I. CALL TO ORDER: Meeting called to order at 6:35 p.m.
2. ROLL CALL: Present: JACOBS, ZASTROW, PIERCE, ASPITARTE, McCARREL.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Jacobs moves to accept the consent agenda as presented. Seconded by McCarrel. ALL

4. UNFINISHED BUSINESS:
A. A-ll-061RZ-13-06 & PP-13-06 - Annexation and Rezone from RUT to MU-DA and
Preliminarv Plat for ADlder's Hamlet Subdivision - Rovlance Investments. LLC and RT
Nahas ComDanv: Roylance Investments, LLC and RT Nahas Company are requesting an
annexation and a rezone with a development agreement from RUT (Rural Urban Transition) to
MU-DA (Mixed Use with a Development Agreement) and preliminary plat approval for
Angler's Hamlet Subdivision, a 42-10t (37-residential, 5-common) residential subdivision.
The 10-acre site is located approximately 400-feet southwest of the intersection of North Park
Lane and State Highway 44, on the south side of West Old Valley Road at 4171 W. Old
Valley Road. This item was continuedfrom the October 23,2006 meeting.
Mike Williams, City Planner, discusses concerns the Commission had at the previous meeting.
Discusses rear setbacks and easement issues. Recommendation often feet for pathway setbacks.
Site Specific Condition #21, side street setbacks of 20 feet. Applicant has requested 10 feet
setbacks on side street. #11 easement. Stands for questions from the Commission.
Bonnie Harper, Corinthian Homes. Discusses side street setbacks. Asks for reductions in
setbacks.
Discussion amongst the Commission.
John McFadden, City Attorney, discusses CC&R's.
Aspitarte moves to recommend for approval A-ll-061RZ-13-06 & PP-13-06 - Annexation
and Rezone from RUT to MU-DA and Preliminary Plat for Angler's Hamlet Subdivision _
Roylance Investments, LLC and RT Nahas Company with the change on 2.6, side street 20
feet, reduce that to 10. On Site Specific Condition of Approval #11, page 4, change wide
rear lot line easement from centered to adjacent on all rear lot lines. Cbange Site Specific
Condition #21, on page 5, from 15 feet to 10 feet. On Site Specific Condition #22, change

with a root barrier required. The final condition is that in the CC&R's it is included that
there will be probable traffic impacts with future developments east of the present
development. Seconded by Zastrow. Discussion. Aspitarte amends his motion that staff
changes and recommendations are adopted in mass and that the setbacks be reduced on Old
Valley Road be reduced to 5 feet because of the common areas will add additional footage.
Second concurs. Discussion. ALL AYES...MOTION CARRIES.
5. PUBLIC HEARINGS:

A. A-15-06 & RZ-20-06 - Annexation and Rezone from RR to MU-DA for a Multi-Familv
Residential Condominium Housinl! Develonment - Orchards at Eae:le. LLC: Orchards at
Eagle, LLC, represented by Jason Densmer with The Land Group, Inc., is requesting approval
of an annexation and a rezone with a development agreement from RR (Rural Residential) to
MU-DA (Mixed Use with a Development Agreement) for The Orchards at Eagle, a 74-unit
multi-family residential condominium housing development. The 24.87-acre site is located
270-feet south of West State Street, on the west side of South Linder Road at 4831 West Old
Valley Road. Staffis requesting this item be continued to the December 4,2006 meeting.
McCarreI moves to continue this to the December 4,2006 meeting. Seconded by Aspitarte.

Overlay District", Chapter 6 "Planned Unit Developments", and amending Title 9, Chapter 1
"General Subdivision Provisions", Chapter 2 "Subdivision Plats And Procedures", Chapter 3
"Design Standards", Chapter 4 "Required Improvements", Chapter 5 "Special Development
Subdivisions", providing a severability clause; and providing an effective date. Staffis
requesting this item be continued to the November 20, 2006 meeting.
Zastrow moves to continue ZOA-04-06 - Zoning Ordinance Amendment - The City of Eagle

C. PP-16-06 - Preliminarv Plat for Eal!le Creek West Subdivision - JLJ Enternrises. LLC:
JLJ Enterprises, LLC, represented by Phil Hull with The Land Group, Inc., is requesting
preliminary plat approval for Eagle Creek West Subdivision, a ll4-lot (98-buildable, 16-
common) subdivision. The 33.46-acre subdivision is located approximately I ,640-feet north
of State Highway 44, on the west side of North Linder Road at 839 North Linder Road.

Aspitarte moves to recommend for approval PP-16-06 - Preliminary Plat for Eagle Creek
West Subdivision - JLJ Enterprises, LLC with the provision that the City and the applicant
will be entering into Memorandum of Agreement regarding developing a municipal water
system for the site. Site Specific Condition #8 changed; the pathway to be located between
lots 6 and 7 of block one for review and approval of parks and pathways. Strike #9 entirely.
Seconded by Zastrow. ALL AYES...MOTION CARRIES.
D. RZ-18-06 and PP-17-06 - Rezone from A-R to R-I-DA and Preliminarv Plat for Overton
Acres Subdivision - William and Wanda Overton: William and Wanda Overton,
represented by Richard Beck with SLN Planning Inc., is requesting a rezone from A-R
(Agricultural-Residential) to R-I-DA (Residential One with a Development Agreement) and
preliminary plat approval for Overton Acres Subdivision. The 4.66-acre, 7-lot subdivision (4-
residential lots and 3-common lots) is located on the west side of North Locust Grove Road
approximately 1,000 feet north of Chin den Boulevard at 6799 North Locust Grove Road.
