CALL TO ORDER: Meeting called to order at 6:30 p.m. 2. ROLL CALL: Present: FELIX, ZASTROW, PIERCE, ASPITARTE, McCARREL 3. CONSENT AGENDA: · Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chainnan, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. · Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of March 5,2007. Zastrow moves to approve the Consent Agenda as written. Seconded by McCarrel. ALL A YES...MOTION CARRIES. 4. PUBLIC HEARINGS: A. A-02-07/RZ-02-07 & PP-04-07 - Annexation and Rezone from RUT to MU-DA and Preliminarv Plat for Greenwich Place - Land Associates: Land Associates, represented by Megan Johnson with WRG Design, are requesting annexation and rezone from RUT (Rural Urban Transitional - Ada County designation) to MU-DA (Mixed Use with development agreement) and preliminary plat approval for Greenwich Place, a 45-lot (35-buildable, 10-common) residential development. The 9.57-acre site is located on the north side of State Highway 44 (State Street) approximately 1,330 feet west of Linder Road at 5342 West State Street. Staffis requesting this item he continued to the Apri/2, 2007 meeting. McCarrel moves to continue to the April 2, 2007 meeting. Seconded by Aspitarte. ALL A YES...MOTION CARRIES. B. ZOA-04-06 - Zoninl! Ordinance Amendment - Citv of Eal!le: An Ordinance of the City of Eagle, Ada County Idaho, amending Eagle City Code Title 8 "Zoning", Chapter 2 "Zoning Districts and Map", Chapter 2A "Design Review Overlay District", Chapter 6 "Planned Unit Developments", and amending Title 9, Chapter I "General Subdivision Provisions", Chapter 2 "Subdivision Plats And Procedures", Chapter 3 "Design Standards", Chapter 4 "Required Improvements", Chapter 5 "Special Development Subdivisions", providing a severability clause; and providing an effective date. This item was continued/rom the March 5, 2007 meeting. Pierce introduces the item. Bill Vaughan, Zoning Administrator, gives a brief overview of application and asks the Commission to make recommendations to the City Council. Discussion amongst the Commission. Discussion on ownership and LLC's. Discussion on lot count flexibility for PUD's, regular subdivisions and open space. Aspitarte moves to recommend for approval ZOA-04-06 - Zoning Ordinance Amendment for City of Eagle with the following recommendations: 1. Highly encourage developers to do the Planned Unit Development route. 2. Encourage flexibility in the PUD for density versus open space. 4. Approve of the 8' path width. 5. Approve of the single ownership or control of a development project. 6. 1 acre lots are exempt from open space requirements past the 50 lot size. Seconded by Felix. Discussion. ALL AYES...MOTION CARRIES. C. RZ-28-06 & PP-22-06 - Rezone from A-R to MU-DA and Preliminarv Plat For Svmphonv Square Subdivision - Jakobson Development. LLC: Jakobson Development, LLC, represented by John Wood, is requesting rezone from A-R (Agricultural-Residential) to MU-DA (Mixed Use with a Development Agreement) and preliminary plat approval for Symphony Square Subdivision, a 24-lot (19-residential and 5-common) residential subdivision. The 6.20-acre site is located at the terminus of West Flint Road approximately 2, I 00 feet east of Park Lane at 3391 West Flint Drive. This item was continued/rom the March 5, 2007 meeting. Pierce introduces the item. Mike Williams, City Planner, makes a clarification to the staff report. Another issue to be addressed is the letter from Ballantyne Irrigation Ditch. Aspitarte moves to recommend approval RZ-28-06 & PP-22-06 - Rezone from A-R to MU-DA and Preliminary Plat for Symphony Square Subdivision with the following changes: Page 3 of 11, 3.1 - Development shall contain no more than 15 residential units. Add 3.13, which is a section that will say - To comply with the recommendation from Ballantyne Ditch Company, adopt the language that was presented to the Commission from Mr. Williams. Change on page 2 of 7 of the development agreement, on 3.1, The development shall contain no more than 15 residential units. Seconded by McCarreI. ALL A YES...MOTION CARRIES. 5. REPORTS: A.
