PLANNING & ZONING COMMISSION MINUTES

6:30 P.M.
I. CALL TO ORDER: Meeting called to order at 6:34 p.m.
2. ROLL CALL: Present: Felix, Zastrow, Pierce, Aspitarte, McCarrel.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Zastrow moves to approve the Consent Agenda as written including items A, Band C.
Seconded by McCarrel. ALL AYES...MOTION CARRIES.
4. PUBLIC HEARINGS:
A. CU-12-06 - Buildinl! Exoansion and Heil!ht Exceotion for United Methodist Church
- United Methodist Church: United Methodist Church, represented by Bruce Poe with
Cole and Poe Architects, is requesting conditional use approval for a 23,500 square foot
building expansion and building height exception of 49 feet-4 inches for the Eagle United
Methodist Church. The 4.63-acre site is located on the west side of Eagle Road
approximately Y2-mile north of the State Street at 651 North Eagle Road. This item was
continued/rom January 22,2007 meeting.
Pierce introduces the item.
Bruce Poe with Cole and Poe Architects reviews the application. Does not agree with staffs
recommendation. Discusses access points and has had meetings with ACHD. Does not agree
with City Forester's comment regarding the tree. Does not feel the new access point would
breach the root system. Asks the Commission to overturn staffs recommendation and
approve the application.
Ted Venagas, City Planner, reviews the staff report. Discusses access point and that ACHD
had said "No" the new proposed access. Discusses the valuation the City Forester gave for the
existing tree. The building needs to be brought in conformity with the EASD book.
Pierce opens the Public Hearing.

Bruce Poe rebuts testimony. Will provide a letter from ACHD regarding the access point.
Asks for clarification of the ordinance and fundamental change. Tried to submit this
application originally to staff but was held up due to nonconformance. Had made some
modifications to the application. Feels that the church's architecture should be the same.
Pierce moves to continue CU-12-06 - Building Expansion and Height Exception for
United Methodist Church upon hearing from Design Review and ACHD and leaving the
public hearing open so testimony can be taken regarding issues with the tree and the
road. Seconded by Aspitarte. ALL A YES...MOTION CARRIES.

6. ADJOURNMENT:
Zastrow moves to adjouru. Seconded by Jacobs. ALL AYES...MOTION CARRIES.
