I. CALL TO ORDER: Meeting called to order at 6:34 p.m.
2. ROLL CALL: Present: PIERCE, ASPITARTE, LIEN, ZASTROW. Absent: JACOBS.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner. member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence detennined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

Business Park to Mixed Use. Rezone with Develooment Al!reement from BP to MU-DA.
Vaeation of MeGrath Road and Preliminarv Plat for Eal!le Gatewav Subdivision-
Cornerstone Grouo. LLC.: Cornerstone Group, LLC., represented by Walter Lindgren, with
Johnson Architects, is requesting a Comprehensive Plan Map Amendment from Business Park
to Mixed Use, a Rezone with a Development Agreement from BP (Business Park) to MU-DA
(Mixed Use with a development agreement), a vacation and realignment of McGrath Road
through the site and a Preliminary plat for an II lot commercial/retail subdivision. The 9.5-
acre site is located at the southwest corner of McGrath Road and State Street, north of State
Highway 44 at 160 I and 1782 McGrath Road. Staff is requesting this item be continued to
the August 21,2006 meeting.

DA. Preliminarv Plat for the Lofts at Eal!le River and Conditional Use for a Heil!ht
Exeention - Sea 2 Sea. LLC.: Sea 2 Sea, LLC, represented by Mark Butler with Land
Consultants, Inc., is requesting approval of an annexation and a rezone from RUT (Rural
Urban Transition) to MU-DA (Mixed Use with a Development Agreement), preliminary plat
approval for the Lofts at Eagle River, an 8 lot (7-residential, I-common), 2l4-unit multi-
family condominium/townhouse housing development and conditional use pennit approval for
a height exception of 49-feet, 2 ]j,,-inches for the condominiums and 36-feet. 7-inches for the

Use for a Height Exception - Sea 2 Sea, LLC. to the September 5, 2006 meeting. ALL
AYES. ..MOTION CARRIES.
B. PPIFP-OI-06 - Combined Preliminarv & Final Plat for Golf Pond Subdivision - Trov
Coooer: Troy Cooper is requesting combined preliminary plat and final plat approval for
Golf Pond Subdivision, a 2 lot residential subdivision. The 0.50-acre site is located at 600
North Edgewood Lane at the intersection of North Eagle Hills Way and North Edgewood
Lane. This item was continued/rom the July 17, 2006 meeting.
Pierce introduces the item.
Mike Engebritson, Boise, Idaho, discusses the application and a letter from ACHD regarding the
access Issues.
Mike Williams, City Planner, reviews the staff report and letter received from ACHD regarding
the accesses for the lots.
Pieree opens the public hearing.
Alma Marvin, 772 N. Edgewood. Discusses the existing driveway. Feels that the lot would be too
small for the existing neighborhood.
Kent Nigaard, 820 N. Edgewood. Does not feel that anything would fit on the lot that would be
comparable to the existing neighborhood.
Chuck Liehe, 602 N. Edgewood Lane. Discusses a permanent easement along the property.
Opposes the application.
Mike Engrenson rebuts testimony.
Mike Williams discusses some points of clarification regarding setbacks and easement issues.
Pierce closes the Public Hearing.

Zastrow moves to deny PPIFP-OI-06 - Combined Preliminary & Final Plat for Golf Pond
Subdivision reason being it is eounter to existing City Code allowing more than two lots
aeeess from the same drive. Seeonded by Aspitarte. ALL AYES...MOTION CARRIES.
C. RZ-15-06 - Rezone from R-4 to CBD-DA - Ideal GrouD. LLC.: Tana Hendren with Ideal
Group, LLC., is requesting approval of a rezone from R-4 (Residential four) to CBD-DA
(Central Business District with development agreement). The 0.45-acre site is located on the
west side of North Eagle Road approximately 500-feet north of State Highway 44 at 265 North
Eagle Road. This item was continued/rom the July 17,2006 meeting.
Pierce introduces the item.
Jim Meyers, one ofthe owners of the project, reviews the application.
Mike Williams, City Planner, reviews the staff report. A Design Review application is required
for this area. Stands for questions from the Commission.

Aspitarte moves to recommend for approval RZ-15-06 - Rezone from R-4 to CBD-DA-
Ideal Group, LLC., with staff recommendations. Seeonded by Lien. ALL
A YES...MOTION CARRIES.
D. A-13-06/RZ-16-06 & PP-14-06 - Annexation and Rezone RUT to R-I-DA and
Preliminarv Plat for Svlvan Wood Subdivision - Svlvan Wood I. LLC.: Sylvan Wood I,
LLC, represented by Phil Hull with The Land Group, Inc., is requesting an annexation and
rezone from RUT (Rural Urban Transitional) to R-I-DA (Residential one unit per acre with a
development agreement) and preliminary plat approval for Sylvan Wood Subdivision, a 31-lot
(24-residential, 7-common) residential subdivision. The 25.4I-acre site is located on the
southwest corner of Ballantyne Lane and Floating Feather Road at 843N. Ballantyne Lane.
This item was continued/rom the July 17,2006 meeting.

and Rezone RUT to R-I-DA and Preliminary Plat for Sylvan Wood Subdivision - Sylvan
Wood I with the additional language and adding a new Site Specific Condition of Approval
that says (the applieant) provide a revised preliminary plat showing an approved turn
around and cul-de-sae at 500 feet to be submitted prior to the Design Review application.
Seconded by Lien. ALL A YES...MOTION CARRIES.
