I. CALL TO ORDER: Meeting called to order at 6:36 p.m.
2. ROLL CALL: Present: JACOBS, ZASTROW, PIERCE, ASPITARTE, McCARREL.
3. CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
· Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Lonesome Dove. LLC: Lonesome Dove, LLC, represented by Kevin McCarthy with
Toothman-Orton Engineering Company, is requesting preliminary plat approval for
Lonesome Dove Subdivision, a 117-lot subdivision, 22 I-unit (lOI-single-family, 120
multi-family (contained within 3-lots), 4-commercial, and 9-common) The 41.20-acre site
is generally located on the southwest comer of Riverside Drive and State Street at 1505
Riverside Drive.
Aspitarte asks that item C be removed for discussion.
Pierce removes item C from the consent agenda.
Jacobs moves to approve the consent agenda items A and B with the exception of C.
Seconded by McCarrel. ALL A YES... MOTION CARRIES.

A. V AC-3-06 - Request for a Vacation of Two Lot Line Easements within Rivervine
Subdivision - Grant N Lee. Jovce M. Lee. Doul!las L. Swenson and Suzann Swenson:
Grant N. Lee, Joyce M. Lee, Douglas L. Swenson and Suzann Swenson are requesting a

vacation of two lot line easements within Rivervine Subdivision Block I, between Lots 7
and 10 and Lots 10, II and 13, located in Ada County at 827 S. Hidden Creek Lane.

Commission.
Aspitarte moves to recommend approval of V AC-3-06 - Request for a Vacation of Two

5. PUBLIC HEARINGS:
A. A-I5-06 & RZ-20-06 - Annexation and Rezone From RR to MU-DA for a Multi-
Familv Residential Condominium Housinl! Development - Orchards at Eal!le. LLC:
Orchards at Eagle, LLC, represented by The Land Group, Inc., is requesting approval of
an annexation and a rezone with a development agreement from RR (Rural Residential) to
MU-DA (Mixed Use with a development agreement) for The Orchards at Eagle, a 74-unit
multi-family residential condominium housing development. The 24.87-acre site is located
270 feet south of W. State Street, on the west side of S. Linder Road at 4831 and 4843 W.
Old Valley Road. This item was continued from the December 4, 2006 meeting.
The public hearingfor this item was left open from the December 4, 2006 meeting.
Pierce introduces the item.
Jason Densmer, with the Land Group, discusses some of the items that the application was
tabled for. Have been unsuccessful in reaching ITD. Displays revisions to the sight plan.
Mike Williams, City Planner, discusses issues with ITD and that Jason Densmer has been
unable to get a response. Discusses the MOA and that there has not been one signed.
Discusses the new site plan and side walks. Stands for questions from the Commission.
Jason Densmer rebuts testimony. Would like to have some of the conditions reviewed and
possibly stricken. Discusses the Comprehensive Plan. Stands for questions from the
Commission.
Mike Williams discusses the conditions.
Jason Densmer discusses the sidewalk issue. Feels that there should not have to be sidewalks
on both sides of the road.
Pierce closes the public hearing.

Aspitarte moves to recommend approval of A-I5-06 & RZ-20-06 _ Annexation and
Rezone From RR to MU-DA for a Multi-Family Residential Condominium Housing
Development - Orchards at Eagle, LLC, leave 3.9 the same, I am changing 3.22 to reflect
the number of dwelling units located south of the pond within the comprehensive plan
designated residential one shall not exceed one unit per acre. I am striking 3.23. I am
adding this language that a letter requesting communication and or guidance is sent to
Sue Sullivan with a copy sent to Kevin

presented to Mike Williams of the City of Eagle. The Memorandum of Agreement shall
be agreed to and negotiated before presented to the City Council. Seconded by

