- 40 acres AR-DA (up to I unit per 5 acres with a development agreement), +/- 1,627 acres RE-DA (up to I unit per 2 acres with a development agreement), +/- 470 acres RI-DA (up to one unit per acre with a development agreement), +/- 670 acres R2-DA (up to two units per acre with a development agreement), +/- 1,250 acres R3-DA (up to 3 units per acre with a development agreement), +/- 670 acres R4-DA (up to four units per acre with a development agreement), +/- 770 acres Village Center-DA, +/- 88 acres MU- DA(Mixed Use with a development agreement) to allow for a maximum of +/- 12,0 I 0 residential units, a Zoning Ordinance Amendment to amend Eagle City Code Section 8-6 "Planned Unit Developments" to allow for the M3-PUD. The +/- 6,005 acre site is generally located north of the Farmers Union Canal and Homer Road, east of State Highway 16 and west of Willow Creek Road. Specifically described in the meets and bounds description on file at the City of Eagle. This item was continued/rom the February 12,2007 special meeting. ORIGINAL Pierce introduces the item. Nichoel Baird Spencer, City Planner, gives overview of updated staff report and application changes. Stands for questions from the Commission. Bill Brownlee, with M3 Companies, reviews the new submittal infonnation. Discusses the BLM exchange. Stands for questions from the Commission. Nichoel Baird Spencer, gives overview of the Southern Planning Area. Susan Buxton, City Attorney, gives overview of the proposed pre-annexation and development agreements. Stands for questions from the Commission. General discussion on open space and Eagle Regional Park. Bill Brownlee discusses the land exchange process between M3 and BLM. A short recess is called. Meeting is called back to order at 7:02 p.m. Ron Marshall, 740 Palmetto. Has lived in the area for many years. Discusses there is no water for the area. Discusses flows of artesian wells in the area. Has concerns about traffic. Lee Schrack, 485 E. Riverside Drive, involved with the Economic Development Committee. Discusses development in Eagle. Excited about the project. Believes the project will boost the economics in Eagle. Dan Richter, 1204 S. Arbor Island Place, moved from Pheonix. He is with Suncor Idaho. Discusses M3 design guidelines. Feels there should be specific constraints for traffic. Has concerns regarding water. Discusses transfer fees. Participated in the foothills planning meetings. Wants to see the foothills plan adopted and in place. Janet Fushert?, 235 W. Floating Feather. Feels the City and M3 should take time before anything plan. Would like to see a wildlife and water mitigation plan. Limits on lawn development, etc. Believes the land swap between BLM and M3 would be beneficial. Wildlife plan to include during construction. CJ Thompson, 4831 Willow Creek, here representing North Ada County Foothills. Would like the Commission to leave the public hearing open. Bill Brownlee rebuts testimony. Discusses water studies done to date. They have submitted municipal water rights application to the Department of water resources. Discusses proposed irrigation plans. Discussion regarding transfer fees. Discussion amongst the Commission. Susan Buxton discusses the changes to this application. Feels the Commission can close the public hearing for the text amendments. Guy Hendrickson, wants to respond regarding the fees. M3 should come up with a proposal for the fees for the trail systems. Barb Jekyll, 2862 N. Feels that M3 is asking for too many homes. Discusses water issues, air concerns, global warming. Feels the hearing should remain open for all items. Ron Marshall, agrees with Ms. JekyII. Discusses water issues. Feels there should be another water study by an outside source. Bill Brownlee rebuts additional testimony. Discussion amongst the Commission. Aspitarte moves to close the public hearing for ZOA-3-06, and close the public testimony CP A-5-06 for both the text and map. Discussion. Seconded by McCarrel. ALL A YES. MOTION CARRIES. Aspitarte moves to continue A-14-06/RZ-19-06 and the development agreement to the April 23,2007 at 6:30 p.m. Seconded by Felix. ALL A YES...MOTION CARRIES. Aspitarte moves to recommend denial for ZOA-3-07. Seconded by Felix. ALL A YES...MOTION CARRIES. Discussion amongst the Commission. Aspitarte moves to recommend for approval CPA-5-06 Text Amendment with the following changes, as per the development agreement. Discussion. Seconded by McCarreI. ALL AYES. MOTION CARRIES.
