1. CALL TO ORDER: Meeting called to order at 6:37p.m.

3. PUBLIC HEARINGS:
A. A-ll-061RZ-13-06 & PP-13-06 - Annexation and Rezone from RUT to MU-DA and
Preliminarv Plat for Ane:ler's Hamlet Subdivision - Rovlance Investments. LLC and RT
Nahas ComDanv: Roylance Investments, LLC and RT Nahas Company are requesting an
annexation and a rezone with a development agreement from RUT (Rural Urban Transition) to
MU-DA (Mixed Use with a Development Agreement) and preliminary plat approval for
Angler's Hamlet Subdivision, a 42 lot (37 residential, 5 common) residential subdivision. The
10-acre site is located approximately 400 feet southwest of the intersection ofN. Park Lane
and State Highway 44, on the south side ofW. Old Valley Road at 4171 W. Old Valley Road.
This item was continuedfrom the October 2,2006 meeting.
Pierce introduces the item.
Mark Butler reviews the application and presents a PowerPoint presentation.
Bonnie Harper, 391 W. State, discusses the housing types for the project. The homes would be
more of a Tuscan style. Discusses the streetscapes and pathways.
Mark Butler discusses the regional pathway connection. Would like to keep the existing house on
the property and asks that the pathway departs from the river. Asks the Commission for some
changes to the conditions in the staff report. Stands for questions from the Commission.
Susan Buxton, City Attorney, asks about the Ballantyne Ditch.and conservation of wetlands.
Rick Collingwood, with Toothman Orton, discusses the Ballantyne Ditch.
Mike Williams, City Planner, reviews the staff report and the conditions. Stands for questions
from the Commission.
A short recess is called.

Pierce opens the public hearing.
William Frost, 4015 Old Valley Road. Discusses a letter addressing some concerns that was
submitted to the Commission for the record.
Foad Rhogani, Eagle.. Discusses a few items from the letter he submitted for the record. Asks
that these requests be included in the CC&R's for this application.
Marian Moore, 4210 Old Valley Road. Discusses the history of the parcel of ground in question.
Rick Collingwood, Toothman Orton. Discusses drainage and easements.
Mark Butler rebuts testimony.
Bonnie Harper discusses courtyards and the sizes of the homes. Also discusses the appearance of
the entrance to the subdivision.
Pierce doses the public hearing.

B. CPA-I0-06 - Avimor LLC.: Avimor, LLC., represented by Robert Taunton, is requesting a
Comprehensive Plan Map and Text Amendment to include +/- 20,080 acres into the Eagle
Comprehensive Plan designating the following new land use designations +/- 6,290 acres
Foothills Cluster Development (1-2 units per acre) and +/- 13,790 acres Foothills
Conservation Development (I unit per 40 acres). The +/- 20,080-acre site is generally located
from Highway 55 on the east to Willow Creek Road via Big Gulch on the west, the northern
boundary is approximately five miles north of the Ada/Gem County line, the southern
boundary abut the Connolly and Kastera properties. Specifically described in the meets and
bounds description on file at the City of Eagle.
Pierce introduces the item.
Nichoel Baird Spencer, City Planner, informs the Commission the applicant would like to have the
item tabled.
Mike Wardle, with Suncor Development, requests the item be tabled.
Zastrow moves to continue CP A-I0-06 - Avimor LLC to the October 30, 2006. Seconded by
McCarrel. ALL A YES...MOTION CARRIES.

RE: A-11-06/RZ-13-06 Annexation and Rezoning of Angler's Hamlet Subdivision
Dear Commissioners:
SAF, LLC owns the property bordering the east boundary of the subject subdivision.
Frost family own 17+ acres to the SE of this development. SAF, LLC property is
currently zoned as mixed use in the comprehensive plan. Frost property is currently
zoned as R-1. We reviewed the subject development with the owner's representatives.
We were pleased with their presentation and plan and are in favor of this development.
In the future we may decide to develop our properties with the same or comparable
densities and our only access is through this development. The following items are our
concerns that we discussed with the developer's representatives. We were assured that
these concerns will be taken into consideration as they proceed with their plan.
1- We requested a sewer manhole with connection point, 8 inch pipe size and
adequate depth for gravity flow at the end of the proposed road stub to the SAF,
LLC property.
2- Since our properties are lower in elevation than the proposed development we
requested proper design to handle storm water away from our properties.
3- Meeting Eagle Fire Department criteria was another item of concern. Based on his
discussions with Eagle Fire Marshall, the developer's representative assured us
the current road design is adequate to handle our development without a need for
a escape route.
4- Owner's representative met with us and Ryan McDaniel, ACHD representative.
Ryan McDaniel confirmed the owner's representative discussion that proposed
road designs will be adequate to handle the traffic for less than 100 homes on our
properties without a need for additional access roads should we decide to develop.
5- Since the future home owners may object to the traffic flow from our
developments, we request the developer to include a language in their CC&Rs
stating approximately 25 acres of land to the E-SE of this development will be
developed with comparable density. The traffic from these developments will
flow through the streets of this subdivision. We would like to review and approve
this language, before the developer's CC&R is finalized.