Aspitarte moves to recommend for approval-I5-06 & RZ-20-06 _ Annexation and
Rezone From RR to MU-DA for a Multi-Family Residential Condominium Housing
Development - Orchards at Eagle, LLC. With 3.9 to reflect a revised concept plan shall
be provided showing sidewalks or pathways adjacent to one side of drive aisles
providing access to the units to provide pedestrian connectivity between residential units
prior to submitting a Design Review Application. 3.22 to reflect the number of dwelling
units located south of the pond within the comprehensive plan designated residential one
shall not exceed one unit per acre and 3.23 is stricken. Another Condition _ A letter
requesting communication and/or guidance is sent to Sue Sullivan with a copy sent to
Kevin within one week of tonight's meeting, 1/8/07 and copies of said letter is presented
to Mike Williams ofthe City of Eagle. Seconded by Zastrow. FOUR AYES (Pierce,
Aspitarte, Zastrow, Jacobs) ONE NAY. (McCarrell) MOTION PASSES...
B. RZ-22-06 - Rezone From A-R to R-E-DA - John Johnston: John Johnston,
represented by Doug Russell, ASLA with The Land Group, Inc., is requesting approval of
a rezone from A-R (Agricultural-Residential) to R-E-DA (Residential-Estates with
development agreement). The 4.74-acre site is located on the southeast comer of North
Beverly Drive and Floating Feather Road at 1200 North Beverly Drive.
Pierce introduces the item.
Doug Russell, with the Land Group, reviews the application. Stands for questions from the
Commission.
Mike Williams, City Planner, reviews the staff report.
Pierce opens the public hearing.
Jason Densmer, with the Land Group, discusses the sewer lines in the area and also for Sylvan
Wood Subdivision.
Doug Russell rebuts testimony. Stands for questions from the Commission.

Aspitarte moves to recommend for approval RZ-22-06 - Rezone from A-R to R-E-DA _
John Johnston with the language on 2.5 - a 9 foot wide compacted gravel shoulder
adjacent to Floating Feather shall be installed except where limited by the ditch or canal
shall be installed as a pedestrian pathway prior to the City Clerk signing a Lot Split
record of Surveyor subdivision plat. Strike 2.6. 2.7 - Prior to signing lot split record of
surveyor Subdivision Plat the Property Owner shall provide proof of adequate sanitary
services and water services to the existing and proposed residential uses. A letter
approving a lot split or subdivision for this site shall be provided to the City from the
Idaho Department of Health, Division of Environmental Quality, and/or Central Distriet
Health, prior to the City Clerk signing a lot split record of surveyor subdivision plat.
Strike 2.8. 2.11 and 2.12. A 35 foot landscape buffer shall be approved by Design

Discussion. John McFadden, City Attorney, explains that this will go forward to Council
without a recommendation from the Commission because the motion died.
A short recess is called.

C. CU-ll-06 - Conditional Use Approval for a Childcare and Elementa" School
Facility - Genesis One. LLC: Genesis One, LLC, represented by Travis Burrows with
Dave Evans Construction, is requesting conditional use approval for a 4,200-square foot
elementary school and daycare facility. The 0.33-acre site is located on the south side of
East Iron Eagle Drive, approximately Y. mile west of Edgewood Lane at 1167 East Iron
Eagle Drive (Lot 9, block I, Merrill Subdivision No.5).

D. A-18-06/RZ-24-06 & PP-21-06 - Annexation and Rezone from RUT to MU-DA and
Preliminary Plat for Eagle Gateway South - Cornerstone Group, LLC: Cornerstone
Group, LLC, represented by Walter Lindgren with Johnson Architects and Morton
McMillen, PE, with McMillen Engineering, LLC, is requesting approval of an annexation
and rezone from RUT (Rural Urban Transition) to MU-DA (Mixed Use with a
development agreement in lieu of a PUD) and preliminary plat for Eagle Gateway South, a
mixed use commercial and residential development. The 57.44-acre, 102-lot subdivision,
114-unit (72-single-family, 42-multi-family (contained within 5-lots), 16-commercial, and
10-common) is located on the southeast comer of State Highway 44 and E. Riverside
Drive at 1650 E. Riverside Drive. Staffis requesting this item be continued to the
January 22, 2007 meeting.
Zastrow moves to continue A-I8-06/RZ-24-06 & PP-21-06 - Anneution and Rezone
from RUT to MU-DA and Preliminary Plat for Eagle Gateway South _ Cornerstone
Group, LLC to January 22. Seconded by Aspitarte. ALL A YES...MOTION
